German court rules religious circumcision on boys an assault

Can the reason and sanity destroyed by ridiculous religious dogma slowly be returning to the world?? In Germany, quite possibly it is!!

Circumcising young boys on religious grounds amounts to grievous bodily harm, a German court ruled Tuesday in a landmark decision that the Jewish community said trampled on parents' religious rights.



The regional court in Cologne, western Germany, ruled that the "fundamental right of the child to bodily integrity outweighed the fundamental rights of the parents", a judgement that is expected to set a legal precedent.

"The religious freedom of the parents and their right to educate their child would not be unacceptably compromised, if they were obliged to wait until the child could himself decide to be circumcised," the court added.

The case was brought against a doctor in Cologne who had circumcised a four-year-old Muslim boy on his parents' wishes.

A few days after the operation, his parents took him to hospital as he was bleeding heavily. Prosecutors then charged the doctor with grievous bodily harm.

The doctor was acquitted by a lower court that judged he had acted within the law as the parents had given their consent.

On appeal, the regional court also acquitted the doctor but for different reasons.

The regional court upheld the original charge of grievous bodily harm but also ruled that the doctor was innocent as there was too much confusion on the legal situation around circumcision.

The court came down firmly against parents' right to have the ritual performed on young children.

"The body of the child is irreparably and permanently changed by a circumcision," the court said. "This change contravenes the interests of the child to decide later on his religious beliefs."

The decision caused outrage in Germany's Jewish community.

The head of the Central Committee of Jews, Dieter Graumann, said the ruling was "an unprecedented and dramatic intervention in the right of religious communities to self-determination."

The judgement was an "outrageous and insensitive act. Circumcision of newborn boys is a fixed part of the Jewish religion and has been practiced worldwide for centuries," added Graumann.

"This religious right is respected in every country in the world."

Holm Putzke, a criminal law expert at the University of Passau, told the Financial Times Deutschland that the ruling was "enormously important for doctors because for the first time they have legal certainty."

"Unlike many politicians, the court has not allowed itself to be scared off by charges of anti-Semitism or religious intolerance," added Putzke.

The World Health Organisation has estimated that nearly one in three males under 15 is circumcised. In the United States, the operation is often performed for hygiene reasons on infants.

Thousands of young boys are circumcised every year in Germany, especially in the country's large Jewish and Muslim communities.

The court specified that circumcision was not illegal if carried out for medical reasons.

  • I'm with the Germans on this one. Nobody has the right to cut off anyone's body parts without their permission. Since juveniles cannot give legal permission, any of these dufusses who perform gender mutilation (either sex)should be tossed in jail. Full disclosure: it is mandatory in my religion and if I ever find the religious nutter who did it to me, I would gladly cut off his entire cock.

    • @khamomil I did not bring it up with them because my father passed on many years ago and my mom is elderly - I see no reason to upset her. I HAVE discussed it with an aunt and uncle - and surprisingly - they were with me on this one. My uncle had just gotten back from witnessing a circumcision and was very upset by what he saw - that clinched it.

      I once was a guest at a celebration in Tunisia for a young boy's circumcision. He was on a kind of pedestal the entire afternoon the feast lasted, and wrapped in a blanket, and he looked completely traumatized. His eyes were staring in the distance and he didn't move nor say anything.

    • @khamomil You bring up some very valid points. I can understand how subjecting a child to a violent act almost immediately after birth cannot be good for the human psyche. I never thought about it much when I was younger, but the older I get, the more I am distressed by these barbaric rituals. To quote my Christian brethren, 'Keep your Jesus off my penis.' Peace.

  • Yep, got into an argument with Freejay and Wargypzy over this last week, The Bris, or genital circumcision, is genital mutilation, a tribal custom handed down to many cultures through the three desert blood cults, Judaism, Christianity and Islam. Some branches of Islam, as we all now know, take this to the extreme to keep their girl children chaste (in other words, to stop their uncles and cousins from raping them) and remove the clitorus and sew the vagina shut!

      Genital mutilation in Africa is not related to religion but to tribal customs. It is not done to prevent uncles & cousins from raping the girls.

      Many orthadox christians still have their children circimcised out of tradition -- and so Jr looks like Dad, so to speak.
      My parents, for one.
      And yes, the mixture of African pagan practices and Islam has created an exceptionally horrible form of female bris, but it still has it's roots in Islam and Judaism -- and it is done to keep the girls chaste and virginal.

  • It's a touchy subject, I don't miss my foreskin but some people do. It wasn't done for religious reasons but reasons of health and cleanliness, which is admittedly arguable. Maybe influenced by culture but not by religion.

  • Is..this a neatzi thing? Or is it an effort to limit the ridiculous female circumcision carried out by Muslims while trying not to play favorites with the Jews. Who knows.But if I'm right, cutting off a bit of foreskin that heals in very little time and has little effect on the boy doesn't even come close to the female mutilation ..that is why it's called MUTILATION.
