Although both are at fault here, the one cutting into the hard shoulder lane (or whatever you call it in your locale) was more at fault. An emergency vehicle could have legitimately been using that lane to skip traffic and the lane cutter would still have caused a collision.

@passive_observer The one passing using the shoulder is at fault. It is illegal to pass using the shoulder. It is not illegal to pull off the road.
