"There are many cases of men marrying underage girls," restaurant owner Ruduan Masmud told reporters. "I do not see how my case can be any different," adding it was "suka sama suka" or mutual consent acceptable under sharia law. In a case that has outraged rights activists Mr Masmud, a father of four from his first wife, allegedly raped the girl inside a car parked by a road in Kota Kinabalu, the capital of the Borneo state of Sabah, on February 16. Advertisement But on April 18 the girl withdrew her accusation against the man in a police report and said they are in the process of him taking her as his second wife. In subsequent court hearing prosecutors did not object to the case being withdrawn but said the man needed to settle the matter under sharia law. The girl's father said Mr Masmud paid the family 5000 Malayasian ringgits ($1,708) in compensation and said he accepted the marriage. "It is best for her that they get married. What else can I do?" he said. Mr Masmud said he plans for the girl to finish her studies and then "take up a cosmetics course with his first wife." After reports of the marriage emerged Sabah's minister for community and consumer affairs Datuk Jainab Ahmad said her ministry was questioning the validity of the marriage. "As a mother, I am still puzzled: how could the father of the girl allow his daughter to be married to the man who had raped her?" she said. "The girl was only 12 years and six months. I believe the victim is in a trauma. She should be protected instead of marrying the man who raped her." The Child Rights Coalition Malaysia (CRCM), a group comprising seven child-related non-government-organisations, slammed the Sabah court for ruling in favour of the child marriage. "It is unfortunate that marriage is seen as a solution for addressing the growing societal issue of rape," the coalition said in a statement. "We strongly feel that the verdict may lead to more societal issues such as early marriage, teenage pregnancy and broken families rather than preventing such issues from happening in the future," it said. "We also would like to assert our view that the child's willingness (to marry) could arise from coercion, innocence or even threat which in all ways will impede the safety and positive well-being of the child." The coalition is appealing to both the Sabah public prosecutor and Sabah's sharia court to reconsider the marriage application and decision to withdraw the rape allegation. The story came from a village in Khashrood district of Nimruz province in Afghanistan. A medical doctor assigned in the main hospital in Zaranj city, the capital of the province, who wished to remain unnamed confirmed that he was "made aware" of the incident and that it was "too late to do anything for her" as well the "remote area didn't allow them to do anything". The girl was one of the several daughters of a man in his late 30s. For an unknown reason he gave his daughter to the Mullah of their village for a big amount of money. It is also common in Afghanistan's rural areas or 3rd level provinces/cities to marry young girls to old men, and trading their daughters for their debts or other items. The mullah is in his late 50s and is the mosque guy of the village where this incident happened. The mullah is already married and has many children too. The two families hold a tribal meeting, agree on the price that the groom's family pay to the bride's family, and they set a date for wedding. In rural areas like this here there are no engagements or any ceremonies beforehand like there are some in the metropolitan and urban areas. The two families planned a wedding party, the wedding and Nekah (The religious process in which a woman is officially married to a man) took place and the 8-years-old bride became the 50-years-old Mullah's 2nd wife. The celebration party was over and the sun downed - the time to have sex (not make love) with the 8-year-old bride. Naturally, she started to bleed in a very bad amount, but the mullah was too annoyed for not being able to have sex with her, to care for what he did or her bleeding or her wounds that he gave her. The girl had her scarf stuffed in her mouth, crying and trying to not raise her voice because others were there in the room adjacent to or outside. The girl was bleeding and there was nobody to help her, neither could the Mullah ask for help as it was a shame for him. Our 8-year-old bride bled and went into traumatic shock from blood loss and early in the morning around 5 when the sun was about to rise, she passed away. He and another man are being held under armed guard at separate hospitals in London. The news of the prisoner release was announced on Tuesday shortly after the government relaxed the curfew in Maiduguri, the capital of Borno state and a stronghold of Boko Haram, which has been fighting the government to enforce Islamic laws. "The (prisoner release) measure, which is in line with presidential magnanimity to enhance peace efforts in the country, will result in freedom for suspects including all women under custody," a statement by defence spokesperson Brigadier-General Chris Olukolade said. Olukolade's statement said President Goodluck Jonathan had ordered the prisoner releases on the recommendation of a panel he set up to seek a political solution to the conflict. Jonathan offered an amnesty on Sunday to fighters who surrender, a sign he is keen to keep channels for a peaceful way out of the conflict open as far as possible. Al Jazeera's Yvonne Ndege, reporting from Maiduguri, the birthplace of Boko Haram and the base of the military offensive, said the detained Boko Haram suspects will be released to the state governors "for rehabilitation and eventual release back to the community".
