Statement by Governor Jan Brewer

&quot;As though we needed any more evidence, President Obama has demonstrated anew his utter disregard for the safety and security of the Arizona people. Within the last two hours, I have been notified the Obama administration has revoked the 287(g) agreement under the authority of which Arizona law enforcement officers have partnered with the federal government in the enforcement of immigration law.

&quot;Of course, it is no coincidence that this announcement comes immediately on the heels of the U.S. Supreme Court's ruling upholding the constitutionality of the heart of Arizona's anti-illegal immigration law: SB 1070. It's worth noting that 68 law enforcement entities in 24 states have functioning 287(g) agreements with the federal government. But it appears the only agreements eliminated today were those in Arizona, the state that happens to be on the front lines of America's fight against illegal immigration. We are on our own, apparently.

&quot;I suppose I shouldn't be surprised. The Obama administration has fought the people of Arizona at every turn - downplaying the threat that a porous border poses to our citizens, filing suit in order to block our State from protecting itself, unilaterally granting immunity to tens of thousands of illegal aliens living in our midst, and now this. Still, the disarmament of Arizona's 287(g) agreements is a new low, even for this administration.

&quot;Since 2006, the U.S. Department of Homeland Security credits the 287(g) program with identifying nearly 300,000 potentially-removable aliens nationwide. Immigration and Customs Enforcement has trained and certified more than 1,500 state and local officers to assist in the enforcement of immigration law, including many in Arizona. In fact, even as the President was wiping out Arizona's 287(g) agreements, the ICE website itself continued to herald the collaborative approach of the 287(g) program, noting, 'Terrorism and criminal activity are most effectively combated through a multi-agency/multi-authority approach that encompasses federal, state and local resources, skills and expertise.'

&quot;The President's action should be of concern to all Americans. This fight is not over. President Obama may disregard Congress. He may target individual states like Arizona. He may generally act with impunity. But he is not 
above judgment - and the American people will have theirs very soon.&quot;

Senator Jon Kyl slams Obama's new immigration policy. Mr. Kyl's comments come one day after the Supreme Court handed down its ruling on Arizona's immigration law.


Sen. Jon Kyl (R-AZ) floated the possibility of impeaching President Obama over the administration's recent decisions on immigration, during an appearance on Bill Bennett's radio show on Tuesday. 

Responding to a question about the Department of Homeland Security's decision to pull back &quot;on a program known as 287(g) - which allows the feds to deputize local officials to make immigration-based arrests&quot; - following the Supreme Court's ruling invalidating substantial sections of Arizona's SB 1070, Kyl said the president must be held accountable: 


BENNETT: How do you make the feds cooperate  ?
 
KYL: Well, that's the executive's job and there are only a couple of ways to do it... If the president insists on continuing to ignore parts of the law that he doesn't like, and simply not enforce that law, the primary remedy for that is political. And you have it two ways: one is oversight through the Congress to demonstrate what they're doing wrong and there are some potential criminal charges there for dereliction of duty. Although, I haven't looked that up yet. And the other part of it is people need to react through the ballot box to turn out of office those people who are not doing their duty. Now if it's bad enough and if shenanigans involved in it, then of course impeachment is always a possibility. But I don't think at this point anybody is talking about that.

It has been more than 18 months since our son, Brian Terry, was shot and killed by a Mexican drug cartel armed by a failed U.S. Department of Justice &quot;gun-walking&quot; operation known as &quot;Fast and Furious.&quot;

The pain that Brian's death has caused our family is indescribable. No matter what words we use in this letter to you, we will never be able to justly convey how much suffering we have endured. We still grieve every day, and we are resigned to the fact that the agony of his death will stick with us for the rest of our lives. Not because he didn't achieve his dreams . . . not because he didn't live his life to the fullest . . . and not because he didn't leave anything behind that we couldn't celebrate or remember.

 

Our family will be forever grief-stricken because Brian didn't have to die.

We wish we could take solace knowing that Brian died doing what he loved to do. After all, it was his childhood dream to make a career in law enforcement and become a federal agent. 

As a youngster, Brian was inspired by his Uncle Bob, a Michigan police offer who would give Brian tours of the police station and share stories of what it was like to be a police officer. From then on, Brian believed he was destined for a career in law enforcement. He joined the Marine Corps after high school and served four years in Naples, Italy before becoming a police officer in Lincoln Park, Michigan - just like his uncle. But Brian's ultimate dream was to become a federal agent, and so he applied to the United States Border Patrol. 

In 2007, he attended the Border Patrol Academy in El Paso, Texas, graduating as president of his class before being assigned to the Naco station near Bisbee, Arizona, only a few miles from the U.S.-Mexican border.

 

Brian accomplished exactly what he wanted to. But all of what he had worked for - and all our family had come to adore and love - was taken away so abruptly . . . so needlessly.

On December 14, 2010, Brian was conducting operations as a member of the Border Patrol Tactical Unit in Nogales, Arizona. He and his team encountered five Mexican drug cartel bandits in the &quot;Peck Well&quot; area near Rio Rico, Arizona. Not knowing the bandits were carrying the latest military grade assault weapons provided by the Justice Department as part of Operation Fast and Furious, there was an exchange of gunfire and Brian was shot in the lower back. 

He died on December 15, 2010.

Before then, our family was expecting Brian to return home for Christmas. What we were not expecting was that he would return home in a flag-draped casket. All because of an ill-conceived government gun trafficking investigation gone horribly awry.

 

The Justice Department's &quot;gunwalking&quot; operation called for American gun dealers to sell weapons to &quot;straw purchasers&quot; tied to Mexican drug cartels between 2009-2011. The intention was to track the guns as they were sold to Mexican drug lords, which would theoretically lead to the arrests and dismantling of the cartels.

But that's not what happened. It turned out that there was no actual plan to track the movement of the guns as they were &quot;walked&quot; into Mexico.

As a result, one of our four children and as many as 200 Mexican citizens were killed with weapons connected to the operation.

Still, hundreds of guns sold as part of Operation Fast and Furious remain unrecovered, putting more brave law enforcement personnel along the border - like our son - at unnecessary risk.

Even though our son fell in the line of duty more than 18 months ago, we still don't have answers that explain why he had to die.

Unfortunately for our family and the families of others who have been injured or killed with these weapons, our son's death has ballooned into a national controversy. Currently, the House Oversight Committee is moving forward with contempt proceedings against Eric Holder, the U.S. Attorney General and head of the Justice Department, for failing to comply with a congressional subpoena requesting all of his communications regarding Operation Fast and Furious. Our hope is that the Justice Department is not withholding information that could expose those who are responsible for our son's death.

It has been nearly eight months since Mr. Holder was served his subpoena, and we know little more now than we did then. We think our family and Brian's memory deserve better.

So even though this government investigation drags on and prolongs our family's suffering, we are taking action. 

 

We have established the Brian Terry Foundation not just to preserve Brian's memory and honor his service to our country, but to also help families of other U.S. Border Patrol Agents who have been killed or injured by providing ongoing emotional and financial support, establish educational scholarships, recognize the heroic efforts of current Border Patrol Agents, and raise public awareness of the flawed Fast and Furious investigation. It is also our personal mission to guarantee that any mistakes made by the Justice Department are never made again.

Because of Operation Fast and Furious, some of the most dangerous criminal organizations in North America have been strengthened, and now our Border Patrol Agents are in the gravest danger of their lives.

So please, we urge you - not just for our son, but for all U.S. Border Patrol Agents who came before him and who will come after him - to join our cause and give as generously as you can. We have to make sure that nothing like Fast and Furious ever happens again, and without grassroots support from folks like yourself, our mission fails. This failed government operation cost our son his life, but that doesn't have to stop us from saving the life of someone else's son.

&quot;Today's decision by the U.S. Supreme Court is a victory for the rule of law. It is also a victory for the 10th Amendment and all Americans who believe in the inherent right and responsibility of states to defend their citizens. After more than two years of legal challenges, the heart of SB 1070 can now be implemented in accordance with the U.S. Constitution.

&quot;While we are grateful for this legal victory, today is an opportunity to reflect on our journey and focus upon the true task ahead: the implementation and enforcement of this law in an even-handed manner that lives up to our highest ideals as American citizens. I know the State of Arizona and its law enforcement officers are up to the task. The case for SB 1070 has always been about our support for the rule of law. That means every law, including those against both illegal immigration and racial profiling. Law enforcement will be held accountable should this statute be misused in a fashion that violates an individual's civil rights.

&quot;The last two years have been spent in preparation for this ruling. Upon signing SB 1070 in 2010, I issued an Executive Order directing the Arizona Peace Officer Standards and Training Board (AZ POST) to develop and provide training to ensure our officers are prepared to enforce this law efficiently, effectively and in a manner consistent with the Constitution. In recent days, in anticipation of this decision, I issued a new Executive Order asking that this training be made available once again to all of Arizona's law enforcement officers. I am confident our officers are prepared to carry out this law responsibly and lawfully. Nothing less is acceptable.

&quot;Of course, today's ruling does not mark the end of our journey. It can be expected that legal challenges to SB 1070 and the State of Arizona will continue. Our critics are already preparing new litigation tactics in response to their loss at the Supreme Court, and undoubtedly will allege inequities in the implementation of the law. As I said two years ago on the day I signed SB 1070 into law, 'We cannot give them that chance. We must use this new tool wisely, and fight for our safety with the honor Arizona deserves.'&quot;

Fairfax, Va. - The U.S. House Committee on Oversight and Government Reform passed a resolution recommending that the House find Attorney General Eric H. Holder, Jr. in contempt of Congress by a 23 to 17 vote. 
 
&quot;The NRA fully supports this contempt resolution,&quot; said Chris W. Cox, executive director of NRA's Institute for Legislative Action.  &quot;The American people - including millions of NRA members and tens of millions of NRA supporters - deserve the truth, and we will support any effort that leads us to that truth.&quot;
 
The Committee's report thoroughly details the immediate reasons for the resolution: the Justice Department's open defiance of legitimate demands for documents that are needed for oversight and investigation of one of the most disastrous episodes in the history of federal law enforcement.
 
Since taking office, Attorney General Holder has seized on the deadly violence in Mexico to promote more gun control.  He perpetuated the lie that &quot;90 percent&quot; of firearms used in Mexican crime come from the U.S. and he called for resurrecting the 1994 Clinton gun ban; and to justify the illegal multiple sales reporting scheme, which amounts to gun registration for honest Americans who buy long guns in southwest border states.
 
There is little doubt that the White House used the Fast and Furious program to advance its gun control agenda.  The White House actively sought information from the operation to support its plan to demand reporting of multiple rifle sales by the nearly 9,000 federally licensed firearm dealers in border states.
 
&quot;The NRA's support of this resolution was not undertaken lightly.  Eric Holder and the Justice Department owe it to the American people to produce the truth,&quot; concluded Cox.

      <title>House Oversight Committee Finds Eric Holder in Contempt in Fast and Furious Investigation</title>

After hours of deliberation, members of the House Oversight and Government Reform Committee on Wednesday voted 23-17 in favor of holding Attorney General Eric Holder in contempt of Congress.
 
Not even an eleventh-hour move by the Obama administration to grant Holder executive privilege concerning &quot;Fast and Furious&quot; documents could prevent the committee vote as Rep. Darrell Issa (R-Calif.) and other lawmakers pushed forward in their pursuit for the truth in their investigation into the failed federal gunrunning operation.
 
Rep. Trey Gowdy (R-S.C.) introduced an amendment, which passed, that made sure that the record stated that the committee was aware of Obama's decision to assert executive privilege and they proceeded with the vote anyway.

A contempt report is ordered to be given to the U.S. House of Representatives for their review, Issa said.
 
House Speaker John Boehner (R-Ohio) announced in a press release shortly after the vote that the measure will be voted on by a full House next week. Lawmakers will be back on Capitol Hill on Tuesday.
 
&quot;While we had hoped it would not come to this, unless the Attorney General reevaluates his choice and supplies the promised documents, the House will vote to hold him in contempt next week.  If, however, Attorney General Holder produces these documents prior to the scheduled vote, we will give the Oversight Committee an opportunity to review in hopes of resolving this issue,&quot; the release said.

Fox News is reporting the President Obama has granted Attorney General Eric Holder executive privilege on documents pertaining to Operation &quot;Fast and Furious.&quot;
 
Holder recently agreed to provide additional subpoenaed documents to members of Congress, including Rep. Darrell Issa (R-Calif.), however, the latest move indicates the attorney general has no intention of making good on his promise.
 
The House Committee on Oversight and Government reform is expected to take a vote on whether or not to charge Holder with contempt today at a 10 a.m. meeting.

      <title>Holder Contempt Vote to Move Forward</title>

A meeting between the head of the Oversight and Government Reform Committee, Rep. Darrell Issa, R-Calif., and Attorney General Eric Holder has not postponed or cancelled a contempt vote of the attorney general.

Rep. Issa told reporters after the meeting, &quot;If we receive no documents, we'll go forward. If we receive documents we will evaluate them.&quot;

Issa and Holder met in an attempt to end a stalemate between Republicans in Congress and the Obama administration over documents pertaining to the Fast and Furious case, the Arizona gunwalking program that put guns in the hands of illicit gun purchasers as a way to track Mexican smuggling cartels. As a result of the program, hundreds of guns showed up in Mexico and one was found at where a U.S. border agent was killed. Issa and his counterpart in the Senate, Charles Grassley, R-Iowa., opened an investigation into the case more than a year ago.

&quot;We're not looking to hold people responsible. We're looking for document production,&quot; Issa said.

Issa's committee is looking for documents dating from February to December 2011 on how the Justice Department handled the Fast and Furious case.

Holder says he made Holder an &quot;extraordinary&quot; offer that includes documents, a briefing on those documents and answers to questions Issa and his committee might have.

&quot;The ball is in their court,&quot; Holder said. &quot;They rejected what I think is an extraordinary offer.&quot;

Senator Grassley, who attended the meeting, tpld CBS News that Issa is right to proceed with contempt vote against Holder. 

&quot;He wants to turn over only what he wants to turn over and not give us any information about what he's not turning over. That's unacceptable. I'm not going to buy a pig in a poke,&quot; Grassley said.

Although Issa said the contempt hearing, scheduled for Wednesday at 10 a.m., is on for now, he left open the possibility that there is still time to cancel the vote. 

&quot;The deadline will always be to the last moment,&quot; Issa said.
