Police dash cam released after fatal accident after officer runs red light

Police dash cam.Virginia,Recently released after trial:TEXT FROM SOURCE:Ashley McIntosh was killed in a violent collision with a Fairfax County police officer who ran a red light at a high speed with no siren on February 12, 2008.

The officer was charged with reckless driving and went to trial.

The court found that the officer's actions were not reckless and delivered a not guilty verdict.

How could this happen? Because Virginia law says an officer's speed and use of lights and siren when driving through a red light are determined by what is "reasonably necessary." In otherwords, at the discretion of the officer. .

This is not enough and jeopardizes lives.

Suggested change to law:

Change the law to: a) mandate that emergency vehicle operators always use their lights and siren when driving through red lights, and b) mandate emergency vehicle operators slow their vehicles so they are able to make a controlled stop when driving through any intersection.

One Virginia Senator is planning to introduce legislation with our change in December, 2008.

    • I agree!, the only option to not cross a green light is the siren of a police or a ambulance, without it, and running at high speed is a call for an accident!.

    • 2 items. First I agree cops should not be aloud to run a red light without a siren sounding. Second a red light during a response should be looked at like a stop sign, go ahead and run the light but make sure you are free to go.

      He was following the rules, but the rules are screwed up and need to be changed. Hopefully they are, and hopefully this doesn't happen again. AND.. Hopefully your grandmother is never the victim of a home invasion.

      The cop was found not guilty by a jury of 12 non cops. Police have to have a certain level of immunity to operate. They need to spped and run red lights among other things.
      I bet you would be the first to complain if a cop took an extra 10 seconds to get to your problem situation. If I was a cop and I knew it was you waiting, I'd take the long way and wait for every red light.

Well, this was in February 08 so I don't know what the final outcome of everything is...but I hope Ashley's family won a big fat civil lawsuit against the state of Virginia and whoever else they could get a dime out of. I mean honestly, the guy was running without sirens, there's video of it....and not even a reckless driving charge. Seems reckless to me.   • Wow - this cop actually had the balls to go to court and plead not guilty? I hope the toll will be taken on his soul over time and slowly ruins him. He certainly earned a special place in hell for trying and succeeding to get away with this. Most people would at least have the decency to admit they were wrong. I hope to god this can be used against him in some way.

  • thats messed up, im NOT a cop hater by any means but he was obviously at fault. where im from the police always stop at the intersections even when responding to a call, to be safe. A couple of years ago a female cop did not stop and t boned another vehicle, she was found guilty and charged with running a red light causing an accident. again im not a cop hater, but in this case, the cop should not have been let off like that.

  • I'm a cop and if there was ever a clearer cut case of reckless endangerment it's this. I don't know how this guy was trained, but we NEVER roll up on a red light like that (even when we are 10-18).

  • Goes to show that that a civilians life isn't worth a cops. It IS a law that while a police car or any other emergency vehicle is going above the speed limit they MUST have Both their sirens blaring and lights flshing, not just one or the other. The jurors in this case either knew the man personally and cut him a break, or were hand selected to vote any way the court saw fit. They should be hit in such manner that would be true justice.
