      <title>New York Gun Confiscation Underway - Citizens Told To turn in Pistol Owner ID and Firearms</title>

      <description>Manasquan, NJ - -(Ammoland.com)- Remember all those who denied that firearms confiscation as a result of New York's new gun laws was too &quot; insane &quot; to even consider?

That it was strictly in the realm of paranoid conspiracy theorists and the  &quot;it cant happen here crowd&quot; ?

 

Those were and remain some of the standard replies to anyone who even thought about the possibility, let alone gave voice to it, despite the fact that Gov Cuomo and numerous other officials made public comments about such a plan, as I discussed in my article &quot;Feinstein &amp;amp; Cuomo Admit Planning Australian Style Government Gun Buy Back&quot; .

 Elected Officials, the media, various Gun Control Groups and their zealous forced disarmament supporters, even some firearms owners themselves all insisted it was to crazy to even consider. 

 There's just one huge problem it is happening now in New York State! 
It seems those that tried desperately to warn of such an insidious plot had hit the bullseye with their warnings after all. News came from multiple NY State based firearms enthusiast websites late Friday that confiscations of Pistol Owner ID Cards, as well as firearms and accessories has commenced in NY under the provisions of the horribly flawed, draconian and blatantly unconstitutional NY SAFE Act.

Those folks having their weapons and FID cards confiscated  have been discovered to have been prescribed multiple different types of psychotropic drugs, such as those for Depression or Anxiety. These are known as SSRI ( Selective Serotonin Reuptake Inhibitors) class drugs and have the potential to cause serious and adverse side effects, something I wrote about extensively last week in an article that went viral in days and caused multiple Anti Gun and Progressive News Groups to initiate a concentrated denial of service hacker attack against Ammoland Shooting Sports News (see Daily KOS &quot; Keeping Track Of The RKBA Crowd&quot;http://tiny.cc/ug67uw),  in an effort to keep the information from the public.

&quot;John Doe, an upstanding professional with no outstanding criminal convictions and no history of violent action received a letter from the Pistol Permit Department informing him that his license was immediately revoked upon information that he was seeing a therapist for anxiety and had been prescribed an anxiety drug. He was never suicidal, never violent, and has no criminal history. The New York State Department of Health is apparently conducting a search of medical records to determine who is being treated for anxiety drugs and using this as a basis for handgun license revocation.

 Those are the facts. Nothing more, nothing less. 
Now, before anyone trots out the old saw about how this is nothing more then a paranoid, unsubstantiated rumor on a  &quot;gun nuts&quot;  internet forum. I spoke to the Attorney of Record in this matter on the phone this morning and he confirmed that the above snippet is accurate and  these cases are happening !

James Tresmond Esq confirmed in our conversation that the above mentioned case is occurring in Erie County NY, it is his client that has been effected, and as yet unknown sources have seen fit to take it upon themselves to share confidential medical records with NY State Officials without authorization, a  massive  HIPPA violation.

It seems these supposedly confidential records are then compared against a list of known NY pistol license holders and letters are sent out demanding their Pistol Owner ID Cards be surrendered, as well   as any firearms and accessories.

 This is an unprecedented violation of a Citizens 2nd, 4th, and 5th Amendment RIGHTS , brought to fruition by power and control hungry tyrants holding elected office who swore an Oath to uphold and defend the very rights they are now actively stripping from their constituents.

Moreover, the confiscation efforts underway in NY State have had another, albeit unintended effect. By undertaking this course of action, those in power have inadvertently pulled back the curtain on something they have suppressed from the Citizens for far to long, leaving them with precious little wiggle room to explain away their actions.

Either they are acknowledging that there is in fact some sort of little reported link between the prescribing of  psychotropic drugs and violent behavior , thus they are somehow, at least in their own minds &quot; justified &quot; in their actions to preempt someone from violence. Or, this is nothing more then a backdoor confiscation effort and massive abuse of governmental power unleashed on innocent Citizens.  Those are the only two possible explanations.

&quot;  Billion Dollar Emergency Flu Contract Changed To Cost Plus!&quot; has to be one of the most strange and boring headlines we have ever posted. But to those in the know, changing a government contract from Fixed Price to Cost Plus is a sign of governmental desperation, and a contractor's greatest dream.

 Cost Plus means that the contractor is guaranteed a profit no matter what he/she spends to fulfill the contract. Throw in the fact that this &quot;Medical Countermeasures Clinical Studies Network&quot; contract is worth .6 Billion dollars and that the ancillary contracts probably bring it up to over a BILLION dollars, and you have the very definition of the US Government URGENTLY &quot;throwing money&quot; at salivating contractors.

 This contract basically covers two things:

 (1) setting up pre event clinical trials of experimental emergency flu vaccines laced with adjuvants.

 (2) setting up a  post event, 24 hour notice reaction squad which can perform emergency, experimental treatment clinical trials on several hundred individuals using investigatory antiviral agents, and probably symptomatic (Cytokine storm) treatments with experimental immune suppressing drugs.

 So for anyone unsure on how seriously the US Government is taking the threat of Hemorrhagic H7N9 Bird Flu, if the change in this contract from Fixed Price to Cost Plus doesn't alert you to the fact that Federal Government thinks this situation is deadly serious, nothing short of mass death and forced vaccinations will convince you.

 Of course none of this means that the government is right; centralized planning seldom ever is right.  But anyway you look at, there will either be a real risk from the hemorrhagic bird flu or/and a real risk from the Government's response in preparation for that hemorrhagic flu.

 Three things one might consider in preparation for the next flu season/outbreak are:

 (1) Emergency treatments for forced vaccination with experimental adjuvant containing vaccines, like immune system suppressing supplements.

 (2) Chlorhexidine Gluconate aka CHG (see below)

 (3) Watch the CDC's strategy / budget appeal movie CONTAGION

      <description>Blue chemical lights illuminated the Pacific under a early morning sky as 41 dark figures approached the black waters off San Onofre beach at 4 a.m. and patiently waited in the brisk air for the countdown to honor their fallen comrades to begin May 17. 

The announcer counted &quot;3... 2... 1!&quot; The Marines plunged into the frigid ocean and stroked their way through a 2,000 meter swim, which was the first evolution of the 5th Annual Recon Challenge here.

Twenty two-man teams and Sgt. Maj. Blake Smith ran the event alone. The event consisted of swimming, climbing, and navigating obstacle courses.

&quot;You have to factor in the rocks, waves and your buddy's abilities,&quot; said Staff Sgt. Mark Rawson, a recon team leader with 1st Force Reconnaissance Company here. &quot;You also have to keep account of all of your gear.&quot;

Each competitor carried a ruck sack weighing no less than 50 pounds when filled with the supplies necessary to complete the race.

&quot;It was designed to simulate a full mission profile,&quot; said Master Sgt. Mariota Pa'u Jr., the operations chief and challenge staff noncommissioned officer in charge. 

&quot;These guys aren't here to compete for a trophy or a Super Bowl ring,&quot; said Pa'u. &quot;They're here to compete because they are representing the recon Marines that have been killed overseas.&quot;

According to Pa'u, like every other recon challenge, this year's was dedicated to the families of fallen reconnaissance Marines and many aspects of the challenges symbolize that.

&quot;You start with the Marine's dog tags and name stenciled on your ruck-sack,&quot; said Pa'u. &quot;You start with them, you finish with them.&quot;

Competitors performed a callisthenic test, climbed a 35 ft. tower and did a 25 meter swim without breaching the surface.

&quot;Every few miles we had to stop and take our pack off and that affected a lot of people,&quot; said Gunnery Sgt. Collin Barry, course chief for Basic Reconnaissance Course with Reconnaissance Training Company, Advance Infantry Training Battalion, School of Infantry-West.

Barry said that the challenge was different this year from previous years because the exercise stations were added to the courses trails.

&quot;Whether it's 20 miles or 30 miles you can get in the right mind set, but not this year,&quot; said Barry. &quot;Every two to three miles you're taking your ruck-sack off to do some type of event that smokes you.&quot;

Although safety is paramount, injuries do occur. Event staff was sure to accommodate those who were impacted negatively during the trial.

&quot;My partner dislocated both of his shoulders yesterday,&quot; said Sgt. Maj. Blake Smith, director of the Staff Non-Commissioned Officer Academy here. &quot;I was linked with a team in the beggining and told I could run on my own if I wanted to. That way I didn't affect any other team's performance.&quot;

Although Smith's partner was unable to finish the race, he said he had to continue any way he could because the race was about those he'd lost long ago.

&quot;He was a good friend of mine from a long time ago,&quot; said Smith. &quot;It was pretty emotional.&quot;

Smith, coincidentally, had the honor of bearing the name of someone he knew this year.

&quot;(This event) is near and dear to a lot of our hearts because we go out and race with the names of our fallen brothers,&quot; said Smith, 43, the oldest participant this year.

Smith's partner wasn't the only one to suffer minor injury.

&quot;I got a cramp on one of the obstacles and fell,&quot; said Cpl. Joshua Rios, reconnaissance Marine with 3rd Reconnaissance Battalion in Okinawa, Japan. &quot;The corpsman wrapped my knee up and recommended I stop, but I kept pushing.&quot;

According to Rios, the risk was worth the reward.

&quot;It's going get tough and it's going to suck,&quot; said Rios. &quot;That doesn't matter. You don't give up because it's much more worth it to see it through to the end than it is to quit.&quot;

Running this event gives these Marines time to catch up with old friends.

&quot;It's a great opportunity for us recon Marines to come together, reunite and shake the hands of brothers we haven't seen in a long time,&quot; said Master Sgt. David Jarvis, operations chief with 1st Reconnaissance Battalion's Alpha Company. &quot;The most important thing is remembering our fallen brothers.&quot;

Jarvis came in first place with his teammate Gunnery Sgt. Tyler Fedelchak at 8 hours and 36 minutes. They beat second place finishers by seven minutes.

&quot;This really brings a tear to your eye because we care so much about the guys we've lost,&quot; said Jarvis, who came in first placefor the second year in a row. &quot;Recon marines were tied to the hip with each other so those guys are literally like family to us.&quot;    

* Sgt. Johnathan Bumpus performs a functions check on an M-240G machinegun that he and his teammate, Sgt. Alexander Hale, assembled under 15-feet of water during the 5th Annual Recon Challenge here May 17. The challenge consisted of a 2,000-meter swim, calisthenics tests and other skill based events.

Two years ago, Zero Hedge  first made the observation  that the bulk of Fed 
reserves (also known simply as &quot; cash created out of thin air &quot; because money is
 first and foremost   fungible       no matter what textbook theoreticians may claim, and
 the only cash allocation preference is the capital allocation IRR analysis) had been 
parked not with US banks, but with foreign banks with US-based operations. We
 followed that  with more analyses , showing explicitly how the Fed was providing a 
constant cash injection to   foreign banks   courtesy of the rate on overnight reserves 
which is the amount Fed pays to banks that hold reserves with it, as the bulk 
of reserves continued to end up with foreign banks - a situation set to become a huge 
political storm some time in 2014-2015 when the IOER has to rise and the
 Fed is &quot;found&quot; to have injected tens of billions of &quot;interest&quot; not into
 US banks but in foreign banks operating in the US, and which then can 
upstream the &quot;profits&quot; to insolvent offshore domiciled holding 
companies. 

So it was our expectation that while if not slowing down its rate of 
money-creation (i.e., reserve-production) - something that won't happen 
for a long time as it would crash the stock market - the Fed's reserves 
would at least revert to being accumulated at US-based banks. No such 
luck. In fact as the  latest H.8 report 
 demonstrates, as of the most recently weekly data, the Fed's policies 
have led to foreign banks operating in the US holding an all time high 
amount of reserves,   surpassing $1 trillion for the first time,   or $1,033 Billion
 to be precise.This means that, as we expected several months ago, the only 
recipient of ongoing Fed money printing are not US banks, but foreign banks 
operating in the US.

 Anthony Weiner thinks his brief absence from elected office means the public will forget his disrespect and disdain for women. He's wrong. He didn't just treat strange women like sex objects, he harassed female journalists who work on Capitol Hill. Two of us work at The Washington Times.

Mr. Weiner was forced to resign from Congress because he was caught texting and tweeting pictures of his private parts to women, some from the House members' gym. The married Democratic congressman thought the scandal would blow over, but House Democratic leaders Nancy Pelosi and Deborah Wasserman-Shultz were so disgusted with his behavior, they told him to take a hike.

A year earlier, The Washington Times White House Correspondent Susan Crabtree was covering Congress for The Hill. She was reporting on the House Ethics Committee's conviction of Rep. Charles Rangel, New York Democrat, and possible punishment. She wrote that her sources said Mr. Weiner might speak on the floor in defense of Mr. Rangel to get a lighter penalty than censure.

Mr. Weiner was furious with the story, probably because it could jeopardize his mayoral ambitions by being associated with the tax cheat. On Dec. 2, Mr. Weiner saw Ms. Crabtree in the Speaker's Lobby, which is the area off the House floor where reporters wait to talk to members as the enter or leave the chamber.

Ms. Crabtree asked him if he would be speaking in Mr. Rangel's defense that day. He replied that she had not verified that detail in her story. She told him that she had had two very good sources that said, exactly as she wrote, that he was considering speaking.

Mr. Weiner then gave her the middle finger - in front of all the other reporters - and quickly walked away.

The congressman wasn't just being a jerk and targeting a female journalist, but he was deceitful about his intentions.

As Ms. Crabtree reported the following day, during the censure vote, Mr. Weiner and two other Democratic members of the New York delegation gathered around Mr. Rangel in the well of the chamber to show their solidarity.

Mr. Rangel, the former chairman of the tax-writing Ways and Means Committee, became only the 23rd member of Congress in history to be censured by his colleagues in the House of Representatives.

Six months after Mr. Weiner flipped off Ms. Crabtree, he subjected me to humiliating sexual comments. I was covering the sexting scandal for The Times. On June 1, the whole Capitol Hill press corps was looking for Mr. Weiner to get some answers.

I happened to be the only reporter in the Speaker's Lobby when Mr. Weiner walked out, clearly looking for someone to tell more of his lies about the scandal.

At this point, he was still denying everything, telling the press that his Twitter account had been hacked. The other women had not yet come forward to show their own naked pictures sent by the congressman.

That day, Mr. Weiner stopped when I approached him and moved in very closely, about six inches from me. He debated me on the charges against him by making sexually explicit jokes at me. As this went on, dozens of reporters crowded around us in a huddle.

Weiner: We don't know where the photograph came from. We don't know for sure what's on it. We don't know for sure if it was manipulated. If it was taken out of one place and dropped something else. And I'm going to let the firm get to the bottom of all that. Jon Stewart might have actually been right last night.

Miller: Are there pictures out there of you undressed? Do you have pictures that exist?

Weiner: You know this is part of the problem with the way in which this has progressed and one of the reasons that I was, perhaps - you'll forgive me - a little bit stiff yesterday.  

Miller: Jesus Christ.

Reporter: You've used the word firm, you've used the word...

Weiner: Can I ask, is there a weiner joke that hasn't been used in this context?

Miller: You're making them all, though.

Weiner: I'm making them all?

Miller: You're making all those.

Weiner: I would refer you to any of the coverage of this case, the jokes kind of write themselves.

Mr. Weiner then gives an extensive defense of his privacy. A reporter asked him to explain how he claimed to have been hacked but did not deny taking the photo of himself. 

&quot;We know for sure I didn't send those photographs. We know for sure that someone did. We know for sure that one of my follower's name was inserted. We know for sure she's put out a statement she doesn't know me. I certainly don't know her. I don't really know her connection to this, but her statement speaks for itself.&quot; He then explained that he was tweeting at time and deleted the tweet when he saw it.

Miller: How did someone get a picture of you in your underwear, if that's possible?

Weiner: We don't know where this photo came from, if it has been manipulated, which is a possibility. As Jon Stewart alluded to last night, there are reasons to believe it might have been.  

(Comedian Jon Stewart, Mr. Weiner's close friend and former roommate, joked on the previous night's show that he remembered his friend as being less well-endowed.)

Weiner: We don't know that it's a police matter. I got spam yesterday. ...

Reporter: How can it not be?

Weiner: How can it not be? Very easily. Every day all of us get spam. Every day, all of us have people responding to us, 'Can't believe you're sending me this.'

Now maybe it will turn out - forgive me - that this is the point of al Qaeda's sword   and that this is the effort, this is where it's going to begin. And I've asked internet security to take a look at my private Internet feed - my private Twitter feed that has 45,000 followers, more than Michele Bachmann, I want to point that out. I finally passed her.

That interaction shows the real character of Anthony Weiner. Today, he does not claim to have learned to respect women in his brief absence from public life. He is solely focused on regaining power and fame.

							If there is one lesson I have learned over my decade and a half 
at Judicial Watch, it is this: you must never overestimate the hypocrisy
 of the Left--especially in covering for their own. 



Lest you have even the slightest doubt, cast an eye to the outrageous 
behavior of District of Columbia Attorney General Irvin B. Nathan when 
he allowed NBC-TV's David Gregory to walk away scot free for a firearm 
offense, even while openly acknowledging &quot;the clarity of the violation 
of the law.&quot;



We don't know for certain what prompted Nathan to decline to prosecute 
Gregory. We do know that, according to the Washington Post, until the 
Republican sweep in 2010, he had been the House Democrats' top lawyer. 
We also know that he was appointed attorney general by D.C. Democrat 
Mayor Vincent Gray. And we know that some legal experts have questioned 
why Nathan did not recuse himself from the case when it was discovered 
that he had a personal relationship with David Gregory's wife. Clearly 
more information was required.



On January 14, 2013, William A. Jacobson, founder and author of the 
outstanding blog website, Legal Insurrection, submitted a District of 
Columbia Freedom of Information Act (FOIA) request to the D.C. 
Metropolitan Police Department (MPD) and Office of the Attorney General 
(OAG) seeking access to the following records:



  1.  The January 9, 2013 letter from Lee Levine on behalf of David 
Gregory, referenced in the letter datedJanuary 11, 2013 from Attorney 
General Irvin B. Nathan to Mr. Levine which was publicly disclosed on 
that date.



  2.  All communications between the District of Columbia Office of 
Attorney General and/or Metropolitan Police Department, on the one hand,
 and legal counsel for David Gregory and/or NBC News, on the other hand,
 with regard to the incident involving the display on television by Mr. 
Gregory of an alleged high-capacity ammunition clip (the &quot;Gregory 
incident&quot;).



 3.  All documents in the possession of the MPD and OAG regarding the 
Gregory incident, to the extent not exempted from disclosure under 
applicable law,  including but not limited to witness statements, 
evidence review and possession records, interview notes, and forensic 
testing.



On February 20, 2013, OAG informed Jacobson that it was withholding 
certain requested records, including the January 9, 2013, letter from 
NBC attorney Lee Levine, as well as responsive emails between OAG and 
MPD. (We just learned the letter from Levine was made available to the 
media, but is being withheld from us!)



The OAG also withheld in their entirety an affidavit and a warrant 
responsive to the Jacobson FOIA request. On April 17, 2013, MPD informed
 Jacobson that it was withholding responsive records as well. This past 
week, Judicial Watch filed a FOIA lawsuit on Jacobson's behalf asking 
that the Court to declare OAG and MDP in violation of the law and to 
order them to produce the records without further delay.



The known facts in the Gregory case are simple. On Sunday December 23, 
2012, the &quot;Meet the Press&quot; host interviewed the National Rifle 
Association's Wayne LaPierre concerning firearms policy in the United 
States. During the course of the interview, Gregory exhibited a 
high-capacity ammunition clip. The possession of such an ammunition clip
 is in violation of the law of the District of Columbia. 



Gregory displayed the ammunition clip despite the fact that, according 
to the D.C. Office of the Attorney General,&quot;NBC was clearly and timely 
advised by an MPD (Metropolitan Police Department) employee that its 
plans to exhibit on the broadcast a high capacity magazine would violate
 D.C. law, and there was no contrary advice from any other federal 
official.&quot;



Some argued that, in accordance with D.C. law, Gregory should have been 
charged with a weapons violation and taken into custody, as other 
alleged offenders have been. The MPD failed to do so, however, and in 
early January announced that it had completed its two-week investigation
 and presented the case to the OAG &quot;for a determination of the 
prosecutorial merit of the case.&quot;



On January 11, 2013, after just two days of deliberation, Attorney 
General Nathan sent a letter to NBC saying that his office would not 
prosecute Gregory, &quot;despite the clarity of the violation of this 
important law.&quot; The Attorney General added, &quot;There is no doubt of the 
gravity of the illegal conduct in this matter...&quot;



Yet, in what surely must be one of the most glaring non sequiturs I've 
seen, Nathan then refused to prosecute Gregory. And the Washington 
Times' outstanding editorialist Emily Miller well summed up the 
absurdity of the situation when Gregory first committed his violation:



The District came up with its overly restrictive laws in response to the
 Supreme Court overturning the capital city's 30-year gun ban. The 
statutes shouldn't apply just to regular people but to the rich and 
powerful as well. The District should either repeal its over-the-top 
restrictions or send a squad car to take David Gregory into custody.



The way Gregory's prosecution decision was handled undermines confidence
 in the fair administration of justice.  If Gregory shouldn't be 
prosecuted then no one should be - and the law should be rescinded.  Our
 client Prof. Jacobsen also is seeking justice in the public interest:



&quot;The documents being withheld will help shed light on the details of 
this highly publicized non-prosecution, which raised issues as to 
whether well-connected and famous D.C. insiders were treated as any 
other citizen in a similar situation.  I appreciate Judicial Watch 
assisting in this search for the truth.&quot;



Let's hope the courts put an end to this cover-up.

      <description>The rise of sectarian violence and recent Israeli bombing indicate that the true aim of the Syrian civil war is to weaken Iran's position in the region, Middle East expert Tariq Ali said in an interview with RT.

Hezbollah militants are fighting beside Syrian governmental troops to retake the strategic town of Qusair from the rebels. It's considered a key weapons smuggling route for opposition forces near the Lebanese border.

The battle for the city in the contested Homs Province is viewed by both sides as a turning point which could prove crucial in deciding the conflict.

Tariq Ali believes Hezbollah has joined the fight in order to protect the weapons smuggling routes of their own, those coming from neighboring Iran.

As for the Syrian people, Ali says the majority just wants the war in the country to end, no matter which side gets the upper hand.

The rebel Free Syrian Army (FSA) held Hezbollah chief Hassan Nasrallah personally responsible for the situation in the Syrian border town of Qusayr, as sectarian tension was on the rise in neighboring Lebanon.

&quot;We announced that Hassan Nasrallah will be held personally responsible for the current situation because he in person is meeting with all of   before they head to Qusayr,&quot; FSA spokesperson Louay Almokdad told Al Arabiya English. &quot;We are today calling Nasrallah a killer of the Syrian people.&quot;

Clashes between forces loyal to Syrian President Bashar al-Assad - along with Lebanese ally Hezbollah - and the rebels  raged into a second day  Monday in the strategic town of Qusayr, which is between Damascus and the coast.

&quot;It has reached the audacity and extent of criminal behavior that Nasrallah met with 1,200 of his fighters in the southern suburbs   before they headed to  ,&quot; the FSA spokesperson said, adding the Hezbollah chief has distributed &quot;tokens of motivation on which Shiite slogans - Yatharat al-Hussein - were written to each of his fighters.&quot;

&quot;We are certain these are fighters of Hassan Nasrallah. They are no longer Hezbollah, they are fighters of Hassan Nasrallah and   Ali Khamanei.&quot;

However, the FSA spokesperson also said that, along with Hezbollah, were fighters from other Lebanese groups, including the Syrian Social Nationalist Party and the Baath Party.

The Syrian rebels have repeatedly  warned  that they will hit Hezbollah targets on Lebanese territory if the latter does not withdraw from Syria and have  called  on the Lebanese government to put a stop to Hezbollah intervention.

The Lebanese government: a state of paralysisHowever, according to Imad Salamey - a professor of International Affairs at the Lebanese American University in Beirut, the Lebanese government cannot do anything to stop the powerful Party of God.

&quot;The Lebanese government has been and continues to be in a state of paralysis, which mostly works in Hezbollah's interest,&quot; Salamey told Al Arabiya English on Monday. &quot;The government cannot stop Hezbollah, and the   army stopping Hezbollah from intervening in Syria will definitely not be the case.&quot;

&quot;Hezbollah is being dragged further into the Syrian conflict, and it is not going to end in Qusayr,&quot; he said, adding that the movement &quot;was dragging Lebanon into a civil war.&quot;

&quot;  involvement in the Syrian issue, no matter what the pretext, will only drag Lebanon into the conflict because the Lebanese are divided  .&quot;

At least three people were  killed  and 40 injured in two days of fighting in Lebanon's northern city of Tripoli, where an Alawite minority lives. Lebanese Sunnis mostly sympathize with the revolt against the government of Bashar al-Assad, whose minority Alawite sect is an offshoot of Shiite Islam.

 Associated Press  reporters are not alone. One week after news broke that the  Justice Department  secretly obtained phone records from AP, more news has emerged about the  Obama administration 's campaign to silence leaks.

This time, it's new details about a 2010 Justice Departmentinvestigation into a  Fox News  correspondent who reportedgovernment secrets on  North Korea . The twist is that in the Fox News case, the government is suggesting that the reporter broke the law and criminal charges could result.

The news points to how the Obama administration is going to unprecedented lengths to defend secrets - prosecuting moregovernment leakers under the 1917  Espionage Act  than all prior administrations combined.


Anecdotal evidence suggests the crackdown is having an effect, with AP saying some of its sources are falling silent. But that success could come at the expense of the newsgathering and investigative-reporting process that the Founding Fathers saw as a crucial check on federal power.

The Fox News case, in particular, suggests the &quot;criminalization of investigative journalism,&quot;  writes Glenn Greenwald  in The Guardian, a British newspaper.

According to a  Washington Post   report Sunday , Fox News chief  Washington  correspondent  James Rosen  reported in June 2009 on a  CIA  analysis that suggested North Korea may respond to  UN sanctions with more nuclear tests. The story was published online the same day that a confidential report on the matter was released to select officials in the intelligence community, including a  State Department  security adviser, Stephen Jin-Woo Kim.


Detecting a connection,  FBI  investigators built a case alleging Mr. Kim leaked information to Mr. Rosen. To do so, they used every tool in their arsenal: analyzing security badge access records to track Rosen's comings and goings from the State Department, tracing the timing of his calls to Kim, even subpoenaing his personal e-mails.

Ultimately, FBI agents concluded Kim did, in fact, leak information to Rosen using a complex, if clumsy, system of communication including aliases and coded signals.

In his report, FBI investigator Reginald Reyes said evidence suggested Rosen had broken the law, &quot;at the very least, either as an aider, abettor and/or co-conspirator.&quot;

While details on the case are forthcoming, it is not a crime for journalists to report classified information, except in rare circumstances. Furthermore, government seizure of media records is tightly circumscribed under the government's  Code of Federal Regulations .

The AP and Fox News cases renew concerns about the potential stifling effect government investigations have on reporters and their sources.

&quot;Search warrants like these have a severe chilling effect on the free flow of important information to the public,&quot; said  First Amendment  lawyer Charles Tobin in the Washington Post report. &quot;That's a very dangerous road to go down.&quot;

 Jane Mayer  of The New Yorker goes further: &quot;It's a huge impediment to reporting, and so chilling isn't quite strong enough, it's more like freezing the whole process into a standstill,&quot; she  told the New Republic .

As a case in point,  Gary Pruitt , CEO of the AP,  told CBS's &quot;Face the Nation&quot;  this weekend that the Justice Department's investigation is already silencing AP sources.

&quot;Already, officials that would normally talk to us and people we talk to in the normal course of news gathering are already saying to us that they're a little reluctant to talk to us,&quot; he said. &quot;They fear that they - they will be monitored by the government.&quot;

Perhaps the most serious implication, however, is that the investigations threaten to jeopardize the very practice of investigative journalism, already endangered by budget cuts and the 24/7 news cycle.

&quot;Under  US  law, it is not illegal to publish classified information,&quot; writes The Guardian's Mr. Greenwald. &quot;That fact, along with the First Amendment's guarantee of press freedoms, is what has prevented the US government from ever prosecuting journalists for reporting on what the US government does in secret. This newfound theory of the Obama DOJ - that a journalist can be guilty of crimes for 'soliciting' the disclosure of classified information - is a means for circumventing those safeguards and criminalizing the act of investigative journalism itself.&quot;</description>
