Location of crime means no death penalty for the crime

Michigan man Steven Deuman Jr. is charged with a capital offense: sexually assaulting and killing his 15-week-old daughter in August 2011. Usually, prosecutors would seek the death penalty in a first-degree murder case such as this, but because the alleged assault and killing took place on an Indian reservation, Deuman will not face execution if convicted. For that same reason, the case is being handled by Federal prosecutors. Under Federal law, tribal authorities have the right to decide whether to pursue the death penalty; unless a tribal governing body decides otherwise, Native Americans cannot be executed under the Federal Death Penalty Act of 1994.

Deuman allegedly told a tribal police officer that the girl, identified in court documents as E.D., was asleep on his bed, but when he went to check on her, he found her unresponsive on the floor with a used condom in her mouth. He also allegedly told investigators that he may have killed E.D. but doesn’t remember, and that an “evil spirit” may have taken over him during that time. If convicted, Deuman faces a life sentence.

  • I think you have it ass backwards: There's NO death penalty in Michigan (for over 150 years). There IS one on the Federal books, and the only way this sleezeball could qualify is under Federal Law. That's why the charges were filed by the feds...

  • I think you are missing the point here.
    If it was not on tribal land, the death penalty would be COMPLETELY out of the question because Michigan doesn't have a death penalty.
    The only reason it is Federal case at all, is because it was on the reservation.
    So if "tribal law didn't reside" in this case as in your poll.... there would still be no chance of the death penalty.

    • @castanza128 then they should have just said no death penalty as in michigan they dont have it. It was said due to the location of the crime meaning where it happened was taken into account. I personally would take him to a state that did have the death penalty and drop him at the prison door.

      Its a fucking joke. That baby was 15 weeks old. 15 weeks.
      He deserves to be choked to death. When death penalty is given the way in which they took a life should be done to them. Exactly the same way.
