The family of a 35-year-old man who was shot to death by Long Beach police after they mistook a water hose nozzle he was holding for a handgun was awarded $6.5 million in damages by a federal jury Thursday.





After a day of deliberations, the jury found that two officers violated Douglas Zerby's constitutional rights and were negligent in the December 2010 fatal shooting outside his Belmont Shore apartment.



Attorneys for Zerby's son and parents argued that officers never delivered any verbal warning to Zerby and that it was a case of contagious fire where one officer fired by mistake, prompting another officer to shoot based on the belief he was under fire.



By contrast, attorneys for the city argued that Officer Jeff Shurtleff, a six-year veteran, and Officer Victor Ortiz, a 10-year veteran, opened fire because they believed that Zerby was about to shoot them and mistook the nozzle for a handgun.



To bolster their argument, they noted that prosecutors declined to charge the officers' finding that Zerby was in possession of an object believed by both residents and responding officers to be a firearm, and that the position of his arms was consistent with someone making a motion to point a gun and shoot.



Attorney Dale Galipo, however, argued to jurors that officers were concealed and covered before they delivered the deadly rounds in the 5300 block of East Ocean Boulevard. Experts testified it was unlikely Zerby was standing up with his hands outstretched pointing the nozzle at police because he lacked hand wounds consistent with that position.



At the time, authorities said they were on their way to an apartment in the Belmont Shore neighborhood after someone reported seeing a man with a handgun.



Zerby was sitting outside a friend's apartment, holding what police believed was a handgun, pointing it to his side and waving it around as Ortiz and Shurtleff took cover inside a nearby apartment.



The officers did not attempt to identify themselves to Zerby nor did they order him to drop his weapon, according to a district attorney's report.



The officers requested additional officers, a police helicopter and the Long Beach Police Department's mental evaluation team. But the officers told investigators Zerby pointed the nozzle at them, prompting their gunfire.



Ortiz was 38 feet away when he fired his shotgun and Shurtleff was about 23 feet away when he fired his handgun.



Zerby was pronounced dead at the scene and a black pistol-grip water nozzle with a metal tip was recovered.



A third officer watched Zerby from 56 feet away through the telescopic sight of a rifle but did not fire, according to a prosecutor's declination.



An autopsy showed that Zerby had been shot 12 times. He had a blood-alcohol level of 0.42% and had valium and THC in his system at the time of his death.</description>

A Riverside police officer nearly killed in an ambush by rogue ex-cop Christopher Dorner made his first public appearance since the shooting, at an emotional dinner where he was greeted warmly by friends and admirers and shared a table with the wife of his late training officer.



Officer Andrew Tachias was sitting in his patrol car with Officer Michael Crain on Feb. 7 when Dorner pulled alongside them at a stoplight and opened fire.



Crain was killed. Tachias, who is still recovering, was shot eight times.



&quot;I think he's like all of us. It's ups and downs,&quot; Crain's widow, Regina, said of Tachias. &quot;One minute you're fine, and the next you are in a hole.&quot;



She added the dinner was the first time she and Tachias, 27, had met.



The officer, whose wounded hands were encased in protective coverings, has said he wants to return to work.



&quot;I'm absolutely speechless for him to be back in this environment,&quot; said Officer Scott Levesque, who was among those at the event at Riverside's Original Roadhouse Grill.



The dinner capped a daylong fundraiser for the families of Tachias and Crain. It drew so many people that at one point, the restaurant ran out of silverware, the Riverside Press-Enterprise reported Tachias, dressed in a gray and black striped hoodie and sporting a beard, was greeted with hugs when he arrived at about 8 p.m. and took a table with Crain's widow.



&quot;To be close to the person who was with him last is comforting to me,&quot; Regina Crain said.



Crain's father also attended the event, along with Riverside Police Chief Sergio Diaz and Lt. Larry Gonzalez, the watch commander on duty when Crain and Tachias were attacked.



Dorner went on a rampage after he was fired by the Los Angeles Police Department for filing a false report.



He killed four people and wounded Tachias before committing suicide Feb. 12 after he was cornered in a mountain cabin near Big Bear Lake.



Authorities surrounded the cabin after a wild chase that began when Dorner tied up a couple and stole their car, crashed it and carjacked another vehicle at gunpoint, then crashed that one and fled to the cabin.</description>

In a misleading article in the   New York Times  , attorney, activist, law professor, and former Soros Justice Fellow,  Michelle Alexander  charges that all police officers &quot;have a special inclination toward confabulation&quot; and the current &quot;era of mass incarceration&quot; bolsters this inherent &quot;incentive to lie.&quot;



Her innuendo suggests that anyone aspiring to become, or who is or has been, a police officer is a natural liar, either born or bred.



The problem begins with the article's deceptive title, &quot;Why Police Officers Lie Under Oath.&quot; Meant to attract the attention of true believers, Ms. Alexander's polemic neither persuades nor informs. She offers no new insights into what she claims to be a pandemic among law enforcement officers.



 A Silly, Specious Argument 
Alexander instead parrots a progressive narrative that uses allegations (and the conviction of corrupt police officers) to smear a profession as if the reported actions by individual officers in, for example, San Francisco and New York City condemns as liars the vast majority of honest officers not only in those two coastal cities, but in all the places in between.



The only officers who tell the truth, apparently, are those who claim police officers lie. Nothing could be further from the truth.



The collectivist charge that police officers lie because they're the police is silly. For a few officers, lying is a choice - sometimes in the interests of self-preservation and sometimes for reasons of misguided altruism.



Other officers may appear to &quot;lie&quot; (likely in Alexander's estimation) because of the varying memories of others involved in a rapidly-evolving and potentially-violent situation, an occurrence that researchers at Force Science Institute have studied in depth.



For Michelle Alexander, regardless of the circumstances or science, police officers lie.



 A San Francisco Example 
To make her point, Alexander quotes Peter Keane, who she describes as a &quot;law enforcement official&quot; and a former San Francisco police commissioner.



She probably hopes that the NYT's readers will confuse a San Francisco police commissioner with that of the police commissioner in New York City, who is a real law enforcement official. She omits Keane's former employment as a supervisory attorney in San Francisco's Public Defenders' Office.



Based on his San Francisco experience, Keane writes in an  opinion article  that police lying is a &quot;routine way of doing business in courtrooms throughout America...&quot;



He focuses his most pointed criticism on drug cops, who he says depend on arrests and convictions for promotion and lapdog judges to provide the coddling environment in which they prosper.



Meanwhile, Back in New York
Alexander then turns her ire toward the New York Police Department. She mentions that in &quot;...2011, hundreds of drug cases were dismissed after several police officers were accused of mishandling evidence.&quot;



Exactly what &quot;mishandling evidence&quot; means is unclear, and the original   New York Times   article on which her comment may be based doesn't provide clarity. Though troublesome, accusations of mishandling evidence are likely different than lying under oath and Alexander probably hopes the reader doesn't care about the difference.



Alexander quotes the late Justice Gustin L. Reichback of the State Supreme Court in Brooklyn,  who condemns , a &quot;culture of lying and corruption in the   drug enforcement units&quot; similar to that found in San Francisco.



Justice Reichback made his comments while presiding over the conviction of former NYPD Detective Jason Arbeeny, whose trial was part of a larger probe into reports that Brooklyn South narcotics officers routinely planted evidence that led to wrongful convictions.



Moved by a post-conviction mea culpa, the Judge granted Arbeeny's  request for probation .



So, who was Justice Reichback?



Though well respected for his strong work ethic, he was an elected judge with a  notoriously radical past . In law school he moonlighted as the commissar of Columbia University's chapter of Students for a Democratic Society.



Fresh out of law school, Reichback gravitated to the New York Law Commune that provided legal assistance to the Black Panthers - at a time when they used more than clubs to intimidate voters.



He also co-authored The Bust Book with, among others, Bryn-Mawr and University of Leningrad educated Kathy Boudin, then on the FBI's most wanted list for inadvertently blowing up a townhouse in trendy Greenwich Village. She eventually pled guilty to robbery and the murder of a policeman during an armored car holdup. While in prison, Bill Ayers and Bernardine Dohrn raised her son, Chesa Boudin, who later attends Yale and earns a Rhodes scholarship.



In December 2010 Judge Reichback released 17-year-old cop shooter  Elijah Foster-Bey  in time to spend Christmas with his family. The wounded officer, 29-year-old Richard Ramirez, remained in hospital concerned about  losing his leg . Seven months later a different judge revoked  Foster-Bey's bail  as evidence emerged that he was not the stalwart citizen Judge Reichback believed him to have been.



She then uses the Urban Justice Center's Police Reform Organizing Project  as further evidence  of police lying, though the project is more about NYPD's controversial stop-and-frisk policies. Ms. Alexander quotes a former NYPD officer, Adil Polanco, who says that NYPD supervisors force officers to make bad arrests.



This information is not new and likely originates from a series of articles in the   Village Voice   that allege some NYPD supervisors, along with select union representatives, routinely pressure officers to make arrests for minor violations (that's limiting an officer's discretion!) and take other questionable action under the color of their authority to meet CompStat quotas.



Michelle Alexander takes her anger at the criminal justice system out on the lowest hanging fruit - the police. That's unfortunate and does little to either advance the debate or add a mature voice to an already crowded field of critics. But it was enough to get her diatribe in the New York Times.</description>

BAKERSFIELD, Calif. - A witness said that a Bakersfield police patrol car was destroyed after an officer reportedly took it out for a joy ride on Saturday. 



On March 16, an unnamed witness said they saw the officer in a new Ford Inceptor patrol car driving along the Westside Parkway .  The witness said the officer told them he had driven it out there to see how fast the patrol car could go.



While driving on the unfinished parkway, a witness said the officer hit a foot deep gap in the pavement, wrecking the patrol car.   



The witness said no fire officials or ambulances were called out to the scene, but other officers with the Bakersfield Police Department and a tow truck did go to the scene to clean the wreckage up. 



The same witness also said he was told to delete photos of the accident from his cell phone and that BPD officials told him &quot;this never happened.&quot; 



The BPD Public Information Officer, Michaela Beard, said is an internal investigation going on regarding the wrecked patrol car.  Due to the investigation, Beard said they couldn't comment further. 



A spokesman for TRIP, the governmental agency overseeing the road project, declined comment and referred us back to Bakersfield Police.



The new BPD patrol cars were recently introduced in January.  Unlike the old cars, the Interceptor has all-wheel drive, quicker acceleration, better handling and gas mileage.</description>

I write this letter on the 10th anniversary of the Iraq War on behalf of my fellow Iraq War veterans. I write this letter on behalf of the 4,488 soldiers and Marines who died in Iraq. I write this letter on behalf of the hundreds of thousands of veterans who have been wounded and on behalf of those whose wounds, physical and psychological, have destroyed their lives. I am one of those gravely wounded. I was paralyzed in an insurgent ambush in 2004 in Sadr City. My life is coming to an end. I am living under hospice care.

I write this letter on behalf of husbands and wives who have lost spouses, on behalf of children who have lost a parent, on behalf of the fathers and mothers who have lost sons and daughters and on behalf of those who care for the many thousands of my fellow veterans who have brain injuries. I write this letter on behalf of those veterans whose trauma and self-revulsion for what they have witnessed, endured and done in Iraq have led to suicide and on behalf of the active-duty soldiers and Marines who commit, on average, a suicide a day. I write this letter on behalf of the some 1 million Iraqi dead and on behalf of the countless Iraqi wounded. I write this letter on behalf of us all-the human detritus your war has left behind, those who will spend their lives in unending pain and grief.

    You may evade justice but in our eyes you are each guilty of egregious war crimes, of plunder and, finally, of murder, including the murder of thousands of young Americans-my fellow veterans-whose future you stole.

I write this letter, my last letter, to you, Mr. Bush and Mr. Cheney. I write not because I think you grasp the terrible human and moral consequences of your lies, manipulation and thirst for wealth and power. I write this letter because, before my own death, I want to make it clear that I, and hundreds of thousands of my fellow veterans, along with millions of my fellow citizens, along with hundreds of millions more in Iraq and the Middle East, know fully who you are and what you have done. You may evade justice but in our eyes you are each guilty of egregious war crimes, of plunder and, finally, of murder, including the murder of thousands of young Americans-my fellow veterans-whose future you stole.

Your positions of authority, your millions of dollars of personal wealth, your public relations consultants, your privilege and your power cannot mask the hollowness of your character. You sent us to fight and die in Iraq after you, Mr. Cheney, dodged the draft in Vietnam, and you, Mr. Bush, went AWOL from your National Guard unit. Your cowardice and selfishness were established decades ago. You were not willing to risk yourselves for our nation but you sent hundreds of thousands of young men and women to be sacrificed in a senseless war with no more thought than it takes to put out the garbage.

I joined the Army two days after the 9/11 attacks. I joined the Army because our country had been attacked. I wanted to strike back at those who had killed some 3,000 of my fellow citizens. I did not join the Army to go to Iraq, a country that had no part in the September 2001 attacks and did not pose a threat to its neighbors, much less to the United States. I did not join the Army to &quot;liberate&quot; Iraqis or to shut down mythical weapons-of-mass-destruction facilities or to implant what you cynically called &quot;democracy&quot; in Baghdad and the Middle East. I did not join the Army to rebuild Iraq, which at the time you told us could be paid for by Iraq's oil revenues. Instead, this war has cost the United States over $3 trillion. I especially did not join the Army to carry out pre-emptive war. Pre-emptive war is illegal under international law. And as a soldier in Iraq I was, I now know, abetting your idiocy and your crimes. The Iraq War is the largest strategic blunder in U.S. history. It obliterated the balance of power in the Middle East. It installed a corrupt and brutal pro-Iranian government in Baghdad, one cemented in power through the use of torture, death squads and terror. And it has left Iran as the dominant force in the region. On every level-moral, strategic, military and economic-Iraq was a failure. And it was you, Mr. Bush and Mr. Cheney, who started this war. It is you who should pay the consequences.

 

I would not be writing this letter if I had been wounded fighting in Afghanistan against those forces that carried out the attacks of 9/11. Had I been wounded there I would still be miserable because of my physical deterioration and imminent death, but I would at least have the comfort of knowing that my injuries were a consequence of my own decision to defend the country I love. I would not have to lie in my bed, my body filled with painkillers, my life ebbing away, and deal with the fact that hundreds of thousands of human beings, including children, including myself, were sacrificed by you for little more than the greed of oil companies, for your alliance with the oil sheiks in Saudi Arabia, and your insane visions of empire.

I have, like many other disabled veterans, suffered from the inadequate and often inept care provided by the Veterans Administration. I have, like many other disabled veterans, come to realize that our mental and physical wounds are of no interest to you, perhaps of no interest to any politician. We were used. We were betrayed. And we have been abandoned. You, Mr. Bush, make much pretense of being a Christian. But isn't lying a sin? Isn't murder a sin? Aren't theft and selfish ambition sins? I am not a Christian. But I believe in the Christian ideal. I believe that what you do to the least of your brothers you finally do to yourself, to your own soul.

My day of reckoning is upon me. Yours will come. I hope you will be put on trial. But mostly I hope, for your sakes, that you find the moral courage to face what you have done to me and to many, many others who deserved to live. I hope that before your time on earth ends, as mine is now ending, you will find the strength of character to stand before the American public and the world, and in particular the Iraqi people, and beg for forgiveness.</description>

All you out there who fear a FORCEFUL takeover of the United States, rest easy tonight, as you saw what 1 man can do.  

While Donner may have been wrong in killing innocent cops, and taking his vendeta against those who had nothing to do with his fate; He did expose something greater then the obvious citizen abuse of the LAPD. 

Here we had JUST ONE  X-Cop/Military man who decided to go against the system. The same system who trained him. 

This single man alone brought the southern state of California into complete panic and frenzy. 
This single man had cops in fear, shooting old women, cops ramming and shooting men from a different race, complete state road blocks and citizen harassment. Local police department were completely out of resource, and causing delays in citizen emergency calls, as they gaurded their own loved ones and personal interests.  Bulletins were sent out that all large black men are possible suspects, and should be approached with caution. 

This single X-Cop who decided to go against his own, brought frenzy and panic to half of California law enforcement agencies. 

The one thing that was exposed is when/if a tyrannical government ever decided to go against the citizen of the United States, it would only take a hand full of GOOD, constitutional loving Police and Military men to rise up against such move. 

There is roughly 800,000 law enforcement personnel in the U.S. If only 10% decided to disobey unconstitutional laws, if/when a tyrant every took the oval office, it would be more then enough to putt an end to any tyranny. That would be 80,000 cops and swat members on the citizens side. Not counting the hundreds of thousands of x military personal, and the 100,000 million armed citizens.


If and when a tyrant took over the oval office, it would not resemble a tyranny as you know. You would be a slave to the system via dept or dependency on such system.  You would probably not even know that the white house was hijacked by people who did not have your best interest in mind, and even plotted against your freedom and sovereignty.  You would be to bussy trying to make a living and not lose your job to focus on what is really going on.  

So, rest easy knowing that you wont have to use your AR15, unless it is at the range.

This was just one crazy man going face to face against the system using force. There are thousands of seasoned veterans with 5 tours under their belt, and some suffering from PTSD that are ready to snap.


The LAPD, or any other law enforcement is not the constitutions enemy. Lack of knowledge and understanding of tyranny is the enemy.  Not learning from history is our problem. Sure, a few bad apples make cops look bad, but all we need is just a few good cops on our side when the S#!t hits the fan.

By no means am I defending this killer, and personally I am glad he is dead and not going to cost me some  taxes for his legal battle, and execution in the chair.  I am just happy to see how weak the system is, when it comes to force. 


We have the numbers, and the force.
