I agree when all ambiguity is erased take the life of the offender.
Like you alluded to there is no 'fool' proof process and I don't want to flip the switch on someone if there is even a hint of doubt.
Caught red handed and six feet under is where I would put someone for committing murder, lesser crimes deserve punishment but not death.
The Chinese have a very aggressive approach to 'rehabilitating' thier offenders.....likely fine for them but over the top for us.
