UTICA - The police officer who was assaulted at the corner of James Street and Dudley Avenue he said he blacked out after he was kicked and punched in the head about 20 times, according to his own statement to investigators.
Police Officer Dzenan Sabanovic, 24, suffered a broken nose, a minor concussion and several abrasions following the attack, and three people have since been charged with assaulting him, police said.
According to Utica City Court records, Darnell and Terrell Howard were
taken into custody moments after additional police officers arrived to
Their mother, Lorraine Howard, 44, was charged as well for trying to prevent police from arresting her sons at their Dudley Avenue residence, police said.
On Thursday afternoon, the third participant - 16-year-old Hector McClain of Utica - was located in Albany on an arrest warrant after fleeing the city, police said.
Sabanovic's statement to investigators describes how events quickly spiraled out of control after his patrol vehicle was flagged down by an employee of the James Street Market. Police officials also said the store's video surveillance captured the attack as it happened,
Someone had damaged the store's front door, and Sabanovic was questioning McClain regarding the criminal mischief complaint when they were approached by two teenagers shortly before 6 p.m.,according to Sabanovic's statement.
When Sabanovic asked McClain about the incident, McClain replied, "He thinks he has me on camera," Sabanovic told police.
"You don't have to tell him nothing," one of the teens then told McClain, Sabanovic stated.
As Sabanovic ordered the disruptive teen to back away, a third teen was encouraging McClain to leave. McClain then began to walk away, but Sabanovic stood in front of him and grabbed his arm.
That's when the two teenagers - Darnell, 17, and Terrell Howard, 14 - began to punch Sabanovic while McClain stood by watching, Sabanovic stated. At some point, McClain took Sabanovic'sbaton and uniform hat."I fell to the ground and I continued to get punched and kicked in the
head and face," Sabanovic stated. "I blacked out from being hit and kicked."
During the attack, Sabanovic called for assistance on his police radio. When police Officer Jeremy Nash arrived, the suspects ran away, he stated. Sabanovic assisted Nash and other officers in chasing the suspects to the porch of their Dudley Avenue residence.
As police tried to take the youths into custody, their mother, Lorraine
Howard, pushed Nash, according to police reports. She was charged with
resisting arrest, obstructing governmental administration and
second-degree harassment, police said.
*Darnell Howard was charged with second-degree assault, obstructing governmental administration and fourth-degree criminal mischief for causing more than $250 in damage to Sabanovic's radio handset, police said. He was also charged with another count of criminal mischief and second-degree harassment after he pushed police Officer Michael Murphy and ripped a shoulder microphone from the patrolman's uniform, police said.
* Terrell Howard was charged with assault as well, but the juvenile's case is being handled through Family Court.Darnell and Lorraine Howard pleaded not guilty Thursday in City Court, and they both are due back in court on Monday for a possible felony hearing.
* On Thursday, McClain was charged with second-degree assault, fourth-degree criminal possession of a weapon for taking Sabanovic's baton, and petit larceny for stealing Sabanovic's police hat, police Capt. John Toomey said.
McClain was also charged with felony third-degree criminal mischief for damaging the store's door.
This is the second time in two months in which a hostile confrontation erupted after Utica police encountered suspects on James Street. Just one block away from Wednesday's incident, four people were arrested July4 after officers Howard Brodt and Donald Greico were injured while apprehending suspects.
Sabanovic has been with the Utica Police Department for about a year, Stemmer said.
He was treated at St. Elizabeth Medical Center for his injuries and the
department hopes to have Sabanovic return to work in a "speedy manner."
