CANTON, Ohio—
Municipal Judge Stephen Belden on Wednesday threw out concealed carry violation charges against William Bartlett of Brewster, Ohio, convinced that prosecutors were not able to prove their
case against him.
It is a case that had already created outrage because of the profanity-laden outburst by Canton Officer Daniel Harless after he was told that Bartlett had a concealed carry permit and gun.
Bartlett, 52, was stopped by Canton police at 1:30 a.m. on June 8 near the intersection of
Tuscarawas and Newton Streets.
Officers describe the the intersection as a high crime area with known prostitution, drugs and gang activity.
They say Bartlett was stopped in the middle of the street with a back seat passenger and a known prostitute approaching the car.
At first Harless and his partner, Officer Mark Diels, were concerned about the back seat passenger who gave them a false name.
Dash camera video later shows Harless approaching the driver's door, asking Bartlett to open it and then asking him what he was doing in the area.
The officer's microphone appears to capture Bartlett try to tell Harless that he had a concealed carry weapon, but defense attorney Timothy Bellew says the officer interrupted Bartlett with a threat that if he was not telling the truth he was going to be in trouble.
The dash camera video was played for jurors on Wednesday, giving them a
chance to hear the outburst after Harless told Bartlett to get out of
the car and was told by Harless that he had a concealed carry permit and
weapon.
The officer immediately launched into an angry, profanity-filled
outburst, during which he called Bartlett a "stupid idiot" and "a
dummy."
On another part of the video that jurors were not shown, Harless is
heard telling Bartlett, "People like you don't deserve to (expletive)
move through public."

SECOND UPDATE: Canton Officer Fired For Profanity Laden Arrests

CANTON, Ohio—
The Canton Police officer who delivered two
profanity-laden outbursts caught on tape by his on-board dash camera has
been let go from the force.
Canton Police Chief Dean McKimm tells Fox 8 News that officer Daniel Harless is no longer employed with the city's police force.
According to Chief McKimm the decision to fire Harless came from the
city's safety director, Thomas Ream, who issued a ruling on Harless'
employment on Tuesday. The ruling came following an internal affairs
investigation and disciplinary hearing. The hearing was held on December
15, 2011.
Ream stated in the ruling, "Drawing from my own background in law
enforcement, I find that Ptl. Harless' actions were not a one-time
breakdown of professionalism and training standards."
He went on to say, "It is quite clear that his actions represent a
pattern of behavior where inappropriate verbal abuse and threat of death
and great bodily harm of the various complainants occurred. This
escalating pattern of potentially dangerous behavior cannot be justified
or excused and clearly illustrated the seriousness of the departmental
infractions."
Harless had come under fire for an arrest in June of 2011 where William Bartlett of Brewster, Ohio, was pulled over by Harless.
Bartlett, 52, was driving near the intersection of Tuscarawas and Newton Streets at 1:30 a.m. when he was stopped by officers.
An on-board dash camera recording of the incident captured Bartlett
trying to tell Harless that he had a concealed carry weapon, but Harless
interrupted Bartlett demanding he tell officers why he was in the area.
