Self-immolated Moshe Silman's case in the Tel Aviv District Court reported
as a case of simulated litigation to the UN Human Rights Council

In July 2012, social activist Moshe Silman self-immolated during social
protest in Tel Aviv. The opening lines of his suicide letter accuse the
Tel Aviv District Court of obstructing his access to justice in his
complaint against the social security administration. Review of the
records of the Court reveals conduct of simulated litigation, involving
judges, clerks, and attorneys in the Tel Aviv District Court and in the
Supreme Court of the State of Israel. Attempts continue to access court
records, to inspect and to copy. In handling such requests, the District
Court continues to engage in simulated service of simulated decisions.

Jerusalem, October 11 – Human Rights Alert (NGO) has filed a report with
the United Nations Human Rights Council, pertaining to the conduct of the
case of the self-immolated Moshe Silman in the Tel Aviv District Court and
the Supreme Court of the State of Israel. [5]

In July 2012, social activist Moshe Silman self-immolated during social
protest in Tel Aviv. The opening lines of his suicide letter accused the
Tel Aviv District Court of obstructing his access to justice, and named
Judge Hagai Brenner as the culprit.

Review of the records of the District Court in the cases related to Moshe
Silman revealed conduct of simulated litigation,involving judges, clerks, and attorneys in the Tel Aviv District Court and
in the Supreme Court of the State of Israel:
• The complaint and initial decision in this case were filed under a
court file number that now the office of the Clerk of the District Court
says never existed;
• None of the published decisions are signed, instead, simulated,
¨Post-it Decisions” were issued;
• Judge Hagai Brenner affected the dismissal of the original
complaint, and then denied an appeal from his own decision.

Attempts continue to access court records in the relevant cases, to
inspect and to copy – a fundamental Human Right. The District Court
continues to obfuscate on permitting access to the records, and continues
to engage in simulated service of simulated decisions.

Today's report was filed as an Appendix to the Human Rights Alert (NGO)
submission to the Human Rights Council for the 2013 Universal Periodic
Review of Human Rights in the State of Israel. The original report
provided extensive evidence, based on data mining and system analysis, of
large-scale fraud in the electronic records of the courts of the State of
Israel, through invalid, fraudulent electronic record systems, which were
developed and implemented in the courts over the past decade. [1-4] The
case of Moshe Silman was discovered after the original submission to the
United Nations, and it was therefore filed as an appendix, documenting the
previously reported fraud in Net HaMishpat – the electronic record system
of the district courts.

A paper, based on the Human Rights Alert submission, pertaining to the
electronic record systems of the courts of the State of Israel, was also
peer-reviewed and published by Data Analytics 2012, and international
conference of computer science experts. [6] An overview for general
readership was also published through OpEd News, a syndicated news
service. [7]
