Victim says shooting accidental; husband still jailed

Urbana Twp., Ohio — The victim of last weekend's shooting has corroborated her estranged husband's story that she was accidentally shot in her home.
Carolyn Havens, 42, of 4960 E. County Line Road, was released from the hospital Thursday, Dec. 4, where she had been in critical condition since she was shot in the chest Nov. 31. Her estranged husband, Timothy Havens, 38, of 859 Hilliard St., told the 911 operator his wife was accidentally shot during sex.
Sheriff's deputies arrested Timothy Havens the day after the shooting on charges of violating a civil protection order that Carolyn Havens had filed against him in August.
In his 911 call, Timothy Havens said his wife's gun was lying beside the bed and when she got up she was shot. He stated in the same conversation that he had thrown the gun off the bed. He later said it was on the night stand.
"So far, (Carolyn Havens) is confirming it was an accidental shooting also," said Sgt. Matt Melvin of Champaign County Sheriff's Department.
Timothy Havens was found guilty in September of violating that order and of assault. That prior offense elevated the current charge to a fifth-degree felony. He remains in jail on a $75,000 bond. A 60-day sentence from the September offense also has been re-imposed.
"Evidence was collected the day of incident. Some of that information is not back yet," said Champaign County Sheriff Sgt. Chris Copeland. "Until we have all the facts in the case, the incident remains under investigation."
The sheriff and prosecutor's office expect to present their findings to the Champaign County grand jury, which meets Dec. 11.
