A former part-time Darby Township police officer entered a negotiated
guilty plea Monday to two counts of theft by unlawful taking for
stealing two rifles from police headquarters and selling them.
According
to an affidavit of probable cause, Jonathan Edward Fiscaro, 23, of
Sharon Park Drive in Folcroft, took the first rifle from the station
sometime in January 2011 and sold it in February 2012 for $500. The DPMS
Rifle belonged to fellow Darby Township Police Officer Craig White.
The second was a Bushmaster Rifle, owned by and registered to the Darby Township Police Department, according to the affidavit.Fiscaro, who had joined the force about two years before his arrest in March, sold that firearm for $600.Police say White first noticed the rifle
missing on March 3 and notified Darby Township Police Chief Leonard
McDevitt Jr. The department subsequently noticed the second rifle
missing later that day.McDevitt contacted county detectives
Robert Lythgoe and Thomas Worrilow, of the county’s Special
Investigation Division, who began an investigation.Fiscaro initially tried to pin the blame on another individual, but later owned up to the theft, according to the affidavit.Under
the plea agreement negotiated by Assistant District Attorney Thomas
Lawrie and defense counsel William Davis, Fiscaro will serve 15 weekends
at the county prison in Concord and pay $1,100 in restitution.Judge James Pagano also sentenced Fiscaro to one year of concurrent probation.
