TiZA school’s future falls to
bankruptcy court

Weeks after it ceased to exist in the eyes of the state, a metro-area charter school is making a case for its survival in bankruptcy court.

The Inver Grove Heights-based Tarek ibn Ziyad Academy filed for bankruptcy June 30, a day before it found itself lacking the state-approved overseer it needs to continue operation. The school since has asked the bankruptcy judge for permission to continue paying employees' salaries and benefits, stressing the value of saving its successful academic program.

Meanwhile, the American Civil Liberties Union asked the court to allow its 2-year-old federal lawsuit against the academy to move toward a resolution. The ACLU accused TiZA of promoting religion. The school has denied those charges, arguing it merely accommodated its primarily Muslim students.

These developments leave TiZA attorneys with a delicate balance to strike: They are championing the school's survival as they argue that its likely demise makes the ACLU lawsuit moot.

"How can TiZA adjust its religious accommodation policies if it doesn't exist anymore?" asked Shamus O'Meara, the school's lead counsel. "It's pretty nonsensical to try to push those claims forward."

At the start of this month, TiZA's overseer - the Washington, D.C.-based nonprofit Islamic Relief USA - became ineligible to continue its role because of a new charter school law that bans out-of-state overseers. Islamic Relief and the state were co-defendants in the ACLU lawsuit before settling out of court.

The state Education Department turned down an application by Twin Cities nonprofit Novation to take over as TiZA's overseer.

TiZA filed for Chapter 11 bankruptcy, which allows an organization to restructure and continue to exist. In court filings, the academy touts the high test scores and other achievements of its overwhelmingly low-income minority students.

"The continued operation of TiZA saves a successful program for the development of students," records say.

And to continue to operate, the school said, it needs to hang onto its staff of about 60. The school, which lists a monthly payroll of about $143,000, is asking the judge to allow it to continue paying its teachers and other employees over the summer.

An attorney for U.S. Trustee Habbo Fokkena argued against granting that request. The ability of the school to reopen in the fall is "clearly in dispute," wrote the attorney, Michael Fadlovich.

He especially objects to a severance clause in employment offers made in the weeks and months before the school filed for bankruptcy: If the school is forced to close, the offers said, employees would receive four months' salary - a liability of about $438,500 by his estimate.

Mark Kalla, TiZA's bankruptcy attorney, did not return a call seeking comment.

TiZA's Executive Director Asad Zaman said the school hasn't worked out a survival plan. Its leaders and legal team still are weighing a court appeal of the Education Department's rejection of Novation's application.

Zaman said he does not plan to re-invent TiZA as a private school, which would require lining up significant private resources.

O'Meara, the school's counsel, is more pessimistic. He said many TiZA employees scattered over the summer, and many students have requested their academic records so they can transfer to other schools.

"The reality is there isn't anyone to fill that school any more," O'Meara said. Meanwhile, the ACLU, the state and Islamic Relief have asked the bankruptcy court to lift a freeze on all legal actions that went into effect automatically when TiZA filed for bankruptcy.

For one thing, the state and Islamic Relief want to pursue repayment of more than $1.7 million in legal expenses that the federal court ruled TiZA should cover. The ACLU is seeking closure in the long-running case, which still is scheduled for trial in November.

Peter Lancaster, lead counsel for the ACLU, said the trial is unlikely with TiZA closed. Lancaster said the ACLU realizes it might not be able to get TiZA to repay millions in state aid or cover the group's own legal fees even as he questioned why TiZA had not yet filed information on its assets.

But Lancaster said the ACLU still hopes the court will approve the ACLU's settlement with the state and thus unseal records marked confidential during the lawsuit's investigative phase.

"The single most important thing we still hope to accomplish is the release of that information to the public," Lancaster said.

Lancaster and his team have argued the documents release would be "highly useful" to the bankruptcy court as well, throwing light on TiZA's financial dealings.

TiZA and its attorneys have called the issue of the settlement documents a misleading publicity stunt by the ACLU.

Judge Robert Kressel, who presided over the bankruptcy case of former auto mogul Denny Hecker, will rule on the various motions in coming weeks.

LETTER TO EDITOR , NO ONE WOULD PUBLISH
ORANGE COUNTY ( CALIFORNIA ) NEWSPAPER-New Immigrants
This is a very good letter to the editor. This woman made some good

points...

For some reason, people have difficulty structuring their arguments

when arguing against supporting the currently proposed immigration

revisions.. This lady made the argument pretty simple. NOT printed in

the Orange County Paper..................

Newspapers simply won't publish letters to the editor which they either

deem politically incorrect (read below) or which does not agree with the

philosophy they're pushing on the public. This woman wrote a great

letter to the editor that should have been published; but, with your help it

will get published via cyberspace!



My wife wrote a wonderful letter to the editor of the OC

Register which, of course, was not printed. So, I decided to "print" it

myself by sending it out on the Internet. Written in response to a series of letters to the editor in the

Orange County Register:



Dear Editor:
So many letter writers have based their arguments on how this land is

made up of immigrants. Ernie Lujan for one, suggests we should tear

down the Statue of Liberty because the people now in question aren't

being treated the same as those who passed through Ellis Island and

other ports of entry.


Maybe we should turn to our history books and point out to people like

Mr. Lujan why today's American is not willing to accept this new kind of

immigrant any longer. Back in 1900 when
there was a rush from all areas of Europe to come to the United States,

people had to get off a ship and stand in a long line in New York and be

documented. Some would even get down on their hands and knees and

kiss the ground. They made a pledge to uphold the laws and support

their new country in good and bad times. They made learning English a

primary rule in their new American households and some even changed

their names to blend in with their new home.



They had waved good bye to their birth place to give their children a

new life and did everything in their power to help their children

assimilate into one culture. Nothing was handed to them. No free

lunches, no welfare, no labor laws to protect them. All they had were the

skills and craftsmanship they had brought with them to trade for a future

of prosperity.


Most of their children came of age when World War II broke out. My

father fought along side men whose parents had come straight over from

Germany , Italy , France and Japan . None
of these 1st generation Americans ever gave any thought about what

country their parents had come from. They were Americans fighting

Hitler, Mussolini and the Emperor of Japan . They were defending the

United States of America as one people.


When we liberated France , no one in those villages were looking for the

French-American or the German American or the Irish American. The

people of France saw only Americans. And we carried one flag that

represented one country. Not one of those immigrant sons would have

thought about picking up another country's flag and waving it to

represent who they were. It would have been a disgrace to their parents

who had sacrificed so much to be here. These immigrants truly knew

what it meant to be an American. They stirred the melting pot into one

red, white and blue bowl.


And here we are with a new kind of immigrant who wants the same

rights and privileges. Only they want to achieve it by playing with a

different set of rules, one that includes the
entitlement card and a guarantee of being faithful to their mother

country. I'm sorry, that's not what being an American is all about. I

believe that the immigrants who landed on
Ellis Island in the early 1900's deserve better than that for all the toil,

hard work and sacrifice in raising future generations to create a land that

has become a beacon for those legally searching for a better life. I think

they would be appalled that they are being used as an example by those

waving foreign country flags.


And for that suggestion about taking down the Statue of Liberty , it

happens to mean a lot to the citizens who are voting on the immigration

bill. I wouldn't start talking about dismantling the United States just yet.

I stand here in abject stupefaction. The so-called "right" or "Tea Party"

in this republic is being so thoroughly rolled and defeated that I am

struggling to come up with an adequate violent submission metaphor

that does not involve prison rape . . . and they honesty think that they're

"winning." Really? You call this winning?

• - Obama gets over $2 Trillion to spend before the 2012 election
• - There are no real spending cuts
• - There is a massive tax increase effective January 1, 2013

Obama is going to be handed something in excess of $2 Trillion -- and

he has made it perfectly clear that he will spend every penny of it before

the November 2012 election. That's why he kept saying, " . . . so we

don't have to do this again", meaning raise the debt ceiling again. The

debt ceiling would only need to be raised if all of the money had been

spent. Therefore, he has stated very clearly that he will spend every

penny of any debt ceiling increase. He is going to burn through $2

Trillion-plus in the next sixteen months. This was the Obama regime's

plan from day one. Geithner appeared before Congress in early May and

told them this in no uncertain terms. This outcome has been a known

quantity all along.
There are no spending cuts in this plan. It is all accounting fraud!

Saying that you are not going to spend money in Afghanistan ten years

from now is not spending cuts. Even if you accept the $1 Trillion in cuts

over ten years propaganda, that is only $100 Billion per year, which is

essentially meaningless relative to the size of the problem. Furthermore,

even a miniscule uptick in interest rates, which given the massive

debasement of our currency is now a mathematical certainty, will

completely consume that $100 Billion per year. It's all a joke.

Back to the $2 Trillion that Obama is being handed. I honestly think

that most people in this country have no understanding of simple

counting numbers. Do you not understand how much a trillion is?

Where do you think this money is going to come from -- who has two

trillion dollars to loan us? China ? Nope. Not even close. China 's

entire GDP is only $6 Trillion. Do you honestly think that China is

going to loan us one third of their total annual economic production?

China was a huge creditor to us back when $100 Billion was considered

a staggeringly large amount of money - which was four years ago. Now

$100 Billion is literally a rounding error. Do you realize that there are

only a handful of nations of this planet that even have a GDP in excess

of $2 Trillion? If these countries loaned usevery penny of their GDP, it

wouldn't even be $2 Trillion:

Canada ($1.57 T)
India ($1.54 T)
Russia ($1.46 T)

Are you starting to understand the scope of what we are talking about

now? Obama is going to embezzle considerably more than the entire

economic output of Canada , India or Russia to his cronies before the

2012 election -- and that is just counting this round of spending. This

doesn't include the other $5 Trillion he has already burned through since

2009.

China is not going to lend us this money because they simply don't have

anything close to that much money to lend. This $2 Trillion is going to

come from the Federal Reserve. Where is the Federal Reserve going to

get $2 Trillion? They are going to print it out of thin air. We are in the

midst of the largest currency debasement ever seen in human history.

There is only one result that can come of currency debasement:

hyperinflation and total economic and societal collapse.

Have you also forgotten the so-called "Bush tax cuts"? Yeah. Those

rates are going to expire on January 1, 2013. Obama will presumably

still be occupying the Oval Office at that time assuming that he is not

forcibly removed or that the Republic is still intact at that time. Taxes

will increase significantly at that point, and the Congressional Budget

Office has scored everything put before them given the fact of the

massive tax increases on 1/1/2013. Do you understand that? When

these Republicans and even these so-called "Tea Party Freshmen" tell

you that there are no tax hikes in their "plan," they are consciously,

willfully, knowingly lying to you through their teeth.

Finally, I do not understand how it can possibly be that conservative

writers are still addressing Obama as if he is actually trying to help the

economy, but his well-intentioned policies are failing.

Obama is the enemy. Obama is a Marxist-Communist usurper and

puppet front for a cabal of Marxist-Communists who are actively trying

to destroy the United States of America . Everything they have done, are

doing, and will do has the single goal of collapsing and destroying the

U.S. economy, military, constitutional government and culture. What

part of "Marxist Revolution" do you not understand?
The Obama regime is not a failure. The Obama regime is not

incompetent. The Obama regime has achieved more in two and a half

years than anyone could have possibly foreseen. It has debased the

currency by 50% of the GDP and guaranteed that our economy will

collapse. It has looted the Treasury for more than the size of a top-ten

economy and embezzled that wealth into the hands of their fellow

Marxists in preparation for the final collapse of the United States . It has

ground the economy of the United States to a screeching halt. It has

destabilized the entire Muslim world and ensured that there will be a

nuclear war centered around Israel within the decade.

The Obama regime has no interest whatsoever in "stimulus" or "getting

folks back to work." How can you not understand this? How can we

possibly win this war if we refuse to come to terms with the fact that we

are in fact fighting a war.

Olson believes the United States is now somewhere between the
"complacency and apathy" phase of Professor Tyler's definition of

democracy, With some forty percent of the nation's population already having

reached The "governmental dependency" phase.

If Congress grants amnesty and citizenship to twenty million criminal

ONIONS

In 1919 when the flu killed 40 million people there was this Doctor that

visited the many farmers to see if he could help them combat the flu.

Many of the farmers and their family had contracted it and many died.

The doctor came upon this one farmer and to his surprise, everyone was

very healthy. When the doctor asked what the farmer was doing that was

different the wife replied that she had placed an unpeeled onion in a dish

in the rooms of the home, (probably only two rooms back then). The

doctor couldn't believe it and asked if he could have one of the onions

and place it under the microscope. She gave him one and when he did

this, he did find the flu virus in the onion. It obviously absorbed the

bacteria, therefore, keeping the family healthy.

Now, I heard this story from my hairdresser in AZ. She said that several

years ago many of her employees were coming down with the flu and so

were many of her customers. The next year she placed several bowls

with onions around in her shop. To her surprise, none of her staff got

sick. It must work.. Try it and see what happens. We did it last year and

we never got the flu.

Now there is a P. S. to this for I sent it to a friend in Oregon who

regularly contributes material to me on health issues. She replied with

this most interesting experience about onions:

Thanks for the reminder. I don't know about the farmers story... but, I do

know that I contacted pneumonia and needless to say I was very ill.. I

came across an article that said to cut both ends off an onion put it into

an empty jar...placing the jar next to the sick patient at night. It said the

onion would be black in the morning from the germs... sure enough it

happened just like that... the onion was a mess and I began to feel better.

Another thing I read in the article was that onions and garlic placed

around the room saved many from the black plague years ago. They have

powerful antibacterial, antiseptic properties.

This is the other note.

Lots of times when we have stomach problems we don't know what to

blame. Maybe it's the onions that are to blame. Onions absorb bacteria is

the reason they are so good at preventing us from getting colds and flu's

and is the very reason we shouldn't eat an onion that has been sitting for

a time after it has been cut open.

LEFT OVER ONIONS ARE POISONOUS

I had the wonderful privilege of touring Mullins Food Products, Makers

of mayonnaise.. Mullins is huge, and is owned by 11 brothers and sisters

in the Mullins family. My friend, Jeanne, is the CEO.

Questions about food poisoning came up, and I wanted to share what I

learned from a chemist.

The guy who gave us our tour is named Ed. He's one of the brothers Ed

is a chemistry expert and is involved in developing most of the sauce

formula. He's even developed sauce formula for McDonald's.

Keep in mind that Ed is a food chemistry whiz. During the tour,

someone asked if we really needed to worry about mayonnaise. People

are always worried that mayonnaise will spoil. Ed's answer will surprise

you. Ed said that all commercially- made Mayo is completely safe.

"It doesn't even have to be refrigerated. No harm in refrigerating it, but

it's not really necessary." He explained that the pH in mayonnaise is set

at a point that bacteria could not survive in that environment. He then

talked about the quaint essential picnic, with the bowl of potato salad

sitting on the table and how everyone blames the mayonnaise when

someone gets sick.

Ed says that! when food poisoning is reported, the first thing the

officials look for is when the 'victim' last ate ONIONS and where those

onions came from (in the potato salad?). Ed says it's not the mayonnaise

(as long as it's not homemade Mayo) that spoils in the outdoors. It's

probably the onions, and if not the onions, it's the POTATOES.

He explained, onions are a huge magnet for bacteria, especially

uncooked onions. You should never plan to keep a portion of a sliced

onion.. He says it's not even safe if you put it in a zip-lock bag and put it

in your refrigerator.

It's already contaminated enough just by being cut open and out for a bit,

that it can be a danger to you (and doubly watch out for those onions you

put in your hotdogs at the baseball park!) Ed says if you take the leftover

onion and cook it like crazy you'! ll probably be okay, but if you slice

that leftover onion and put on your sandwich, you're asking for trouble.

Both the onions and the moist potato in a potato salad, will attract and

grow bacteria faster than any commercial mayonnaise will even begin to

break down.

Also, dogs should never eat onions. Their stomachs cannot metabolize

onions.

Please remember it is dangerous to cut an onion and try to use it to cook

the next day, it becomes highly poisonous for even a single night and

creates toxic bacteria which may cause adverse stomach infections

because of excess bile secretions and even food poisoning.

Healing Miracle for burns:

A young man sprinkling his lawn and bushes with pesticides wanted to

check the contents of the barrel to see how much pesticide remained in

it. He raised the cover and lit his lighter; the vapors inflamed and

engulfed him. He jumped from his truck, screaming. His neighbor came

Keep in mind this treatment of burns which is included in teaching

beginner fireman this method. First aid consists to spraying cold water

on the affected area until the heat is reduced and stops burning the layers

of skin. Then, spread egg whites on the affected are.

One woman burned a large part of her hand with boiling water. In spite

of the pain, she ran cold faucet water on her hand, separated 2 egg white

from the yolks, beat them slightly and dipped her hand in the solution.

The whites then dried and formed a protective layer.

She later learned that the egg white is a natural collagen and continued

during at least one hour to apply layer upon layer of beaten egg white.

By afternoon she no longer felt any pain and the next day there was

hardly a trace of the burn. 10 days later, no trace was left at all and her

skin had regained its normal color. The burned area was totally

regenerated thanks to the collagen in the egg whites, a placenta full of

Just as I was thinking about aborting the flight, the canopy closed over

me,
and Biff gave the ground crew a thumbs-up. In minutes we were firing

nose
up at 600 mph. We leveled out and then canopy-rolled over another F-14.

Those 20 minutes were the rush of my life. Unfortunately, the ride lasted

80.
It was like being on the roller coaster at Six Flags Over Hell. Only

without rails.
We did barrel rolls, snap rolls, loops, yanks and banks. We dived, rose

and
dived again, sometimes with a vertical velocity of 10,000 feet per

minute.
We chased another F-14, and it chased us.



We broke the speed of sound. Sea was sky and sky was sea. Flying at
200 feet we did 90-degree turns at 550 mph, creating a G force of 6.5,
which is to say I felt as if 6.5 times my body weight was smashing
against me, thereby approximating life as Mrs. Colin Montgomerie.

And I egressed the bananas.

And I egressed the pizza from the night before.

And the lunch before that.

I egressed a box of Milk Duds from the sixth grade.

I made Linda Blair look polite. Because of the G's, I was egressing
stuff that I never thought would be egressed.

I went through not one airsick bag, but two.

Biff said I passed out. Twice. I was coated in sweat. At one point,
as we were coming in upside down in a banked curve on a mock
bombing target and the G's were flattening me like a tortilla and I
was in and out of consciousness, I realized I was the first person
in history to throw down.

I used to know 'cool'. Cool was Elway throwing a touchdown pass,
or Norman making a five-iron bite. But now I really know 'cool'.
Cool is guys like Biff, men with cast-iron stomachs and freon nerves.
I wouldn't go up there again for Derek Jeter's black book, but I'm
glad Biff does every day, and for less a year than a rookie reliever
makes in a home stand.

A week later, when the spins finally stopped, Biff called. He said
he and the fighters had the perfect call sign for me. Said he'd
send it on a patch for my flight suit.

What is it? I asked.

'Two Bags.'
