DHS Checkpoint Blog Entry 14: Obedience Training

On November 26th, I was stopped & seized for about the 50th time since the beginning of 2008. The seizure took place at an internal suspicionless Homeland Security checkpoint along Southern Arizona's SR86 near mile post 146. SR86 is an East-West public highway located over 40 miles North of the border and never intersects the border at any point.

During the stop, Agent Gilmore admitted he knew who I was & all three agents told me I wasn't being detained. Nonetheless, these facts didn't stop the agents from refusing to allow me to go about my lawful business, choosing instead to escalate the encounter by requesting that I move to secondary inspection for more intensive scrutiny absent my consent or any articuable suspicion.

While continuing to deny that I was being detained and refusing to allow me to leave, the agents threatened me with arrest for impeding their operations. After

  • Piss off all of the above, bunch of idiots. Plan and simple, these are illegal search and seizures. Look into the law if ya don't belive me. At least one state in the union won't allow such road blocks to occur within their borders. Mine.

    • Michigan. Michigans Supreme court has told, the federal Government, The United States Supreme court, in so many words " Go fuck yourselves, if the U.S. goverment won't protect the citizans of Michigan from illegal search and seizure than we ( the Michigan supreme court) have not only a right but a duty to protect Michigan from such an act.

Fuck these fake ass cops and their simple questions. How does answering a question determine anything, like you can't lie or doctor forms. This man More..

    • You also don't have a land border with Canada bozo. Your separated by water, except for a tiny portion where it's only a fast moving river. Have you seen a north American map lately?

    • Dude, I live in Michigan. Been to Canada many a time. I guess those so called drug runners and terroist can't find/buy a boat. What about Montana, Idaho, North Dakota. This is just an onslaught upon citizens rights. But oh wait I forgot, you have a job to do.

    • I know your in Michigan, and I know there is some problems with people trying to get into the U.S. from our side. But are you seriously comparing that problem to the one you guys have on the mexican border?

  • You thankfully are fighting a fight that few men would ever stand up and do. Im sure you carry a copy of the constitution with you, please make sure these brainless dogs know it. Have you filed suit yet against the USA? It is necessary. We, as responsible, good men, must stand up against tyranny. Evil happens when good men do nothing.

  • Do we as law abiding citizens, not have the right of freedom of travel, within our countries borders?
Do we not live in a democracy, free from needless harassment from police?
We need more citizens such as this man that challenges the system that is infringing on democracy and freedoms.
For those of you who beg to differ, watch out or one day you will wake up in a police state, with NO freedoms!

  • LOL @ 'Agent Soto' asking 'are you a United States citizen' with a foreign accent.
Reminds me of the UK Border Control Agency Immigration desks at Gatwick and Manchester - British passports being checked by someone with a long beard and a turban.
Absolutely true - I kid you not!

  • I don't think he's a jerk. I think more people should be like him. He also may sound crazy to you, but he looks like he knows what he is doing. He should be admired as a patriot who obviously sees the big picture, and knows the true meaning of individual freedom, justice and liberty. Your great country was founded on those principles. Your individual rights are being slowly eroded, and a people are being conditioned in a new manner of thinking.

i.e. I am so sick of hearing the word Ter More..

  • I have been dealing with this for a decade. It has only gotten worse all the while more and more illegals break into our country and sap our resources. I applaud this man! They are putting their resources in the wrong place. I am an American and I do not have to declare that to anyone while I am in my country unless I want to!

  • Any fuck stick that thinks these roadblocks are ok, is either too young to realize this shit is jacked, a high and self rightous bible thumping do gooder, or a complete fricken moron. Michigan does not allow any roadblocks of any kind, state or federal. our supreme court has spoken. I ask you morons, do they perform these illegal search and seizures in the upper north of our borders? No, not in Montana, not in Whyoming, and for sure not in Michigan. Michigan, has a very weak border with Ca More..

    • Yeah, cause there's no problem on the southern border is there? What's a few million illegal aliens, a few terrorists and a few tons of drugs anyway? As long as Mr. Legal beagle doesn't get even the most minor of inconveniences while his country is being invaded.

    • Actually, they have ALL the authority to stop you, even in your beloved Michigan. I don't know if you understand this, but federal trumps state. But thanks for playing.

    • Michigan Supreme court has already trumped the U.S. supreme court when it comes to road blocks. They are not allowed in Michigan. If the federal government chooses to try and enforce some bullshit that the state of Michigan has ruled unconstitional, I'm sure federal troops will be met with resistance. Come to Michigan and we will show you whos playing.

  • Douche or not, he is within his rights and asks basic questions to the homeland officer.

The point is not to give these homeland agents trouble, his point is to illustrate the basic rights and laws that protect you as a United states citizen.

Yours rights won't be taken away all at once, it will piece by piece... At some point enough is enough.

  • Funny thing with Liberals. Treat someone differently, they cry DISCRIMINATION--RACIAL PROFILING--BOO HOO!! Treat everyone the same and they still bit** and moan OOH POOR ME--THEY'RE PICKING ON ME--I KNOW MY RIGHTS!! Most of their "rights" have come from the judicial branch of the government through their lawyers. Now, if you know your Constitution as well as you claim, your rights are supposed to come from the Legislative branch. Didn't see 90% of these responders in the previous More..

  • This guy's a douche. If you ask me, his little quote about reasonable suspicion is more than fulfilled by his refusal to answer a simple question.

In all honesty, these guys' supervisors should figure out exactly what they can and canot do with this muppet and hand down instructions to their guys. I'm sure it could be argued quite successfully that refusing to answer a simple question and refusal to cooperate with reasonable demands could be reasonable suspicion to detain him.
