Wrongful-death lawsuit filed against LA County Sheriff's Department in Fatal Shooting

LOS ANGELES (KABC) -- The family of a man shot dead by an L.A. County sheriff's deputy has filed a $5 million wrongful death lawsuit against the department.

The family says surveillance video shows that Jonathan Cuevas posed no threat during the 2010 incident.

Video shows a squad car pulling up next to three men walking along the street. A deputy flashes a light at them.

As he exited the car Cuevas, 20, started running and the deputy shot at him.

"He fires six shots running towards Jonathan, and the seventh shot he stands over Jonathan and shoots him right through the torso, as a coup de grace kill shot," said James Segall-Gutierrez, an attorney for the Cuevas family.

"Was he armed? Yes. Is the whole story being told now? No. Let's not forget who has already investigated this: Internal Affairs, Office of Independent Review monitoring that. Homicide Bureau. The District Attorney," said Sheriff's Spokesman Steve Whitmore.

Segall-Gutierrez says Cuevas' fingerprints were not on the gun the department claims he was carrying, and questions its authenticity.

  • 5 million? Don't they calculate how much that individual would have earned in the course of a lifetime to come up with the amount? Well they should .. I think most would be owing the state a few hundred thousand when the totals are added up.
    I'm sure his gun wasn't there just for self defense.

    • @buoymarker internal affairs is a fucking joke... it's like cops policing cops... they don't always do a good job at that and there are ways to manipulate your own department so that internal affairs doesn't suspect a thing.

      Hey super-stupid.....deadly force cases are also presented to the DISTRICT ATTORNEY'S office for review, as well as the "Independent Board of Review" which is made up of a group of attorneys, not affiliated in any way to the law enforcement agencies or the courts.

      They all gave that cop's shooting a clean bill of health.

  • Police do have a right to use deadly force to defend themselves or another person if they are facing a deadly threat situation. Police officer's also have the right to shoot at a fleeing person if that person is armed with a deadly weapon, and the officer has probable cause to believe that the suspect is a threat to other people.
    This officer is going to have to prove that this person was threatening to him or someone else or he's in big trouble.

  • If a fleeing suspect is armed, he can be shot to protect others in the area because this armed suspect poses an immediate danger to others. The video is grainy so it is hard to see the suspect's hand movements.
