Police officer cleared in taser incident "man went down like tree"

"In his written report, Ruha said the subjects were “actively
fighting” when he approached the scene. He wrote, “Both subjects were in
boxer stances and were hitting each other with fists.” Ruha also stated
one of the men was still trying to fight as he and another officer
approached on foot, leading Ruha to draw his Taser. According to Ruha,
when he ordered the man to get on the ground, the man turned, looked at
him and “squared up” to fight to him.

“None of that is true,” Hertz-McGrath said. “The officer gets out of
the car, and the Taser is immediately on that man’s chest... No one was
actively fighting when he approached the scene. He came upon two men and
a woman standing in the street. Did he have a right to investigate?

Of course he does. That’s his job.”Hertz-McGrath said officers acted inappropriately and put a man’s safety at risk.

“That man went down like a tree,” she said. “He could have been seriously injured.”
