A U.S. Marine punched me in the head, knocking me out, after i touched his medals, Can I file a lawsuit?

I was at the K Mart, and saw a Marine, I called him a baby killer. He ignored me. So then
I touched his medals and said, You get these for killing babies. I spit on him.

Next thing i know, i was on the ground unconscious the next minute.

I did not think he would have the guts to hit me in public, the K Mart, in a public place. The store was empty. Maybe if it was more crowded, he wouldnt have done anything.

I thought they cant freaking hit you if they are in uniform?

I awoke 10 minutes later in an ambulance. They told me at the hospital, he hit me like 5 and 6 times, after i was out cold. I have 2 missing teeth, and a swollen nose, and swollen eyes and 2 bruises on my head. My hospital bill is over $10,000, including ambulance ride. Can I file a lawsuit against the military, to get them to pay my hospital bills?

Plus I missed 3 weeks of work, I lost over $1200 in work pay.

Also, they dropped the charges against this guy? How can I re-press them against him?

I think he should have charged civily and criminally, I had no clue a uniform man would attack somebody in public place.

If you are in America, you can sue. Anyone with the money to file the case at the local courthouse can, regardless of how petty or inaccurate, frivolous or unjust the case is, as this is how we keep lawyers in business in this country.

The problems for you are:
(1) the judge probably won't see your side and
(2) the Marine can counter sue you, and you can get stuck with paying the bill to launder his uniform, as well as physical pain and suffering to his hand and emotional pain and suffering from the incident, and depending on which state you are in, if he has a good lawyer, he will get you to pay all the court costs, too, which can easily run into tens of thousands of dollars.

Unless you live in San Francisco, I would recommend you move on.

IMO, you got everything you deserved.

Be thankful he only hit you 5 or 6 times. You spit on me, and I'd hit you 5 or 6 times before you even hit the ground!

By spitting on him, you assaulted him first. Who knows, he may now had some disease that could affect his future! I'd expect him to be sending you the bill for his blood test.

First of all you insulted a Marine. This person has fought for your freedoms, and you abuse it. You touched this man without permission, that is assault. Then you spit on him, that is battery with a bodily fluid. Your lucky that you are still living.

Maybe you could, I'm not from the US. But let me tell you, if you did that to one of our Marines here in the UK you would have got the same punishment. Spitting is an assault, plus you called him a baby killer, when infact you have no idea what that poor soldier has been through, hes probably seen his comrades heads blown of and all kinds. And he has to come home to twunts like you, the people whos freedom he is fighting for.

Maybe you can conduct a law suit against him. But in my book you got what you deserved.

I have seen similar post, that I believe are as bogus as this one, but if this is real you surrendered your rights when you touched him. You assaulted him and I am sure he is suffering from mental distress from having to beat you down like the fool you appear to be. Yes, you can sue any one you want. No, you will not win because you started the fight and have no witness, and if you are as worthless in reality as you appear in this posting, you will piss off the jury too. If you sue, I hope he counter sues, but what would anyone gain from suing someone who makes $400 a week and hangs out at K-Mart. At least by hanging out at K-Mart you are not cruising the Junior High Schools. If you missed 3 weeks of work because you were missing some teeth, I hope they firer you for missing work.
