Man waving gun around fatally shot by Albuquerque police

Video from an officer's lapel camera shows police shoot and kill Orlando Abeyta, 28, near Central and San Pedro NE.

At least one Albuquerque Police Officer shot and killed a man who was reportedly waving a gun around. The incident occurred around 3 p.m. Monday January 6th in the area of Central and San Pedro.

A spokesperson for APD said officers, who were patrolling the area, observed a man running across Central with a firearm, and then waving it in "a dangerous fashion." As officers approached, the spokesperson said at least one of them fired. The suspect died at the scene. During the investigation, police recovered a gun.

A witness said police shot the man when he tried to put an object in his pocket. "It's something that I witnessed, that I have to live with from this day forth," the witness said. "Seeing him around he's a happy man, he's a young guy, always happy and making jokes, doing silly stuff and now he's just laying over there."

According to court records, he had previously faced several charges including resisting an officer. That charge was dismissed.
