The DHS is essentially a military force not covered by the Posse Comitatus act or the insurrection act of 1807.
And as such they can wage war on the civilian population (without a request from a local government official) and call it a law enforcement action.
Technically the Air Force isn't covered under these acts because there was no air force at the time. However when it was still the army air corps it was covered.
