Hutaree Militia Can Go Free on Bond, Judge Rules

Nine Members of Michigan-Based Militia Accused of Plotting to Kill Police Officers; Will Be Subject to Electronic Monitoring.

A judge said nine members of a Michigan-based militia accused of trying to plot war against the government can be released from jail on bond.

U.S. District Judge Victoria Roberts on Monday overturned the April 2 decision of a federal magistrate judge. She says all can be released with electronic monitoring devices and other strict conditions.

The government says the nine members of a southern Michigan militia called Hutaree are radicals who planned to kill police officers and more. They were charged in March with conspiracy to commit sedition and attempted use of weapons of mass destruction.

Defense lawyers say it's just a case of irrational, hateful speech.

  • Hmmm... I wonder how much of this case was heresay; what other evidence is there against these people? Maybe the judge made her ruling because of lack of evidence?

  • if hate-filled venomous speech was a crime there would be very few Democrats left in Congress

  • The United States is correct that it need not wait until people are killed before it arrests conspirators, U.S. District Judge Victoria Roberts said in a decision this morning. But, the Defendants are also correct: their right to engage in hate-filled, venomous speech, is a right that deserves First Amendment protection.

    • Plus, they could file suit agains the leftwing liberal media for sensationalizing the story and assessing the 'terror group' label to them. I'd sue their nuts off. I bet this was just a rural family, who enjoy outdoor shooting activities and might have joked about something anti-government. The media just took pictures of them wearing camo on a hunting trip and made it sound like they dress like that all the time and carry guns everywhere they go. What a bunch of shit. I feel for these people.

Obama has started the pendulum of public opinion swinging back to the right, and hard.

  • Releasing all of them? If there was sufficient evidence to charge these folks with conspiracy to murder, then it seems insane to allow them to post bail. I suspect some big chunk of the government case has collapsed.

    • They got shit on them and even the judge knows it. The so called bomb evidence is road signs they found at the property, supposely they were going to waste the time cutting up road signs for shrapnel instead of going to Home Depot and buying a pound of nails. They will walk or either get a sweet plea deal.

    • I grew up in a rural area of America, road signs are cheap targets, it take a couple dollars, a little effort and welding equipment to buy 3/4" plate steel to make drop down targets.

Anyone that has ever driven through the country has seen a road sign with a bullet hole in it, and years ago it was quite common.

And the jist of the hate speech was in a prepared "speech" the man was going to give in public. If anything is protected by free speech it should be a "speech" More..

    • There is still a few bullet riddled signs on the backroads out here so I know what you mean. I read the speech he was going to give and I can tell you it wasnt anymore extremist than what most people here write. The 1st amendment will clear their names or so I hope.

  • When I heard that the father (David Stone Sr) was being harassed by a local cop, the local cop shinning his 10,000 candle watt spotlight into the family home at 3 in the morning it came as no surprise that a person would say "I'd like to kill that bastard" and being a member of law enforcement the feds took it as a threat against law enforcement.

The whole case will unravel on the grounds of free speech.

    • Sedition is a term of law which refers to overt conduct, such as speech and organization, that is deemed by the legal authority as tending toward insurrection against the established order.

US Code Title 18 Part 1 Chapter 115 Section 2384:

If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by forc More..

    • The quoted statue applies to speech directed against the Government of the United States of America, and as such in the transcript of the speech in question the defendants never once spoke of rising against the Government of the United States of America....

      Read the "Speech"

what they spoke about was, the New World Order.

      Good Luck

    • Just because, even though you've read it, you'll still say they never said the NWO was/is affiliated with or is our government seeing as how your only argument is semantic:

"They forget, they live in our neighborhoods. They shop at our grocery stores. They eat at our restaurants. We are the ones who control everything in this nation from preparing the food that they eat to running the power stations that they get their electric from to even maintaining the roads they drive down."

      You lose.

and I am not a co-conspirator as you wish to label my opinion as such.

Justice will run it's course, and the federal government will lose.

In closing, every American needs to be concerned, themselves and their families future with, what is the New World Order?
      Who are these people?
      Where are they located?
What is their net worth? How vast of a fortune do they control?

Can they, do they, control More..
