Some witnesses are speaking out after cell phone video posted online which shows Rocklin police officers using force during an arrest at a New Year's Eve party.

At 11:30 p.m. Friday, Rocklin police said they witnessed 41-year-old John Banks pushing his girlfriend during an event inside Rocklin's Mercedes-Benz dealership.

Police said an officer tried to stop the man, but he resisted, forcing them to use a Taser gun and to repeatedly hit him with a baton.

"The whole time this occurred, he was resisting," Lt. Lon Milka said. "He was resisting the officer's commands to put his arms behind his back."

However, Banks denied the police department's version of events.

He said he was drinking and got into an argument with his girlfriend but that he never pushed her and that he never fought back against police.

"They beat the mess out of me for no reason when they could have just walked me out," Banks said.

On the video, a party attendee is seen attempting to step in between police and Banks trying to stop the use of force.

Witnesses claimed police pushed Banks' head underwater in a fountain.

"He was face-down, unconscious in the fountain and they were still using force on him," witness Amber Harlan said.

Two witnesses who said they did not see Banks resisting arrest.

As of now, Rocklin police are not investigating their officers' actions further because they said nobody has filed a formal complaint.
