A 25-year-old Altamont man was sentenced today to two years in the South Dakota State Penitentiary for soliciting a minor.

Brian Todd Bublitz was arrested this summer after arranging a meeting with what he thought was a 13-year-old girl.

Bublitz told the undercover officer posing as the girl during an online chat that he would pay her $300 to defecate in a diaper and have sex with him.

Due to prior complaints and a psychosexual evaluation that indicated a high danger of re-offending, Minnehaha County State's Attorney Aaron McGowan told Judge Patricia Riepel that Bublitz deserved the maximum sentence for soliciting a minor.

McGowan said Bublitz was accused of but never charged with rape and sexual torture involving a diaper in Deuel County and admitted to having sex with a 15-year-old girl there.

Another undercover officer in Pennington County who was posing as a 14-year-old girl engaged in explicit chats with Bublitz in March, McGowan said. That same month, police stopped a teen who'd met Bublitz in a chat room from going to his house.

“Before the court today is an individual whose poor choices and inability to control his urges makes him a danger to the community,” McGowan said.

Defense attorney Richard Johnson told the judge his client needs serious help but would be more likely to get it through a sentence of probation and counseling.

He wants to overcome his obsessions, be rehabilitated, get married and start a family someday, Johnson said.

“If it's possible to change those habits, this is his best shot at it,” he said.

Bublitz wept as he apologized for his actions.

“I'm willing to go to counseling for the rest of my life,” he said.

“Mr. Bublitz, this is probably the most disturbing psychosexual (evaluations) I have ever read,” Reipel said. “You are a very dangerous man, and at the same time, very sad man … this court can't trust you on probation.”

Because Bublitz has already served 155 days in the Minnehaha County Jail and this is his first felony conviction, he will be released from prison in less than two years. Reipel also ordered Bublitz to complete an extensive sex offender counseling as a condition of parole.
