An Army National Guardsman and Iraq war veteran found himself in jail, charged with “committing a terroristic act and wearing body armor while committing a felony offense” after he was arrested while jogging and holding an air-soft gun.
William Everett Alemar was taken into custody after police in Martinsburg, W.Va. responded to multiple calls at 7 a.m. on Aug. 20 about a man running down the road near a school in army fatigues and a protective vest, clutching what looked like an assault rifle.
Shortly after, three officers reportedly pulled their weapons and ordered Alemar to the ground and took the rifle from his hands. Police soon found out that the rifle was merely an air-soft “training” AR-15 rifle that anyone can buy at their local sporting goods store. The Herald Mail reports the gun also had the “red tip” that indicates it was a toy gun. However, police also found two knives, a
number of empty rifle magazines and ceramic plates in his vest.

Alemar, 23, of Martinsburg, was charged with committing a terrorist act and wearing body armor while committing a felony offense, according to police and court records.
Alemar is charged with violating a state law covering acts that are likely to result in serious bodily injury or intended to intimidate or coerce the civilian population. If convicted, he faces as many as three years in prison and as much as $25,000 in fines, according to state code.
Alemar could get another two to 10 years if convicted of a charge of wearing body armor while committing a felony offense.

Alemar was actually drunk, registering a .213 blood-alcohol reading. The legal limit for motorists in West Virginia is .08 percent.
While there is certainly an argument to be made that running with anything that resembles a rifle and also carrying knives and empty magazines — especially when intoxicated — is unintelligent, there will surely be some debate over whether his actions warranted being charged with a felony and labeled a “terrorist.”

Why is wearing body armor while committing a crime a crime in of itself BUT EVEN MORE SO. Why is it illegal to carry a toy gun when it's completely legal to carry a real gun?!
I've even been thinking about buying a jacket and keeping it in my trunk, what is that illegal if I have body armor in conjunction with a handgun? You can own a gun but you can't make it harder for someone to kill you if they want to?

ok im normally on the police/government side but this is complete BS, from what i know he was probably training, its better to train by wearing all your gear and carrying a weapon so your used to it and know you can do it without problems

I'm not a big fan of people jogging with body armor and assault rifle BUT as soon as you find out that it's a paint-ball you tell him that this is bad and wake police for nothing...

So, doing a military work out is illegal. such B.S. Nanny State. Guess the WV National Guard needs to be arrested also while training in the state. Body conditioning. many Soldiers do it. Drop the charges....

They always pile on charges after arrest, then reduce them in according to what they can prove by the time it comes down to a trial. You have to be pretty naive to think this is ok to do, seeing as how the media has everyone in fear of mass shootings.
