How I see it is this. We are all going berserk 'cause an authority is getting down on a liveleak poster. Since when is it legal to distribute offensive material? Is it ok to post child porn for example? Well of course it isn't.. Why? because by posting it you are shpwing other's offensive material. The judgement here is really about what is ok to post, what is THE LINE? In my opinion this video was disgusting and foolish but that is just MY opinion. Those who found it child abuse, and I understand how it can be seen that way, therefore get angry at people posting it and legally the poster WAS distibuting an offensive video.
This is not really a question about what is ok on the internet, and what isn't - this is about how far the law goes when you post something which can be seen as offensive or illegal. If you post something that is an attack on another person, then by most laws you can be sued by that individual if you have said something defamatory or untrue.
Why should the law not extend to posting something offensive? What would you think if the guy posted a video of a child being slapped around and crying? Would that be ok? Would that be his 'right' under the assumed law of the internet where anything goes? Remember, to some people that video is child abuse, and child abuse, bestiality, rape are things that will attract attention and is illegal to post.
I feel for the guy, because he may have been posting that to make a point about what a bastard the dad was. However he posted it, by posting you distribute...
I hope the guy doesnt get prosecuted, and I hope the energy is spent on tracking the dad down in the video and the kid gets checked out for damaged joints.
Just something to think about...
