MONTICELLO - A Swan Lake man facing a felony driving while intoxicated charge showed up to Sullivan County Court on Monday with a bag full of beer and was promptly thrown in jail without bail.

Keith Gruber, 49, had a scheduled 10:30 a.m. pretrial hearing.

Gruber came to court about an hour and a half late carrying a black bag that contained four cans
of Busch beer. He also was carrying an open can of Busch beer and was drunk, authorities say.

He tried to throw away the can.

The bag was confiscated by court officers at the security check and was produced to Judge Frank LaBuda. Before Gruber arrived in court, LaBuda relieved Gruber’s attorney from the case. Gruber has been represented by the Greenwald law firm but hadn’t cooperated with them.

LaBuda asked Gruber if he enjoyed his “liquid lunch.”

Gruber indicated he did and said he was sorry.

“It was obvious he was intoxicated,” LaBuda said.

Gruber, who has prior DWI convictions, was arrested on Dec. 27 in the town of Liberty and was out on $30,000 cash bail.

LaBuda put Gruber in jail on no bail.

  • Turned 18 and was drinking a beer at a bonfire party. The sheriff pulled up and everyone ditched or hid their beers. I was like, hey I'm not wasting my beer cause I turned of legal age. Sheriff leech asked me what I was drinking and I responded "Silver Bullet". He said step back to the car with me. I obliged and sat in the passenger seat and took a sip of my beer. He requested my license, which I promptly gave to him. He looked at it and said, "you don't turn 18 till midnight" More..

  • I had to go to court in 2000 for a DUI, paid handsomely for an attorney only to find out that the prosecutor mis-filed my paperwork. Attorney had to go meet in judges chambers, told me that I MUST come back to court in 3hrs. I went to a BBQ spot near the courthouse at lunch and recognized Sam Huff, former Redskins player, and drank beer w/ him. He's been in that situation (like 4x) Told him I will probably do a day in jail, and he bought me some more drinks. It was the best way to go to jail!
