cctv shows victim's wife lied about road rage attack with tire iron

The Licking County prosecutor was working to determine whether charges would be filed against two drivers who were involved in an apparent road rage incident.

Last week, a man told that he was attacked at a gas station along state Route 158 after tangling on the road with another driver.

A man who asked to be identified only as Carl, said that he was in the passing lane along Interstate 70 when the incident started.

"They came up on me pretty fast," Carl said. "I couldn't see their headlights. They were so close. I did brake (to) try to get him to back off."

The other driver, Wyatt Malaby, said that Carl attempted to run him off the road.

Investigators said that they may never know what really happened along I-70, but video taken from surveillance cameras at the gas station showed both men pulled over and were set to fight.

Gloria Malaby, the wife of Wyatt Malaby of Zanesville, told a news station, last Sunday that her husband was beaten with a tire iron by another driver.

But CCTV video showed Malaby exiting his truck and was carrying the tire iron.

"I said, 'You don't need a tire iron. Why do you need a tire iron?'" Carl said.
"He said, 'I'm going to bust you in the head with it.'"

Carl said that he has a steel plate in his head so he wanted to defend himself so he would not be hit.

He threw a single punch and Malaby went down.
"I thought to myself, 'Oh God, what did I do?'" Carl said.

Carl left the scene but later called investigators and told them his side of the story.

He said that he acted in self-defense but investigators asked him why he exited the highway in the first place.

"I should have just kept driving," Carl said.

Malaby was taken to a hospital.
The blow to his head left him with no memory of the attack.
