He has a point. If the waitress sesarved him then called the cops it would be entrapment. She was keeping him there until the cops could arrest him. If she told him to get out and he didn't then she could have him arrested for trespass. By serving him she is conducting a mutually accepted bussiness transaction and he is therefore not trespassing.
