Police Officer William Stadnick is not to blame for the Feb. 22 incident in which his squad car struck city resident Ludwig Lomberk, 73, in his motorized wheelchair, behind a grocery store.
Lomberk suffered a broken leg in the collision and is still in the hospital recovering from his injury, according to his girlfriend.
Dashcam video shows Lomberk crossing the street in the middle of the road from the back of the Save-A-Lot grocery store.
It was raining and Stadnick was traveling south on the road. Lomberk appears on the screen in his motorized wheelchair only moments before he was struck. The crash knocked Lomberk out of his chair.
Maria Robles, who lives at Lomberk's home said he is in the Intensive Care Unit at South Jersey Healthcare Regional Medical Center. His condition is improving, she said.
Robles said Lomberk did not talk to her about the accident and would not be available to comment.
Robles said Lomberk often crossed in the middle of the street when in his motorized wheelchair, rather than crossing at the traffic light at 2nd and Broad streets.
Stadnick, a two-year veteran of the police department, was not hurt and did not take a leave during the investigation, Grennon said.
"We don't believe he's at fault," Grennon said of the officer, noting it was dark and rainy that night.
"It's one of those things you have to see the video three or four times before" you see Lomberk appear.
"On the fifth time, if someone really wants to nitpick they can say he should have" seen Lomberk.
"If you're in a car and were driving that night it would have been really hard to see him."
