Biggles9: Baby-swinging video uploader fronts court

A man charged over a video of another man swinging a baby around like a rag doll, says he'd be happy with a trial by jury.

Christopher Charles Illingworth, 60, of Maroochydore, briefly appeared in Maroochydore Magistrates Court on Thursday charged with two counts of using a carriage service to transmit child abuse material.

His lawyer Chelsea Emery told the court the matter would be strenuously defended.

The case was adjourned to February 19, 2009, to allow the prosecution to gather more evidence.

The freelance journalist and father of four allegedly shared the video using the website Liveleak, a site similar to YouTube but mainly carrying short videos relating to news and current affairs.

Illingworth's home was raided in November by police officers from Taskforce Argos, which targets child pornography and abuse.

Illingworth was not involved in making the three-minute video, which is understood to have originally been uploaded by a Russian circus performer.

It features a man in a lounge room swinging what is believed to be a nine-month-old baby boy.

Illingworth said outside court he would defend the charges.

"My name and health has been damaged - I'm going to do something about this," he said.

"If anything, I want this to go to trial by jury - 12 adults, 12 parents are going to see the stupidity of this.

"Bring it on, bring it on with all your might."

He said supporters had raised around $500,000 to cover his legal costs.

Ms Emery said outside court the case had wide implications for all internet users.

"I've not heard of anyone being charged with anything similar to this before," she said.

"It's a very unusual case - it potentially presents enormous difficulties for internet users."

      This is good...The prosecutors need tme in order to get evidence...Aren't they supposed to have evidence in order to charge a crime against one of its citizens? Seems Biggles has enough fight in him to get through this fine and make a mockery of the Queensland authorities on a national scale.

    (a) The Baby Swinging Video is of public benefit; and
    (b) The Baby Swinging Video does not extend beyond what is of public benefit.

    • Oh and let us NOT forget, Fox News thought it was of 'Public Benefit' and they aired it, so why couldnt Biggles also post a viral video here for Public Benefit?

      There is no doubt that this video could be of Public Benefit in making people aware that its very dangerous and wrong to do this to a child.

      But, does this video go BEYOND Public Benefit? This is what the prosecutor will need to prove to a jury if the Federal Police are to have a hope of winning this case.

    • Fox aired it because it's an injustice and they aren't as left leaning as the other networks. Political correctness doesn't have them in quite the same irrational choke-hold.

      I think Biggle's best hope is jury nullification. And it's probably a good hope. What the jury thinks is what matters (it was what the jury thought, not the evidence, that let OJ walk), and they'll probably have enough common sense to not send a man to prison for this.

  • Prosecutors are actually going to spend time, money, and resources to "build a case?"

    I picture a child who is the victim of abuse and is stuck not being able to do anything about it, and the government who takes their time and resources to prosecute an innocent instead of the criminals.

    • Interestingly in New South Wales such a misuse of public funds could possibly be prosecuted under current public policy laws, but only after an investigation by both the police and ICAC. However, the problem is that both those organisations would ignore the case as they "only investigate major breaches". There is no record of them ever investigating ANY misuses of public funds, which is interesting because NSW is the most corrupt state in Australia.
