Officer Shoots Woman Homeowner Accidentally

"SAN DIEGO -- A Spring Valley woman remained hospitalized Tuesday night after she was accidentally shot by a Sheriff's deputy in her backyard.Family members said Jennifer Orey, 36, suffered wounds to her breast, bicep, and little finger when she rounded a corner of her home Sunday to find deputies with guns drawn.
San Diego Sheriff's officials identified the deputy who pulled the trigger as Luke Berhalter.
Berhalter has been with the department for less than two years. He has been placed on administrative leave pending an investigation.
The deputies were responding to a call of a suspicious man wearing a ski mask in the 8900 block of Leigh Avenue, authorities said.
"She just wants them to own up to their mistake," said James Morgan, the victim's brother.
Sheriff's officials say Orey's gate looked suspicious, so deputies entered her backyard. When they ran into her, one had a "spontaneous reaction" and shot her.
They said Orey was not holding anything in her hands, and was not armed. "

You have got to be kidding me, "spontaneous reaction"? Why the hell was the safety off? This is exactly why you rarely draw your gun in situations like this and instead pull out the tazer. IF you draw your gun and you are searching you making sure your finger is OFF the trigger with the nuzzle pointing slightly down.
