During a break in jury selection for Zimmerman's trial, Jarrett told 
viewers of Fox News' live Internet broadcast that the judge had tried to
 restrict the evidence to facts related to the day of the shooting.
&quot;She's said we're not going to have any of this stuff introduced as 
evidence about the history of Trayvon Martin, whether he had a history 
of getting involved in fights, making threats, marijuana use, gun use, 
being suspended from school and so on and so forth,&quot; he observed. 
Former federal prosecutor Doug Burns pointed out that the judge may 
allow evidence that Martin had marijuana in his system at the time of 
his death. 
&quot;If an M.E. -- a medical examiner -- takes the witness stand and says
 he was high on marijuana based on toxicology, how does that play?&quot; 
Jarrett wondered. 
&quot;That's a very good question,&quot; Burns agreed. 


&quot;If he is high, he may have acted irrationally and may have been violent,&quot; Jarrett opined. 


Burns noted that the prosecution could argue &quot;the reverse spin, which is the effect of marijuana making you more mellow.&quot;


&quot;If it's in his system, that's a fact that the jury is entitled to 
know,&quot; Burns added. &quot;But again to repeat our point, it can cut both 
ways. You could call an expert to say that marijuana doesn't make you 
violent.&quot;
Speaking on the online Internet video broadcast last week, Jarrett  offered the opinion  that Zimmerman &quot;has already been punished&quot; for killing Martin because he &quot;looks like he's put on a hundred pounds.</description>

SANFORD, Fla. (WOFL FOX 35 ORLANDO) -During a news conference following Wednesday's jury selection proceedings, a lawyer for the family of Trayvon Martin stressed that the teenager George Zimmerman is accused of murdering is not the one on trial.


Martin family attorney Ben Crump said at a short meeting with representatives of the media, &quot;Trayvon Martin is not on trial here, he is the victim. George Zimmerman, his killer, is the man who is on trial.&quot;Crump also took issue with a comment made by former New York City police detective Harry Houck Tuesday on a FoxNews.com live panel, in which he said that Martin would still be alive if he didn't have a &quot;street attitude.&quot;

&quot;This comment is reprehensible and extremely reminiscent of the victim-blaming rhetoric we saw a year ago,&quot; said Crump.  &quot;We all know,Trayvon Martin was unarmed.  All he had was Skittles and can of iced tea.George Zimmerman was an armed adult.  He profiled and chased Trayvon Martin and shot him in the heart.&quot;


On a third day of juror questioning, the lawyers sought to whittle down the pool of hundreds of potential jurors to just six, plus four alternates, who will decide the fate of Zimmerman, a Florida neighborhood watch volunteer.  In Florida, 12 jurors are required only for criminal trials involving capital cases, when the death penalty is being considered.

The day began with Circuit Judge Debra Nelson asking Zimmerman about the responses to questionnaires by potential jurors.

&quot;Have you had the opportunity to discuss with your attorney how you felt about the responses to those questionnaires?&quot; she asked.  &quot;Yes, Your Honor,&quot; Zimmerman replied.

Attorneys asked each potential juror what they thought of the news coverage of the case and whether or not it tainted their views.  A potential white juror in his 20s, known at &quot;R-39,&quot; had a strong opinion.
&quot;Murder is murder.  Even if it's self-defense, it still doesn't make it right,&quot; he said.
He was dismissed after acknowledging bias.

A middle-aged white man, known as &quot;E-7,&quot; said he was unemployed and wanted to be on the jury.
&quot;I can't form an opinion, because everything I have can be flushed with facts.&quot;

Then, the judge asked him a question about a Facebook posting, after he had indicated that he had posted some thoughts about the case.

&quot;Did you post something on March 21st under the Coffee Party Progressives?&quot; Judge Nelson asked.  &quot;That's possible, because they're on my list,&quot; E-7 replied. Then the judge handed the potential juror a piece a paper asking him to identify the post as his. 
&quot;I don't need an explanation for what is posted, I just want to know if it is, in fact, your posting,&quot; said Judge Nelson.  &quot;Yes, yes that is,&quot; he responded. 


The postings were about Trayvon Martin and the Million Hoodie March and have since been deleted.  Then &quot;E-7&quot; was asked to leave.
Two potential black jurors were questioned on Wednesday.  One woman criticized the Sanford Police Department for not making an arrest immediately after the shooting of Martin. The other woman said she is keeping an open mind, even though many of her relatives support Trayvon Martin.
&quot;But my immediate family that I see, they want to wait and see exactly how the trial progresses,&quot; she said.

The judge has been strict with media and their equipment, but it was a bodyguard who caused a disruption in court when his cell phone went off.


Attorneys had interviewed 18 potential jurors by lunch break Wednesday on the third day of selection. By the end of the day Tuesday, 75 jury candidates had been dismissed.There are now 20 candidates who have been questioned individually about pretrial exposure and have not been dismissed for cause or hardships.   Once they have 30 jurors, they will be brought together as a group for broader questioning by lawyers on both sides.

Zimmerman, 29, is pleading not guilty to second-degree murder charges in the death of 17-year-old Trayvon Martin. If convicted, Zimmerman could face life in prison.

      <description>This past Thursday, George Zimmerman's attorneys released new evidence relevant to the upcoming trial of their client on a second-degree murder charge for the shooting of Trayvon Martin.


The Martin family attorneys say the evidence is irrelevant. They are wrong. It is damning. The text messages and photos from Martin's cell phone tell a story wildly at odds with the one the State of Florida and the media have been peddling for more than a year, but one altogether truer and sadder.


In the way of recap, in February 2012, Zimmerman, a neighborhood watch captain in Sanford, Florida, shot and killed the seventeen-year-old Martin.


Taking their cue from the Martin family's attorneys, Reuters ran the first national article on the shooting ten days after it happened.  Zimmerman was a &quot;loose cannon.&quot;  He profiled Martin, stalked him, and shot him, disregarding police instructions.  Martin, by contrast, was a &quot;good kid.&quot;  He had hoped to be a pilot.  He was simply bringing the soon-to-be iconic iced tea and Skittles home to his &quot;little brother.&quot;


This story was pure fable from the beginning, and the attorneys knew it.  Even before going public, they moved to seal Martin's school records, and with good reason.  Consider this exchange between Martin and a female friend on November 21, three months before his death.  After he told her he was &quot;tired and sore&quot; from a fight, she asked him why he fought.  &quot;Bae&quot; is shorthand for &quot;babe.&quot;


MARTIN: Cause man dat nigga snitched on me

FRIEND: Bae y you always fightinqq man, you got suspended?

MARTIN: Naw we thumped afta skool in a duckd off spot

FRIEND: Ohh, Well Damee

MARTIN: I lost da 1st round :( but won da 2nd nd 3rd . . . . 

FRIEND:  Ohhh So It Wass 3 Rounds? Damn well at least yu wonn lol but yuu needa stop fighting bae Forreal

MARTIN: Nay im not done with fool..... he gone hav 2 see me again

FRIEND: Nooo... Stop, yuu waint gonn bee satisified till yuh suspended again, huh?

MARTIN: Naw but he aint breed nuff 4 me, only his nose 


As his social media accounts show, Martin was a student of mixed martial arts.  The fight followed the MMA format.  A day later, he would tell a friend that his opponent &quot;got mo hits cause in da 1st round he had me on da ground nd I couldn't do ntn.&quot;  As his girlfriend complained, Martin was &quot;always&quot; fighting.  He was also something of a sadist.  His opponent, after all, did not bleed enough.  Why might this be relevant?


Witness #6, the best of the eyewitnesses to the shooting, told the Sanford PD that a there was a &quot;black man in a black hoodie on top of either a white guy ... or an Hispanic guy in a red sweater on the ground yelling out help,&quot; and that black man on top was &quot;throwing down blows on the guy MMA   style.&quot;


Martin was not the innocent little boy that the media relentlessly and corruptly portrayed him to be.  At the time of his death, he was five feet, eleven inches and weighed 158 pounds.  To put this in perspective, legendary boxer Tommy &quot;The Hitman&quot; Hearns was six feet, one inch and 145 pounds when he first won the world welterweight title as a twenty-one-year-old.


Before leaving for Orlando on February 21, 2012, Martin had already missed 53 days of school that year and been suspended three times, most recently for possessing drug paraphernalia, the time before that for getting caught with women's jewelry and a burglary tool.  Why might this be relevant?


When George Zimmerman first spotted Martin near the shortcut into a community plagued by burglaries and home invasions, he told the dispatcher, &quot;This guy looks like he's up to no good.  Or he's on drugs or something.&quot;  Zimmerman might have been right on both counts.


Had the school district police not been ordered to suppress crime statistics, especially for black males, Martin would likely have been arrested at least twice, and that might have snapped his parents out of their fog.  Instead, as the new evidence reveals, he was allowed to live out his increasingly angry, aberrant life as though he were merely a bit mischievous.


On November 22, the day after the MMA-style fight, Martin told a friend that his mother &quot;just kicked me out&quot; and that he had to move in with his father.  When the friend asked why, Martin answered, &quot;Da police caught me outta skool.&quot;


&quot;U a hoodlum,&quot; said the friend.  &quot;Naw,&quot; said Martin.  &quot;I'm a gangsta.&quot;  Incredibly, his death would transform this wannabe gangster into a saintly little boy, or, in the words of Florida State Attorney Angela Corey, a &quot;precious victim.&quot;


On December 21, 2011, Martin told a friend, &quot;dam I just got in trouble 4 sum sh** I aint even do.&quot;  His mother, Sybrina Fulton, was dismayed.  &quot;Pack up your clothes now,&quot; she texted him.  &quot;I love u but I think u being w/ ur Dad is best.&quot;


Martin lived with his mother only intermittently and spent even less time with his father, who was then living with a sister in the Miami area.


On December 22, Martin confided to a girlfriend, &quot;I got in trouble.&quot;  She asked, &quot;What did you do now.&quot;  As was typical, Martin took no responsibility.  &quot;I aint do ntn . . . . call me.&quot;  The friend had other priorities: &quot;I'm about to get my nails done so you gotta wait a few.&quot;


On the day before Christmas, Martin's mother, Sybrina Fulton, texted him: &quot;I'm concerned about u but I'm praying for u and I want U to pray for yourself EVERYDAY, ok.&quot;  She was texting the son she used to know.  The Trayvon who was about to turn seventeen, she knew next to nothing about.


On January 6, 2012, Martin got into trouble at school again.  When asked why, he told a friend, &quot;Caus I was watcn a fight nd a teacher say I hit em.&quot;  Said the friend, &quot;Idk how u be getting in trouble an sh**.&quot;  By this time, Martin's mother had thrown him out of the house for &quot;fightn,&quot; and he had moved in with his aunt and uncle.


The multiple texts about &quot;weed&quot; and the photos of marijuana plants confirmed his interests in drugs -- a friend called him &quot;weedhead&quot; -- but the new photos pointed to an even more dangerous new hobby -- namely, guns.  Indeed, one of the photos of Martin's showed a hand, likely Martin's own, on a pistol.


On February 21, 2012, Martin took the bus for Orlando to stay with his father's girlfriend, Brandy Green.  He was free to travel because his school had suspended him for marijuana.  The bust did little to sober him up.  &quot;I hid m weed,&quot; he confided to a female friend, afraid that they might have searched him on the bus.  He texted later that day, &quot;I got weed nd I get money Friday.&quot;


The saddest messages among these texts come from the parents who indulged him.  They had all but lost control of their son but chose not to see how far out of control he had spun.  Like so many divorced parents, they were torn between punishing him and appeasing him.


The father, Tracy Martin, texted his son during this trip to Orlando.  &quot;Show much respect to   and adjust to my Lady &amp;amp;  . Show them you a good kid and you want positive things aroud you.&quot;  His mother texted him as well: &quot;R u comfortable on the bus??  Go to sleep n u will be there soon.&quot;


In between these texts, Martin was negotiating to buy a handgun with a friend.  &quot;U wanna share a .380?&quot; he asked.  Guns excited him.  &quot;U got heat??&quot; he enthused earlier upon learning that a friend had access to a gun.


Upon leaving Miami, Martin seemed to be growing angrier.  On February 21, he texted a girlfriend who was pouting about another girl, presumably in Sanford.  Wrote Martin, &quot;f*** u cuz I neva text ha 2 day I made dat sh** up so u leav me df alone bout it.&quot;


Two days later on February 23, a friend tried to warn Martin off some behavior that troubled even the friend.  &quot;I ain't ya parent,&quot; he texted him, &quot;but gsh** thro it away.&quot;  Martin was not in the mood to be lectured to.  &quot;Y u gotta knock my hustle??&quot; he shot back.


On February 26, bored and likely high, Martin was in no mood to be challenged by some small &quot;white&quot; guy who was trying to maintain a visual on him until the police arrived.


&quot;As I headed back to my vehicle the suspect emerged from the darkness and said, 'You got a problem?'&quot; Zimmerman would tell the Sanford PD.  When Zimmerman answered, &quot;No,&quot; Martin said, &quot;You do now.&quot;  As it turned out, both of them had a problem.  Martin's proved fatal.


Martin's parents failed him.  The school system failed him.  The sad vestiges of the civil rights movement betrayed him, and the media betrayed America.  This all comes at a cost, and the piper has yet to be paid.

MAIn a bid to muddy up Trayvon Martin in advance of trial, a lawyer for George Zimmerman has released photos of a handgun and marijuana plants that were found on the late teenager's cell phone.In a court filing today, attorney Mark O'Mara listed documents and images he &quot;intends to introduce into evidence&quot; during the criminal case against Zimmerman, who has been charged with murdering Martin. The 17-year-old was shot to death in February 2012 by Zimmerman (who claims that he fired in self-defense while being attacked by the unarmed teenager).

Included in the photos that O'Mara says he wants jurors to see are two images extracted from Martin's Huawei phone showing a Smith &amp;amp; Wesson handgun and clip. In one photo (seen above) the weapon appears to be held by the person who snapped the photo. The second photo shows the gun and clip atop what appears to be a soiled mattress.

Two other photos from Martin's phone show potted marijuana plants.

O'Mara has also notified Florida prosecutors that he will try to introduce text messages from Martin's phone. Those messages include exchanges dealing with Martin's suspension from school for fighting and his mother's decision that he needed to move in with his father (from whom she was divorced). &quot;My mom just told me i gotta mov wit my dad,&quot; read one November 2011 message that was followed up with a text noting, &quot;She just kickd me out : (.&quot;

Other texts on Martin's phone appear to refer to his use of marijuana and theoffer of a gun.

Days before Martin was killed, his father sent a text with advice about how his son should behave and show respect. &quot;Show them that you a good kid and you want positive things around you. Be a big brother and not a DONKEY ...... LOVE DAD.&quot;


O'Mara also wants to introduce several photos of Martin, including one image showing him giving two middle fingers to the camera.MAY

      <description>The defense team for George Zimmerman, the man charged with second-degree murder in the Florida shooting death of unarmed teenager Trayvon Martin, has released a trove of texts and photos from Martin's cell phone - but it's not clear whether they'll be admissible in trial.

The newly released evidence, posted to a website run by Zimmerman's defense team on Thursday, includes texts from Martin where he discusses being suspended from school and smoking marijuana. He also shows an interest in guns in several texts.

This comes just days before a key hearing next Tuesday that will determine the admissibility of certain evidence at the trial.

Martin, a black 17-year-old, was shot to death by Zimmerman on Feb. 26, 2012, in Sanford, Fla., in a case that set off racial tensions around the country.The 25 photos released by Zimmerman's team include some of Martin that have already circulated widely online, as well as some new ones, including one where Martin shows his gold teeth to the camera while sticking up his middle fingers, and a close-up picture of a gun that the defense says was taken from Martin's camera, although it's not evident from the photo who is holding the gun.

Zimmerman, a former neighborhood watch volunteer of white and Hispanic descent, has pleaded not guilty, claiming he shot Martin in their gated community after Martin attacked him.

In one of the text conversations, sent 12 days before his death, Martin tells a friend he has been suspended from school for fighting.

&quot;Why you not in school?&quot; a text he receives asks.


&quot;Suspended.&quot;

&quot;I thought you was going out with ur friend,&quot; the reply says.

&quot;Naw my ol g say she dont want me home caus she think ima get in mo trouble,&quot; he texts back.

Martin's texts also indicate he may have been curious about guns.

&quot;U gotta gun?&quot; reads a text from Martin's phone, sent on Feb. 18, 2012, to a friend of his who was on the phone with him on the night of the shooting.

&quot;You want a 22 revolver&quot; asks someone in a text he receives that day.

Three days later, Martin mentioned a caliber of gun while asking a friend in another text, &quot;U wanna share a .380 w. ?&quot;

Other texts released allude to problems Martin was having at home and with authorities. 

&quot;My mom just told me i gotta mov wit my dad,&quot; says one from Nov. 22, 2011. &quot;She just kickd me out.&quot; 

Later that day, a text says, &quot;Da police caught me outta skool.&quot; 

Marijuana references are scattered throughout the texts. Some of the newly released photos show Martin blowing smoke and what appear to be marijuana plants.

Jeff Deen, a former assistant state attorney in Florida and the head of a state agency that represents criminal defendants, said that strict rules having to do with character evidence will likely make Martin's texts and photos inadmissible at trial.

&quot;What does his mom saying he needs to live with his dad for a while say about why he was shot?  Nothing,&quot; he said. &quot;Generally, reputation evidence is not admissible in court.&quot;

But Mark O'Mara, the lead defense attorney for Zimmerman, said he will try to use the new evidence during Zimmerman's trial on June 10.

But an attorney for Martin's family argued that the pretrial evidence release consisted of &quot;irrelevant red herrings.&quot;

&quot;Is the defense trying to prove Trayvon deserved to be killed by George Zimmerman because of the way he looked?&quot; Benjamin Crump said in a statement on Thursday.

&quot;If so, this stereotypical and closed-minded thinking is the same mindset that caused George Zimmerman to get out of his car and pursue Trayvon, an unarmed kid who he didn't know. The pretrial release of these irrelevant red herrings is a desperate and pathetic attempt by the defense to pollute and sway the jury pool.&quot;

Martin's death spurred a national conversation about guns and Florida's expansive &quot;Stand Your Ground&quot; self-defense law, which allows people to use deadly force if they believe they are in danger of being injured or killed.  In April, Zimmerman waived his right to a pre-trial &quot;Stand Your Ground&quot; immunity hearing, guaranteeing his June trial before a jury.

On Thursday evening, Zimmerman's defense team also filed a request for a delay in the trial.

 appeared on Fox News this afternoon to champion new evidence his team 
plans to use in defense of his client's innocence in the alleged 2012 
murder of Florida teen  Trayvon Martin . New photographs and text messages show a &quot;three-dimensional image of Trayvon,&quot; O'Mara said while describing the new evidence.
The first piece of evidence was a photograph extracted from Martin's 
cell phone, showing a hand holding a gun. O'Mara wouldn't say whether he
 believes that hand belongs to Martin, but that if the court decides to 
focus on the &quot;broader&quot; picture of both Zimmerman's and the late 
teenager's pasts, then it will become a relevant question.&quot;If Trayvon Martin's propensity for violence becomes relevant, then I
 think the jury can consider the fact that he has several pictures of a 
gun,&quot; O'Mara explained of why he might consider the photograph 
admissible in court.
O'Mara also revealed the images and text messages related to marijuana that were found on Martin's phone

Asked by   Megyn Kelly  
 how these could possibly become relevant in court, the defense attorney
 explained: &quot;We know that there was pot in Trayvon Martin's system the 
night of the event. One of the state's experts has said that that level 
of THC in his system, while it may not be enough to get you arrested for
 DUI, could definitely have an impact and make you impaired.&quot;
O'Mara also claimed that text messages found on Martin's phone reveal
 that the deceased teenager &quot;had involved himself in some street 
fighting.&quot; The defense lawyer cautioned once more that these pieces of 
evidence will only become relevant if the court decides to consider &quot;who
 Trayvon Martin was&quot; rather than just the events that occurred within 
the moments before his death.
Asked by Kelly to assess Zimmerman's chances in court, O'Mara 
concluded: &quot;He's innocent. He acted in self defense from day one... He's 
going to be acquitted.&quot;

 The defense team also want to use blood tests that show traces of marijuana in Martin's system  Explosive new pictures from Trayvon Martin's cell phone show the slain Florida teenager blowing smoke rings, a photo of a gun and what appears to be a marijuana plant.

 

The data released on Thursday by George Zimmerman's attorneys also include worrying text messages with a friend about fighting, smoking pot and being forced to move out of his mother's house because of trouble at school.

 

A hearing next week will decide if the information can be used at the trial for Zimmerman, who is charged with fatally shooting the unarmed 17-year-old last year.

 

Prosecutors want the negative evidence omitted, but Zimmerman's lawyers said if they try to portray his client as the antagonist and Martin as the victim, he wants to show the jury that Martin has talked about fighting before
On November 22, 2011, three months before the shooting, Trayvon wrote messages about being involved in a fight. His unnamed opponent, he wrote: 'got mo hits cause in da 1st round he had me on da ground an I couldn't do ntn. (sic)'

 

Six weeks earlier he wrote a text about problems at school involving a fight: 'I was watcn a fight nd a teacher say I hit em. (sic)'

Prosecutors have filed a motion asking Circuit Judge Debra Nelson to prevent the photos, texts and other personal information from being used at the trial. 


The hearing is set for next Tuesday when the judge also will consider the motion to delay the trial.

Attorneys for Martin's parents said in a statement that the photos and texts were irrelevant to the trial and could pollute the jury pool.

'Is the defense trying to prove Trayvon deserved to be killed by George Zimmerman because (of) the way he looked?' they said.

'If so, this stereotypical and closed-minded thinking is the same mindset that caused George Zimmerman to get out of his car and pursue Trayvon, an unarmed kid who he didn't know.'

As for the delay, O'Mara said he needed more time to review the qualifications of a prosecution witness with an expertise in speech identification. 

 


O'Mara said prosecutors only made him aware of the expert a short time ago. The expert could be used to testify whose voices were on 911 calls that captured the fatal fight between Zimmerman and Martin.

O'Mara said in an interview that he needed another month or two to prepare. He also said that he is going to ask a judge to sequester not only the jury but the jury pool in the upcoming trial. That may involve sequestering 500 potential jurors in order to find six people who can serve on the jury.
 
 
 

The texts and pictures come after Zimmerman's attorneys released photos showing evidence related to the night in February 2012 when the neighborhood watch volunteer shot and killed Martin.


The new batch of photos include pictures of Martin's belongings on the night he was killed including the cell phone he used to speak to his girlfriend for the last time, plus the Skittles and bottle of ice tea he had just bought at a local 7/11.


Defense attorneys have issued the photos as they prepare for Zimmerman's upcoming second-degree murder trial, which is scheduled to begin June 10

Defense attorneys had to list all evidence turned over to prosecutors. It include items they opted not to make public because of Florida privacy laws, including half dozen autopsy photos of Martin plus 17 taken of him at the scene of the shooting.

The 29-year-olf former Neighborhood Watch volunteer killed Trayvon, an unarmed black 17-year-old, on Feb. 26, 2012, after calling Sanford police and describing the teenager as suspicious.


Zimmerman's defense team also filed a motion on Tuesday asking the judge to deny a request by prosecutors to ban blood samples from Trayvon Martin's autopsy from being submitted as evidence during the trial.

According to Zimmerman's lawyers, the results of those blood tests showed traces of marijuana in Martin's system, and they argue jurors should know that.</description>
