*VOLUME* .... so, the kid starts a fight, and the teacher gets suspended ?
A wild fight that erupted between a freshman student and her teacher at Stockton's Cesar Chavez High School has left the student facing an assault charge and the teacher facing an investigation of her actions. More info under the clip.
The fight broke out Monday at 12:30 p.m. when Marlina Martinez, 15, began applying makeup at the end of her math class.
Martinez said her female teacher, who is not being identified because she is not yet facing any charges, confiscated her makeup. Martinez then called her mother on her cellphone to have her demand that her teacher give her back the makeup.
When Martinez gave her teacher the phone to talk to her mother, the teacher confiscated the phone. At that point, Martinez confronted her teacher and loudly demanded to have her phone back.
The incident developed into a shoving match and then escalated into a fight. Eventually, the pair end up on the classroom floor as other students try to pull them apart.
The entire incident was captured on cellphone video by another student in the class, who then posted it to his Facebook page.
Stockton Unified School District spokesperson Dianne Barth acknowledged the video is shocking to watch. "It was a regrettable incident and very unusual. I don't recall an incident like this happening in the last several years," Barth said.
Barth said the teacher has been put on paid administrative leave as the incident is investigated. "I'm not sure what happened.
I can't even tell by looking at the video what happened once the initial pushing started. I don't know," Barth said.
Martinez was arrested by school district police on an assault charge. She has been suspended for five days and has a meeting with her principal on Thursday to learn if she will be expelled.
She admits she should not have confronted her teacher.
"I know I did wrong by like going up to her and trying to get my stuff, but from the get-go she should have gone and pushed that button," said Martinez, referring to a button in each classrooms teachers can use to summon security.
Martinez's grandmother agreed. "When they see the student that is getting aggressive or loud, they should walk away, push whatever button they have to push for the security and they should step outside," Alice Gonzalez said.
Martinez showed off a bump on her forehead and scratches on her neck and upper back she received in the fight.
Barth said the teacher was also "roughed up" and has a black eye.
