'Big Man' Train Passenger Charged With Assault

A train passenger dubbed "Big Man", whose confrontation with
a fellow passenger featured in a viral YouTube video http://www.liveleak.com/view?i=11d_1323639138 has been charged
with assault.

The alleged incident happened at Linlithgow station on December 9

Alan Pollock, 35, was shown apparently removing 19-year-old Sam Main from the Edinburgh to Perth train on Friday December 9.



The video - filmed by another passenger with a mobile phone - has had more than a million views on YouTube.



The alleged incident happened atLinlithgow station, on board a ScotRail service on Friday, December 9.



British Transport Police said both men had been reported to the procurator fiscal.



Sky News understands that Mr Pollock, an investment banker from Stirling, has been charged with assault.



Mr Main, a student, has been reported under Section 38 of the Criminal Justice and Licensing Act Scotland.

      Yeah I knew it was coming too. The fact is that the Big Man did not have any authority to get in a physical confrontation with the punk. If he was the security guy on the train or a police officer it would be different. Rules are Rules and technically he did assault the little punk.

      Clearly you have no idea when it comes to scottish or British law.

      Common law states:-
      3. — (1) A person may use such force as is reasonable in the circumstances in the prevention of crime, or in effecting or assisting in the lawful arrest of offenders or suspected offenders or of persons unlawfully at large.
      (2) Subsection (1) above shall replace the rules of the common law on the question when force used for a purpose mentioned in the subsection is justified by that purpose.

      He does not have to be arresting him, if you read the act 'PREVENTION OF CRIME' is where the common law power comes from. The crime is fare evasion/fraud or using threatening abusive behaviour. By ejecting the oik from the train, he is preventing further criminal offences and a continuance of the same offence.

    • @fido321 goto agree with satan777, the raj never paid so he got ejected he didn't care about the other passengers on the train and failled when asked to provide a valid ticket and refused to leave the train.

      You're right, he assaulted someone, and regardless of the justification the police are obliged to report him. It's up to the DPP as to whether they will charge him and what they'll charge him with. I doubt the court will do anything other than tell him he shouldn't do that.
