Joshua Waddell, a first lieutenant in the U.S. 
Marines, appeared on his way to a stellar career as an American military
 officer. The son of a retired Navy SEAL commander, Waddell had won a 
Bronze Star during his first tour of duty in Afghanistan and had 
returned for a second.

Then he made a decision in combat that military experts say has severely jeopardized his future in the corps.


But some military experts say the black mark 
on Waddell's record was undeserved, that he and other young American 
officers are being put in a difficult, if not impossible, situation by 
unreasonable rules of engagement foisted upon the military by 
politically sensitive commanders in the Pentagon.
The facts in Waddell's case are spelled out in
 Marine Corps documents. But how those facts should be interpreted is a 
matter of heated dispute.

On Nov. 1, Waddell, a 25-year-old executive 
officer with 3rd Battallion, 7th Marine Corps Regiment, was monitoring a
 surveillance camera in Sangin, Afghanistan, when he spotted a man who 
had been identified as a bomb maker working with area insurgents. Two 
days earlier, a sergeant from India Company had lost both legs and a 
hand when a bomb detonated in their area of operation. The man spotted 
on the camera was believed to be responsible.

After receiving permission from his battalion 
commanders, Waddell ordered Marine snipers to open fire on the man, and 
he was hit. A group of Afghans rushed to the man, put him on a tractor 
and attempted to flee. Waddell ordered the snipers to hit the engine 
block of the tractor, disabling it so the man believed to be a bomb 
maker would not escape. The tractor was hit but no civilians were 
injured.

Then, about three weeks later, the civilians who helped remove the wounded man from the area were found to be teenagers.


As a result, Waddell was demoted from 
executive officer, and the battalion commander, Lt. Col. Seth Folsom, 
determined he had violated rules of engagement that governed when 
Marines could fire, and at whom. Folsom said Wadell &quot;is not recommended 
for promotion&quot; and &quot;in violation of   during an 
engagement.&quot; The report stated that &quot;noncombatant local nationals&quot; were 
in the area of direct fire and that &quot;the engagement resulted in a 
damaged local national vehicle.&quot;

A Marine brigadier general who reviewed the 
case was sympathetic to Waddell, whom he described as a &quot;superb and 
heroic combat leader. But the general said the decision on whether 
Waddell should be promoted was &quot;the commander's prerogative,&quot; noting 
that the battalion commander on the scene had lost &quot;confidence in 
  abilities.&quot;

Marine Maj. Shawn Haney, spokesman for Marine 
Corps Manpower and Reserve Affairs, said Waddell's fitness report will 
go before a review board at the time of any promotion &quot;and everything is
 under scrutiny, so Waddell will have a chance to defend himself against
 the accusations.&quot; Still, Haney conceded, Waddell's fitness reports play
 a &quot;significant role in future promotions.&quot;

The upshot is that Waddell's career has been effectively blunted, his chance for promotion blocked.


Waddell is just one of hundreds of cases of 
troops who have suffered under stringent rules of engagement, said Jeff 
Addicott, a former senior legal adviser to U.S. Army Special Forces.

&quot;We have hamstrung our military with  unrealistic ROEs that do more harm to our soldiers than the enemy, and  now a Marine's career is on the line because he disabled a tractor,&quot; 
Addicott said. &quot;In many ways our military is frozen in fear of violating
 absurd self-imposed rules on the battlefield, How can you tell if it's a
 teenager or a man, a farmer or an enemy when you're fighting an 
insurgency?&quot;

A Marine stationed in Afghanistan who does not
 know Waddell, but who has operated under the same rules, said, &quot;The 
rules of engagement are meant to placate   Karzai's 
government at our expense. They say it's about winning the hearts and 
minds, but it's not working. We're not putting fear into the enemy, only
 our troops.&quot;

Waddell's father, Mark Waddell, who served 
more than 25 years in the military and retired as a commander of a Navy 
SEAL team, said his son and other Americans fighting in Afghanistan are 
being victimized by these rules.

&quot;I feel what's happened to my son is a 
complete betrayal, and he isn't the only one,&quot; said Waddell, of Fort 
Worth, Texas. &quot;Josh is a hero. We expect them to go out and make 
instantaneous combat decisions, then we Monday-morning quarterback their
 decisions. It's an outrage.&quot;

SACRAMENTO, CA - A 29-year-old Sacramento woman has been arrested on suspicion of burning her baby in a microwave oven, causing the infant's death, police say.

Ka Yang was taken into custody Tuesday following a three-month investigation into March 17th death of 6-week-old Mirabelle Thao-Lo.

Officer Laura Peck with the Sacramento Police Department said homicide detectives, medical experts and forensic scientists determined the baby girl suffered extensive thermal injuries resulting in her death.

Peck said investigators found only three other reported injuries similar to the victim's in Texas, Ohio and Virginia.

Yang was apprehended at her residence on the 800 block of Rood Avenue, Peck said.

&quot;We thought it was an accident,&quot; neighbor Derrick Waddell said. &quot;We thought they dropped their baby, and we just heard she put her baby in the microwave. It's something you'd see in a horror story.&quot;

&quot;They're very nice people,&quot; neighbor Nou Vang said. &quot;I know the father who goes to church. I wouldn't expect any foul play or anything.&quot;

&quot;It's sad. It's terribly sad. so many safe places baby could have ben taken to. I wish I knew,&quot; neighbor Pam Waddell said.

According to the Sacramento County Sheriff's Department jail website, Yang was booked on one count of murder and one count of assault leading to the death of a child under age 8. She is ineligible for bail.

      <description>TUCSON (KGUN9-TV) - Exactly what happened during the very few seconds between the time a SWAT team broke down Jose Guerena's door, and shooting erupted?  

 

The latest release of information shows that when one SWAT officer saw Guerena standing in the hall swinging a gun in the team's direction, he did not wait to see what would happen next.  The officer opened fire.   The new information also shows that the team was confused about what was going on, and mistakenly believed that Guerena also had opened fire.

The release contains new evidence photos showing some of the things investigators say they found in the raid on Jose Guerena's house; such as the assault rifle under his mattress and the body armor found in his garage.

But most of the controversy has centered on the way the SWAT team fired on Guerena.

Team members agree that Guerena was waiting for them in the hall holding an assault rifle when they broke open the door.  Originally they said he fired at them.
        
In debriefings with detectives, the one SWAT member who went in armed with a rifle that day said he saw a man in the hallway holding a rifle.  The officer said that he did not wait for that man to fire first.

He said, &quot;...as soon as I saw the male suspect come from that direction he yelled something.  At that point I began firing my weapon at the suspect.&quot;

On closer questioning, that officer told detectives, &quot;...whether at that point he actually had raised the rifle up...I couldn't...&quot;

The interview was conducted via audio, with no video, but the officer was making gestures at the time.  The investigating detective described those gestures out loud for the benefit of anyone who might need to listen to the recording.  &quot;You're making a motion like he's bringing a rifle up on you,&quot; the detective said.

Then the rifleman then answer, &quot;Absolutely, absolutely.&quot;

In other words, the SWAT member who opened fire is describing to the detective who is debriefing him, with gestures, his observation that Guerena had begun to swing his weapon in the direction of the SWAT team members.
        
The SWAT member holding the shield at the door said he saw a muzzle flash.  The detective asks: &quot;Where was the muzzle flash?&quot;

The shield holder replies: &quot;Directed right towards us.&quot;

One of the team assigned to break open the door says, &quot;They were coming from basically, the front door, but directly straight back from the front door.&quot;

&quot;I'm seeing the muzzle, from the muzzle flash from inside the house, coming, you know, towards us.&quot;

The other officer assigned to break open the door turned away as the door swung open.

The detective asks: &quot;So at that point you breached the door, you turned around, you turned around you're facing the team and the gunfire is coming at your back from....&quot;

Breacher#2: &quot;Yes.&quot;
      
Detective: &quot;Inside the house?&quot;

Breacher#2: &quot;Yes.&quot;

And the team commander says, &quot;Immediately I saw a muzzle flash and gunfire or heard gunfire.&quot;

And that Guerena, &quot;Raised the rifle and pointed it towards us and fired multiple times.&quot;

Some of the officers said that in opening up on Guerena, they were returning fire. 

Shortly after the shooting, the Sheriff's Department said that Guerena had fired on the SWAT team and that the team had returned that fire.  A few days later the department issued a correction, saying that Guerena had not fierd, but that the team had opened fire on Guerena when Guerena pointed his rifle at them.

Documents released Friday show Guerena's rifle was examined immediately after the shooting.  Deputies found that it was ready to fire, but that the safety was still on and that no rounds had been expended.

It's hard to know for sure why SWAT members stated so firmly they felt Guerena had fired on them.  Their attorney has suggested that they may have seen reflections from their own muzzle flashes and, in the confusion, thought those flashes had come from Guerena's weapon.  The fact that one of the officers stumbled and fell right after the shooting erupted added to that impression; officers at first thought their teammate had been hit by gunfire from Guerena.

Video taken during the raid shows that only a few seconds elapsed between the time SWAT members broke down Guerena's door, and the shooting erupted.   Once the team saw Guerena standing there with a gun, events moved very quickly.

Confusion about exactly what is going on during a shooting situation is not uncommon.  It happens often enough that military experts have a phrase for it -- &quot;fog of war.&quot;  But that one officer's testimony that he opened fire on seeing Guerena swinging a gun in the direction of the SWAT team is consistent with the revised statement from the Sheriff's Department issued May 9.

In the debriefing, the SWAT team members also describe shouting commands identifying themselves as police before breaking down the door. 

The incident has led to an emotional community debate about whether the shooting was justified.  Guerena's wife Vanessa told KGUN9 News that she and her husband did not know who was breaking down their door.   Some critics have suggested that the use of a SWAT team to serve search warrants such as this one is not necessary and represents an over-militarization of the police.

On Thursday Pima County Sheriff Clarence Dupnik told KGUN9 News anchor Jennifer Waddell that the use of the SWAT team to serve this search warrant was justified given the nature of the drug conspiracy of which Guerena was suspected of being a part.  The sheriff said that the SWAT team did what it had to do when it encountered Guerena pointing a gun in the team's direction, and that anyone who does such a thing can expect similar results.  The sheriff added that law abiding citizens have no reason to fear confrontation with police officers.

On Thursday, Sheriff Clarence Dupnik broke his long public silence about the May 5 SWAT shooting that claimed the life of former U.S. Marine Jose Guerena, and sat down for an extended interview with KGUN9 News Anchor Jennifer Waddell.  He addressed questions about why authorities felt it necessary to dispatch a SWAT team that day to execute a series of search warrants, and also talked about other issues surrounding the controversial shooting.  The sheriff made the startling revelation that he believes Guerena greeted the SWAT team with a rifle because Guerena thought he was about to be arrested on a charge of murder.

Guerena has family ties to two people who were shot to death in a double homicide last year.  The murders of Cynthia and Manuel Orozco remain unsolved.  Someone shot the couple to death in their home on Tucson's west side March 29 of last year, leaving the victims' two children orphaned. 

Sheriff Dupnik declined to say whether his office's investigation has connected Guerena directly or indirectly to that or any other specific murder case.  He did say that the office of County Attorney Barbara LaWall has that information and will be releasing it soon.

Guerena died May 5 shortly after a team of SWAT officers broke down his door in an attempt to serve a search warrant related to a drug conspiracy investigation.   The team fired a total of 71 shots, with 22 of them hitting Guerena.  The Sheriff's Department and the SWAT team attorney have said that the officers were forced to open fire after Guerena pointed a rifle at them.   Guerena's wife claims she and her husband did not know at the time who was breaking down their door.

In the interview, the sheriff told Waddell that the shooting was fully justified, that the Pima County Regional SWAT team is one of the best in the nation, and that law abiding citizens have no need to fear the possibility of a confrontation with police officers.

Waddell:  I'm going to go back almost 20 months with you. There were two murders here in Tucson, the Orozco family... Do you have any reason to believe that Guerena in some way may have been tied to that?

Dupnik:  There are some aspects of this investigation that are very critical, and, it's not - I don't think it would be professional for me to start answering those kinds of questions.  The County Attorney is very involved with us in this investigation.  And there's no doubt in my mind that at some point in the not too distant future there are going to be a number of arrests made.

Waddell:  Back in 2009, Garcia Morena was found shot and burned in the desert... Any possibility that he might have been connected to this?

Dupnik:  I don't know.  My feeling is that the reason he came not to the door, but entered the hallway with an assault rifle pointed, the only reason none of us were shot, is because he forgot the safety was on.  And by the time he realized, he was shot.  But my feeling is the reason he came with that gun is that he thought we were there to arrest him for murder.

Waddell:  Is there any explanation as to the mixup, because Storie has come out and said, look, we thought he wasn't going to be home, or, we didn't know the wife and kids were going to be home.

Dupnik:  I don't have an explanation, but that's not the facts that I have.  We had reason to believe that he probably was going to be there.  We also had reason to believe that the kids may not, and the mother, because they were supposed to be at school.  That was their normal pattern.  But we did not conduct the surveillance that day because we would have been identified.  We can't do that.  First of all, when we are serving a search warrant on a property, it's typical for when the people find out that you're outside the house, the start destroying evidence that they can, burning documents, and things of this nature.  That's one of the reasons that we don't do that.  We had no reason at all to believe that this was anything other than any of the multitude of other search warrants that we've served where we never had a problem.  We had no reason to believe that this guy was going to do that.  But because he is part of a very violent organization, we considered it high risk.

Waddell:  There have been a lot of people who have started to call for changes in SWAT protocol in general - the way that things are surveilled, the way that the operation is conducted itself.  We've even had one of your former colleagues, the Graham County Sheriff, come out and say, look, I've worked with Sheriff Dupnik and I think it's time to make some changes.  One, what do you say to those critics who are calling for changes in SWAT protocol?  And two, do you think that maybe it is time to review some of the policies?

Dupnik:  We're always reviewing our policies.  And that's one of the purposes of our shooting board, which is going to be meeting next week.  But as far as the other criticisms, let me tell you that Pima County has a nationally-recognized SWAT team.  As a matter of fact, one of our commanders goes all over the country instructing other organizations on SWAT techniques and protocol.  We have one that's known internationally, Dr. Richard Carmona, who goes all over the world talking about SWAT.  In my judgment, we have a premiere SWAT organization, and at this point I don't see any need to -- This was an unfortunate situation that was provoked by the person himself.

Waddell:  So you don't see any need at this point to make any changes.

Dupnik:  Well, I'm going to let the shooting review board, which is going to be comprised of the four agencies that had people involved in this particular shooting.

Waddell:  I think people don't realize that this Pima regional SWAT team is that, that there are members coming from different organizations, not just the Pima County Sheriff's Department.

Dupnik:  That's correct.

Waddell:  Oro Valley, Marana, Sahuarita.

Dupnik:  In this particular case we had officers, from those three organizations, as well as our own, which makes four, having officers involved in this particular shooting.

Waddell:  We have had some viewers who have come out and said, look, how do I know that the SWAT team isn't going to bust into my house and shoot me dead in my house for what they would say is no reason.  What would you say to the community to address some of those concerns of perhaps mishandling?

Dupnik:   I don't think anything was mishandled.  Unfortunately, this individual points an assault rifle at cops.  You do that, you are going to get killed.  And the community has no reason to be concerned about it.  We have a national reputation.  We have been doing this for many years.  And our organization as I said is nationally recognized as one of the most proficient.  It's not an issue.  We average about 50 of these searches of where we have to have a search warrant from judge.  And law abiding people don't have to worry about confrontation with the cops.

Waddell:  There's old saying that if you're not doing something you're not supposed to, you're not going to find yourself in this position to begin with.  Would you agree with that?

Dupnik:  Absolutely.  Unfortunately in this particular case, the printed media, in this case, for whatever reason, decided to beat Dupnik up, over the head, with a sledge hammer because he's not behaving in a way that they, that he normally does.     And I tried to explain to them with a press release saying we had some serious issues here with the safety of individuals, and as soon as those are resolved, you can have all the information.  we've already told you what happened at the scene.  How many agencies would tell the press, the very next day, we gave you some very bad critical information.  We knew that was going to cause a firestorm of media activity.  We told 'em that they were in a firefight.  The fact of the matter is, several of those SWAT members thought that they were in a firefight. When we find out that they weren't, we let the media know immediately.

      <title>Sheriff Dupnik opens up about fatal SWAT raid</title>

      <description>On Thursday, Sheriff Clarence Dupnik broke his long public silence about the May 5 SWAT shooting that claimed the life of former U.S. Marine Jose Guerena, and sat down for an extended interview with KGUN9 News Anchor Jennifer Waddell.  He addressed questions about why authorities felt it necessary to dispatch a SWAT team that day to execute a series of search warrants, and also talked about other issues surrounding the controversial shooting.  The sheriff made the startling revelation that he believes Guerena greeted the SWAT team with a rifle that day because Guerena thought he was about to be arrested on a charge of murder.

Guerena has family ties to two people who were shot to death in a double homicide last year.  The murders of Cynthia and Manuel Orozco remain unsolved.  Someone shot the couple to death in their home on Tucson's west side March 29 of last year, leaving the victims' two children orphaned.  Sheriff Dupnik declined, however, to say whether their investigation had tied Guerena to that or any other specific murder case.  He did say that the office of County Attorney Barbara LaWall has that information and will be releasing it soon.

Guerena died May 5 shortly after a team of SWAT officers broke down his door in an attempt to serve a search warrant.   The team fired a total of 71 shots, with 22 of them hitting Guerena.  The Sheriff's Department and the SWAT team attorney say that the officers were forced to open fire after Guerena pointed a rifle at them.   Guerena's wife claims she and her husband did not know at the time who was breaking down their door.

      <description>Clubbing seals is probably on the top of the long list of things that upsets liberals.... Unless clubbing seals involves attacking our military's finest heroes while defending murderous terrorist muslim scum. I had to read this a couple times to make sure I was reading this right, but it's true. Liberals, 100% invested in defeat of our military, have enabled a terrorist to press charges against three Navy SEALs for being &quot;too rough&quot; after he was captured. This is scumbag POS responsible for orchestrating the brutal murder of four contractors in Falujah in 2004, who deserved nothing less than crucifixion for his crimes. They apparently punched poor Mohammed twice, leaving him with a bloody lip. Thanks to the terrorist-enabling liberal vermin infesting this country, these three heroes are now up for court martial. Furthermore, this is ONLY being reported by Fox at the moment. Shocker.

This story is reason 1,000,001 why liberals should have no say whatsoever on how we run our country.

Last week, Fox News reported a jaw-dropping story about how our war on terror has now become a war on ourselves.
 
In September, a team of Navy SEALs captured terrorist Ahmed Hashim Abed, a man known to the U.S. military as &quot;Objective Amber,&quot; the architect of the vicious and deadly attack on four American contractors in the summer of 2004. These poor men were shot, burned, and then their bodies were desecrated, hung from a bridge over the Euphrates River.
 
But instead of hailing the SEALs as heroes for bringing this vicious murderer to justice, three of them have been brought up on charges.
 
When Abed was captured, he was brought to Camp Baharia, a U.S. base two miles outside Fallujah. According to one attorney, Abed was turned over to the Iraqis by mistake and was later returned to U.S. custody. There are differing reports that he was punched in the gut and given a bloody lip.
 
The SEALs were faced with two options. One, choose an administrative hearing, facing no possibility of jail time or dishonorable discharge, but having their reputations forever tarnished. Two, choose a court-martial which could exonerate them completely or, if convicted, land them behind bars and end their military careers.
 
They have chosen the latter. So now they must stand trial, to defend themselves. The terrorists must be laughing in disbelief at us, especially when it's a well-known fact that they inflict injury on themselves (or each other) while in captivity so as to accuse their captors of abuse. If true in this case, the ruse has worked beyond their wildest dreams.
 
But let us conclude the SEALS punched this man in the act of capturing him. Take a poll and ask how upset the American public would be and that's when you'd hear the outrage - at the way the SEALs are being treated.
 
But you won't hear that outrage because the American people don't know about this story because, believe it or not, our national media won't report it.
 
There is no one except Fox emerging in a Nexis search of TV news transcripts. No ABC, CBS, NBC, MSNBC, or CNN. How can this merit nothing? There is no sign of a story in major newspapers like The New York Times, The Washington Post, USA Today, the Los Angeles Times, even the Associated Press and other wire services. (One exception: Gannett News Service ran an article from the Navy Times, even if it didn't make USA Today, Gannett's largest property.)
 
Time and Newsweek couldn't find space for it. Time did cover the saga of one Navy SEAL - suffering post-traumatic stress disorder. But instead of allegedly punching a terrorist, SEAL commander Mark Waddell was in danger of attacking a cartoon character at Disneyland: &quot;The noise of the careening rides, the shrieking kids - everything roused Waddell to a state of hypervigilance typical of his worst days in combat. When an actor dressed as Goofy stuck his long, doggy muzzle into his face, Waddell recalls, 'I wanted to grab Goofy by the throat.'&quot;
 
Waddell's counselor hit Time's sweet spot: &quot;We get all excited when Johnny goes marching off to war, and then we forget about him a few days later when our favorite football team loses a game.&quot;
 
Time only forgets about our fighting men when they're dragged into court for capturing a terrorist.
 
It's not like the Abed story is unconfirmed. Kate Wiltrout had the story for the Norfolk Virginian-Pilot last week: &quot;The military confirmed Wednesday that Petty Officer 2nd Class Matthew McCabe, 24, was charged last month with assaulting a detainee, dereliction of duty for failing to protect a detainee and making a false statement. Petty Officer 1st Class Julio Huertas and Petty Officer 2nd Class Jonathan Keefe are accused of failing to protect the man, whose identity is classified, said Lt. Col. Holly Silkman, a spokeswoman for the military's special operations command.&quot;
 
The New York Post wasn't shy about this outrage. &quot;And so the SEALs will be arraigned on Dec. 7 -- another reason for the date to live in infamy,&quot; it stated. &quot;Ironically, if the three had treated Abed like Al-Qaeda-in-Iraq has routinely treated American soldiers it captures, his bloody, mutilated corpse would've turned up floating in a river. (For the record, the number of US combat troops captured in Iraq and Afghanistan who have been recovered alive is approximately zero.)&quot;
 
The national media don't want to touch this story, such is their hostility to the United States military, no matter how much they profess to the contrary.  You've heard the Obama White House insist that Fox News is not a &quot;legitimate news organization.&quot; This story demonstrates, yet again, that Fox often is just about the only legitimate news organization.
 
It's high time the American people started getting very vocal in their outrage.</description>
