Tony Tran, 35, who is seeking to rebuild his life with his nine-year-old son in Melbourne, is demanding an apology and compensation from the Federal Government. "I continue to suffer ongoing physical and psychological health issues and I am receiving medical treatment," Mr Tran said. "Hai (my son) is improving, but he suffers ongoing difficulties from the experience." Mr Tran and his family fled to the US as Vietnamese refugees when he was a child, his migration lawyer David Manne said. Years later, in 1992, he arrived in Australia on a visitor visa and settled in Brisbane, where he married his second wife, a South Korean national, in 1997. Mr Tran worked, the couple bought a house, and his wife gave birth to their son Hai, who is now nine years old. His right to re-enter the US had legally expired and he applied for permanent residency in Australia. The Immigration Department issued him a bridging visa while his application was being considered, Mr Manne said. In December 1999, the department informed Mr Tran that he no longer had a bridging visa and placed him in detention for having no lawful status in Australia. While in detention, he was stabbed and suffered head injuries during an attack from another detainee. In mid 2005, he was summarily released from detention after receiving a letter from the department saying he had, in fact, always had a bridging visa. "The letter reads like a sort of an equivalent to an alteration to a parking infringement notice," Mr Manne said.
