One week after news broke that the Justice Department secretly obtained phone records from AP, more news has emerged about the Obama administration 's campaign to silence leaks. This time, it's new details about a 2010 Justice Departmentinvestigation into a Fox News correspondent who reportedgovernment secrets on North Korea . The twist is that in the Fox News case, the government is suggesting that the reporter broke the law and criminal charges could result. The news points to how the Obama administration is going to unprecedented lengths to defend secrets - prosecuting moregovernment leakers under the 1917 Espionage Act than all prior administrations combined. Anecdotal evidence suggests the crackdown is having an effect, with AP saying some of its sources are falling silent. But that success could come at the expense of the newsgathering and investigative-reporting process that the Founding Fathers saw as a crucial check on federal power. The Fox News case, in particular, suggests the "criminalization of investigative journalism," writes Glenn Greenwald in The Guardian, a British newspaper. According to a Washington Post report Sunday , Fox News chief Washington correspondent James Rosen reported in June 2009 on a CIA analysis that suggested North Korea may respond to UN sanctions with more nuclear tests. The story was published online the same day that a confidential report on the matter was released to select officials in the intelligence community, including a State Department security adviser, Stephen Jin-Woo Kim. Detecting a connection, FBI investigators built a case alleging Mr. Kim leaked information to Mr. Rosen. To do so, they used every tool in their arsenal: analyzing security badge access records to track Rosen's comings and goings from the State Department, tracing the timing of his calls to Kim, even subpoenaing his personal e-mails. Ultimately, FBI agents concluded Kim did, in fact, leak information to Rosen using a complex, if clumsy, system of communication including aliases and coded signals. In his report, FBI investigator Reginald Reyes said evidence suggested Rosen had broken the law, "at the very least, either as an aider, abettor and/or co-conspirator." While details on the case are forthcoming, it is not a crime for journalists to report classified information, except in rare circumstances. Furthermore, government seizure of media records is tightly circumscribed under the government's Code of Federal Regulations . The AP and Fox News cases renew concerns about the potential stifling effect government investigations have on reporters and their sources. "Search warrants like these have a severe chilling effect on the free flow of important information to the public," said First Amendment lawyer Charles Tobin in the Washington Post report. "That's a very dangerous road to go down." Jane Mayer of The New Yorker goes further: "It's a huge impediment to reporting, and so chilling isn't quite strong enough, it's more like freezing the whole process into a standstill," she told the New Republic . As a case in point, Gary Pruitt , CEO of the AP, told CBS's "Face the Nation" this weekend that the Justice Department's investigation is already silencing AP sources. "Already, officials that would normally talk to us and people we talk to in the normal course of news gathering are already saying to us that they're a little reluctant to talk to us," he said. "They fear that they - they will be monitored by the government." Perhaps the most serious implication, however, is that the investigations threaten to jeopardize the very practice of investigative journalism, already endangered by budget cuts and the 24/7 news cycle. "Under US law, it is not illegal to publish classified information," writes The Guardian's Mr. Greenwald. "That fact, along with the First Amendment's guarantee of press freedoms, is what has prevented the US government from ever prosecuting journalists for reporting on what the US government does in secret. The white van involved, registration number FP07KJN, can first be seen around 10 seconds in, pulling out of a yard, with the rider moving past it on the inside then ahead of it to get around a car that is being parked, although the queue of traffic ahead means that that manoeuvre would not have held up the van. The rider, who is also on Twitter under the user name CCStev, said that he showed the footage to police, but they told him that Home Office rules meant they were unable to press charges, because the driver, after being made aware of the video, admitted his guilt, and had no previous convictions. While the police insist their hands are tied, the cyclist is said to have been unhappy with the alternative provided - that he seek a "local resolution" with the motorist, although it is a course of action he has reluctantly accepted. The van is operated by a Birmingham-based pet business, Weird and Wonderful of Birmingham, which has deleted its Facebook and Twitter accounts as a result of the complaints it was receiving from cyclists, as well as disabling the online feedback form on its website. By Robert Costa Representative Jason Chaffetz, a Utah Republican, says President Barack Obama may face impeachment over his administration's response to the Benghazi attack. "They purposefully and willfully misled the American people, and that's unacceptable," Chaffetz tells me. "It's part of a pattern of deception." Behind the scenes, he says, House Republicans are frustrated by the White House's evasiveness, and the calls for impeachment will likely increase. Chaffetz acknowledges that House speaker John Boehner is wary of moving too swiftly against the president, but the brash, 46-year-old conservative is tired of waiting for answers. He's ready to issue subpoenas and schedule more hearings. His chief concern is that the White House, which he says is staffed by "self-preservationists," seems to be hiding documents related to the attack and the president's decisions, in order to protect the administration from scrutiny. "They've released 100 emails, but there are thousands of documents that we still need to see," he says. "The truth gets colder as time goes on, so we need to stay vigilant." "Now, the speaker has more patience than I do," Chaffetz says. "He has told me to be patient, that the truth will eventually surface. But I'm not a patient person, and if this administration makes us do this the hard way, that's what we'll do." Chaffetz's tension with the White House has been building for months, ever since he took a fact-finding trip to Libya last October, less than a month after the terrorist attack. During that visit, he huddled with several U.S. diplomats, including Gregory Hicks, a former deputy chief of the Libya mission. But the heavy-handed tactics of the president's advisers, he complains, sullied his investigation from the start. He worries that allies of Obama and former secretary of state Hillary Clinton have inappropriately pressured his sources - and restricted his access. "They've obstructed me from doing my congressional duty," he says. "When I went over there, a State Department babysitter intimidated me and many others." "The State Department had people watching my every move," he recalls. "But even as they watched me like a hawk, I was able to see how ill-prepared the embassy was for an attack. There were walls that weren't very tall, and trees that could be climbed. One of the walls was so low that some people were able to prop up a ladder to dump trash on our embassy's grounds. I asked one of my guides why that was allowed, and he shook his head and said, 'Well, I guess we just didn't want to offend the neighbors.'" But the worst part of the journey, Chaffetz says, was having State Department lawyer Jeremy Freeman along, shadowing him through every meeting. Hicks and other U.S. diplomats, he says, were effectively muzzled by his presence. "And at one point, Hicks had to leave a meeting, only to be chastised over the phone by Cheryl Mills, Hillary Clinton's top adviser," he says. "It was unsettling - to see, up close, the depths to which Secretary Clinton was willing to go to manipulate the process." Chaffetz says he has relayed these stories to his Republican colleagues, especially after Hicks testified before the House oversight committee earlier this month. Chaffetz says the conversations about his experiences have stirred unease, and he expects members to press the White House for details on how officials may have obstructed Congress. "The White House likes to say that our questions are a political sideshow, but it seems like it was their politics that caused a lot of the problems," Chaffetz says. "Hicks testified about being suppressed from saying much to me during my trip, so it's not like we're running roughshod." Over the weekend, White House communications director Dan Pfeiffer appeared on the Sunday talk shows and defended the administration. When asked about the editing of national-security talking points and the president's conduct on the night of the attack, Pfeiffer argued that the administration was engaged and acted responsibility. Chaffetz doesn't buy it. "This is an administration embroiled in a scandal that they created," he says. "It's a cover-up. I'm not saying impeachment is the end game, but it's a possibility, especially if they keep doing little to help us learn more." Look for Chaffetz, the chairman of the oversight committee's subcommittee on national security, to lead the fight for accountability as the controversy - and talk of impeachment proceedings - escalates. In the meantime, he's trying to get back to Libya. "Unless you go out there and kick the tires, you'll never really get the proper perspective," he says. "I've been kicking them for a while, but this is only the beginning.
