FORT PIERCE — A 39-year-old Vero Beach man was arrested Saturday after being found with a short-barrel assault rifle outside a gun show at the Havert L. Fenn Center in Fort Pierce, according to a recently released arrest affidavit and a sheriff’s official.
James Mathew Kennedy, of the 1000 block of 27th Avenue Southwest, took the AR15-type rifle into the gun show, where he went to buy parts, officials said. They gave this account: The rifle had a barrel length about three inches shorter than is allowed without first going through a lengthy federal approval process.
A federal Bureau of Alcohol, Tobacco, Firearms and Explosives official identified the weapon as being illegal.
A St. Lucie County Sheriff’s Office investigator arrested Kennedy, listed as self-employed, after he left the show and went to his vehicle. He faces a charge of possession of short barrel assault rifle.

The Bushmaster Carbon 15 comes in both a rifle and pistol version. The rifle has a 16 inch barrel, the pistol has a 7.5 inch barrel.
The legal destinction lies in the fact that the pistol does not have a butstock. As such it is not subject to the short barrle rifle provision of the national firearms act.

If you believe the law is unconstitutional, then by all means challenge it in court. Until someone does challenge the law, and have it struck down as unconstitutional, it will remain on the books and enforceable.

I think the motive of the law is about how easy the weapon is to conceal. It's hard to hide a full size rifle or shotgun.
The only reason you would need a short barreled rifle is.
1. They are cool
2. You plan on being in a close quarter gun fight against people with body armor and you need more penetrating power than a pistol.
Nobody except swat teams have any real use for short barreled rifles.
