  • The Constitution DOES have a preamble, but "We hold these truths..." isn't in it.

    Anyway, cap 'n' trade is a scam, and I fully support Bachmann in opposing it.

    Wrong, Boehner isn't a Senator, he is a Congressman in the House of Representatives.

    I'm not holding Rachel Maddow to any acocunt - only to point out she was wrong, as was John Boehner.

    Rachel Maddow can spew ignorant rants all night long on her cable news program for all I care, it is still somewhat a free country.

    John Boehner's fate will be decided during next years election.

    Misquote...maybe, although he said "in the preamble" without clarifying which one, but probably was referring to the constitution in his hand.

    Either way, confusing a preamble is different than outright saying there isn't one.

    This is of course correct.

    The preamble of the constitution does not confer or deny powers to the federal government. Because of this it has not been, and will not be used to ajudicate constitutional law.

    The preamble to the Declaration of Independence, however, has been and will continue to be used to ajudicate constitutional law.

    It is disappointing that the minority leader in the House does not know the difference, and the importance regarding constitutional law.

    The section of the preamble to the DoI that he should have quoted is thus:

    But when a long train of abuses and usurpations, pursuing invariably the same object evinces a design to reduce them under absolute despotism, it is their right, it is their duty, to throw off such government, and to provide new guards for their future security.

    It is this portion that all Americans should contemplate now and into 2010.

  • Quibbling. Maddow's error was minor, as were all the errors she was ridiculing. But Maddow does need to get off her high horse. It appeals to a small number of Ooh-I'm-so-smart liberals, but leaves the rest of the country thinking "What a jerk!"
