Italian court convicts scientists for not predicting earthquake

experts around the world say they are appalled by an Italian court’s
decision to convict six scientists on manslaughter charges for failing
to predict the deadly quake that devastated the city of L’Aquila. They
warned the ruling could severely harm future scientific research. The
court in L’Aquila sentenced the scientists and a government official
Monday to six years in prison, ruling that they didn’t accurately
communicate the risk of the earthquake in 2009 that killed more than 300
people. The trial centered on a meeting a week before the 6.3-magnitude
quake struck. At the meeting, the experts determined that it was
“unlikely” but not impossible that a major quake would take place,
despite concern among the city’s residents over recent seismic activity.
Prosecutors said the defendants provided “inaccurate, incomplete and
contradictory information about the dangers” facing L’Aquila. The court
agreed, convicting the six scientists from the Italian National
Institute of Geophysics and Volcanology (INGV) and a member of the Civil
Protection Agency. It also ordered the Italian authorities to pay 7.8
million euros ($10 million) in damages. Seismologists were aghast at the
court’s decision, noting that earthquakes remain impossible to forecast
with any kind of accuracy. -CNN

As I understand it the issue lies not in their inability to predict an earthquake (an impossible task), but in their not actually performing the physical tests required to ascertain the structural integrity of the buildings. After taking public money for non-existent tests they then provided reports of the buildings' integrity with no test data which created a false sense of security. These guys are not scientists, but fraudsters with degrees.

Exactly. They took taxpayer money to perform risk assessments on the physical structures, did not actually do any of the tests, and then told people that they were safe staying in the buildings. People died as a result.
American courts would probably find against scientists in this case, too. Failing to do what one is paid to do and then feeding misrepresentations to the public that gets people killed? The scientists are liable.

The American reporting of this case has been a joke.
The scientists were guilty of dereliction that led to deaths because they had been hired by the government to assess the risk of earthquakes, which included doing risk assessments of damage to buildings in the city. The people in L'Aquila were accustomed to fleeing older buildings when a few tremors started happening since this often leads up to a larger quake. erm...not in American Law. We are talking about degree and mens rhea here. There are degrees in Murder charges as well. Highest being Capitol Murder charges.
A 2ND Degree murder (Murder 2) charge carries with it the same penalties as a Manslaughter 1 (Man 1).
I do not know Italian law, so I'm not aware of the differences. I take it Roman Law is different? Manslaughter is in Fact Murder in America.Just a different degree of culpability is all.
