Rumor confirmed: Murdered agent Terry armed with beanbag rounds

* March 3rd, 2011 1:24 pm ET

Do you like this Article?

“Files add some clarity to Terry's death,” The Arizona Daily Star is reporting. “Agents used beanbags against migrants, who replied with gunfire.”

This corroborates a rumor that has been widely circulating since the mid-December shootout, when Border Patrol Agent Brian Terry was fatally wounded in Peck’s Canyon after encountering armed illegal immigrants who would not obey commands to drop their weapons.

A key point is highlighted in this new report:

The Terry family remains upset about allegations that the Bureau of Alcohol, Tobacco, Firearms and Explosives allowed a gun smuggler it was investigating to purchase and smuggle into Mexico the weapons used in the shootout in which Terry died. The Justice Department has denied the allegations, but U.S. Sen. Charles Grassley, R-Iowa, continues to insist on the validity of the claims.

Another key point remains unresolved. The autopsy has shown “Terry was shot once in the lower back, about 29 inches down from the right shoulder…The bullet found inside his body was one used with AK-47s...”

So of course this means the government also knows which gun was used to kill Agent Terry. That the Justice Department refuses, as yet, to confirm that points to the same intentional stonewalling that kept the beanbag information suppressed for so long.

Officials who do not want information about the circumstances of Agent Terry’s death and about wider “Project Gunwalker”* allegations to come to light are engaging in a cover up. That makes redoubled efforts by Senator Grassley of utmost importance. Reports indicate the Department of Justice missed the Feb. 23 deadline he gave them to begin producing documents, and this correspondent left a voice mail with Grassley’s press secretary seeking confirmation of that.

This also highlights the critical need for Rep. Darrell Issa to initiate parallel oversight hearings in the House. It is clear ATF management and their DOJ handlers have no intention of producing information unless it is dragged out of them.

Let the dragging begin.

*Note to newcomers to this story: “Project Gunrunner” is the name ATF assigned to its Southwest Border Initiative to interdict gun smuggling to Mexico. “Project Gunwalker” is the name I assigned to the scandal after allegations by agents that monitored guns were allowed to fall into criminal hands on both sides of the border through a surveillance process termed “walking” surfaced.

The Truth About Guns has been following the ATF’s Gunwalker Scandal for some time. That’s the name given by Gun Rights Examiner writer David Codrea to the stink surrounding the revelation that the Bureau of Alcohol, Tobacco, Firearms and Explosives (and Really Big Fires) allowed smugglers to purchase guns in the United States—and failed to intervene in their journey down the so-called Iron River to Mexico. (Codrea was riffing on the name of the ATF’s interdiction efforts: Project Gunrunner.) The scandal got serious when smugglers used one of those guns to murder U.S. Border Patrol Agent Brian Terry. Allegations of an ATF coverup ensued. And now we learn that Mexican drug thugs used another Gunwalker gun to murder ICE Special Agent Zapata. Time to sort out who did what when, who knew what when, and what’s going to happen now.

FOIA received

ATF has received the Freedom of Information Act request I sent them on Feb. 16. Why they did not even receive it until Feb. 28 is a curiosity I have no answer for. They have 20 business days to respond from their dater of receipt. So we should see something by the end of this month.

We should…

The CBS report indicated a schism within the ATF. Will ATF, ICE and Border Patrol Agents start coming forward with more revelations?

Many of us have been keeping this story alive through various blogs and friendly conservative websites, it is absolutely maddening that the MSM will not start doing their job?

david codrea:
We certainly hope so--I've been advocating them having an "I am Spartacus!" moment, but then it is not my neck on the line--and when you look art some of the retaliatory abuse and expenses some who have bucked the system have had to endure, it's understandable why most have remained in the background
