it was not the BMW driver fault it was the SUV drivers in the middle of the rood who caused the accident,, and lift the scene as if it doesn't concerns him.

You forgot to mention that BMW is going some 90-100 kmh where 60 is allowed, overtaking on the right. Evasive maneuvers are forbidden in our laws, only braking. BMW 100% guilty (as always).
